<![CDATA[Tujuan studi ini untuk menganalisis penerapan sistem matrilineal dalam pembagian warisan pada masyarakat adat Minangkabau. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan historis dan perundang-undangan. Hasil studi menunjukkan bahwa sistem matrilineal di Minangkabau berperan penting dalam menjaga keberlanjutan harta pusaka melalui pengaturan status tanah. Tanah pusaka tinggi tidak dapat diperjualbelikan, tetapi dapat digadaikan dengan syarat tertentu, sedangkan tanah pusaka rendah dapat diperjualbelikan atau digadaikan. Sistem ini mencerminkan upaya perlindungan terhadap hak-hak perempuan, yang menjadi pewaris utama dalam struktur adat Minangkabau. Dalam perspektif hukum adat, tanah pusaka memiliki fungsi sosial yang tidak hanya bernilai ekonomis tetapi juga simbolis sebagai bagian dari identitas keluarga. Oleh karena itu, penerapan prinsip matrilineal bertujuan untuk melestarikan harta pusaka bagi generasi mendatang dan mempertahankan keseimbangan sosial dalam masyarakat. The purpose of this study is to analyze the application of the matrilineal system in inheritance distribution within the Minangkabau customary law. This study employs normative legal research methods with a historical and statutory approach. The findings reveal that the matrilineal system in Minangkabau plays a crucial role in preserving ancestral property through the regulation of land status. High inheritance land (pusaka tinggi) is prohibited from being sold but may be mortgaged under specific conditions, whereas low inheritance land (pusaka rendah) may be sold or mortgaged. This system reflects efforts to protect the rights of women, who are the primary heirs within the Minangkabau customary law structure. From the perspective of customary law, ancestral land holds not only economic but also social and symbolic value as a representation of familial identity. Accordingly, the application of the matrilineal principle aims to safeguard ancestral property for future generations and maintain social balance within the community.]]>
