Abstract

The increasing prevalence of gratification practices continues to erode the integrity of numerous officials, including executives serving in ministerial positions. This situation underscores a critical issue: existing regulations governing gratification practices heavily rely on the awareness and willingness of gratification recipients to report such acts to the Corruption Eradication Commission (KPK). Meanwhile, ministries themselves already have an internal supervisory body known as the Government Internal Supervisory Apparatus (APIP), authorized to conduct internal oversight. APIP’s position within institutions makes it a strategic body for preventing gratification. However, APIP still faces several challenges, including limited authority and low operational efficiency. Using a doctrinal research method, this study adopts a statutory and conceptual approach to analyze the problems and propose solutions through qualitative elaboration. The data used in this research are secondary data sourced from literature studies, primarily derived from the Corruption Prevention Network portal. The findings and conclusions of this study reveal that APIP’s limited authority and low efficiency in performing its duties as an internal supervisory body can be addressed through synergy between APIP and KPK. This can be achieved by expanding APIP's authority to report suspected gratification to KPK and granting KPK the authority to act as a mentor for APIP to enhance its capabilities. These two approaches are seen as efforts to optimize the prevention of gratification practices within ministries.

Abstract

Abstrak Disrupsi ekonomi membawa paradigma baru dalam operasional suatu pekerjaan misalnya jasa ojek konvesional yang bertransformasi menjadi layanan ojek online. Kemudahan menjadi mitra dan fleksibilitas yang ditawarkan dalam pekerjaan tersebut nyatanya justru memiliki risiko yang sangat besar. Faktanya banyak mitra ojek online yang mengalami eksploitasi pekerjaan seperti durasi kerja yang panjang, pendapatan yang kecil, hingga tidak adanya jaminan keselamatan kerja. Melalui metode penelitian yuridis normatif yang didukung dengan studi kepustakaan, artikel ini menjawab permasalahan tersebut berdasarkan lingkup hukum. Adapun hasil penelitian menunjukkan bahwa upaya pemberian kesejahteraan bagi gig workers dapat dilakukan melalui penerapan doktrin unjust enrichment, yaitu suatu doktrin yang digunakan agar gig workers dapat melakukan upaya hukum apabila merasa bahwa perjanjian kemitraan yang ada merugikan dirinya.   Kata Kunci : Gig Workers; Partnership Agreement; Unjust Enrichment   Abstract Economic disruption brings a new paradigm in the operation of a job, for example, conventional ojek services that are transformed into online ojek services. The ease of becoming a partner and the flexibility offered in the job actually has a huge risk. In fact, many online motorcycle taxi partners experience job exploitation such as long work duration, small income, and lack of work safety guarantees. Through normative juridical research methods supported by literature study, this article answers these problems based on the scope of law. The results show that efforts to provide welfare for gig workers can be done through the application of the doctrine of unjust enrichment, which is a doctrine used so that gig workers can take legal action if they feel that the existing partnership agreement is detrimental to them.   Keywords: Gig Workers, Partnership Agreement; Unjust Enrichment
