Abstract

The restorative justice approach is an alternative to case resolution that emphasizes the restoration of relationships between victims, perpetrators, and the community, as well as providing opportunities for perpetrators to take responsibility and correct the mistakes that have been made. In this case, the research explores the process and mechanism of implementing restorative justice, starting from the identification of problems, the involvement of related parties (victims, perpetrators, families, communities, and related institutions), to the remedial steps taken. This study aims to analyze legal protection for children victims of violence and the application of the restorative justice approach in resolving cases of violence against children, especially in the case of abuse of a 12-year-old child by a biological father in Medan Amplas District. The results of the study show that children as victims of violence have certainly been given legal protection by the government which is manifested in the form of legal provisions and the application of the law that. Meanwhile, the restorative justice approach as a form of dispute resolution process can be a constructive solution in reducing the long-term impact on children victims of violence and providing opportunities for perpetrators to make changes. Overall, the application of restorative justice in cases of violence against children can be an important step in creating more sustainable justice and rebuilding relationships within affected families.

Abstract

Negara merupakan suatu organisasi yang memiliki kekuasaan tertinggi dan berdaulat. Sebagai negara yang berdaulat Indonesia harus melindungi hak-hak warga negaranya melalui ketentuan hukum yang berlaku. Perlindungan hak tersebut dapat dilakukan untuk melindungi warga negara dari tindakan kejahatan. Salah satu kejahatan yang eksis akhir-akhir ini adalah kejahatan siber. Kejahatan siber semakin berkembang dengan adanya kemajuan teknologi. Artikel ini digunakan untuk mengetahui bentuk tindakan kejahatan siber dan penetapan surat dakwaan subsidair pada pemidanana pelaku kejahatan siber. Artikel ini menggunakan metode studi Pustaka dengan menggunakan bahan literatul untuk menjawab legal issue. Hasil dari penelitian ini adalah bentuk Cybercrime di klasifikasinya beberapa cara yang antara lain kejahatan yang target utamanya adalah jaringan computer atau device dan kejahatan yang menjadikan jaringan computer sebagai alat yang antara lain adalah revenge porn, cyberstalking, penipuan dan pencurian data, serta phising yang ada karena kemajuan teknologi. Selain itu penetapan surat dakwaan subsidair akan efektif berdasarkan teori efektivitas hukum apabila dapat menjerat pelaku tindak pidana kejahatan siber.

Abstract

The phenomenon of lavender marriage—a marriage between heterosexual and homosexual individuals based on social or cultural motives to maintain the image or fulfill family expectations—is a real challenge in family law practice in Indonesia. This study aims to analyze the forms, motivations, and legal, social, and psychological implications of this practice. Using a qualitative approach with normative-sociological methods, data were obtained through interviews and literature studies which were then analyzed thematically. The findings show that although lavender marriage is administratively valid, this practice is contrary to the maqashid of marriage according to Islamic law and Law Number 1 of 1974, because it ignores the principles of honesty, the goal of building a family, and protection of partners and children. This study emphasizes the importance of a more adaptive regulatory response and social education to prevent the misuse of the institution of marriage as a tool for identity camouflage. This research contributes to the development of family law policies that are more responsive to contemporary social dynamics.
