Abstract

The Village Fund is a strategic instrument to promote the development and welfare of rural communities, as stipulated in Law Number 6 of 2014 concerning Villages. However, its implementation is often hampered by aspects of transparency, accountability, and community participation. This article examines the implementation of the Village Fund program in Boro Village, Sanggar District, Bima Regency, from a legal perspective using an empirical juridical approach. The results indicate that implementation is suboptimal due to weak apparatus capacity and minimal community participation. The principles of transparency and accountability have not been fully implemented. Regulatory strengthening, capacity building, and community oversight and participation are needed for the Village Fund to have a significant impact.

Abstract

There is an overlapping authority between the Constitutional Court (MK) and the Supreme Court (MA) in reviewing laws and regulations. This is evident in the disparity between the Constitutional Court's decisions No. 70/PUU-XXII/2024 and No. 23P/HUM/2024 regarding the age limit for regional head candidates. The Constitutional Court uses the 1945 Constitution as a touchstone, while the Supreme Court uses the Law. This difference creates legal uncertainty. This study aims to analyze the Judicial Review authority of the Constitutional Court and the Supreme Court and formulate a harmonization strategy to avoid disparity in decisions. This study uses a normative legal method with a statutory and conceptual approach to examine the regulation and harmonization of Judicial Review in Indonesia. Harmonization efforts can refer to Law No. 13 of 2022, one of which is through the unification of normative review institutions.

Abstract

Artikel ini membahas kedudukan Dewan Kehormatan Penyelenggara Pemilu dalam memperkuat akuntabilitas penyelenggara pemilu di Indonesia. Permasalahan utama yang dikaji adalah bagaimana kewenangan etik DKPP berkontribusi dalam menjamin integritas, profesionalitas, netralitas, dan tanggung jawab publik penyelenggara pemilu. Penelitian ini menggunakan pendekatan yuridis normatif dengan menganalisis peraturan perundang-undangan, prinsip etik, konsep kelembagaan, putusan DKPP, serta literatur akademik yang relevan. Pembahasan menunjukkan bahwa DKPP memiliki kedudukan strategis sebagai lembaga etik yang melengkapi fungsi Komisi Pemilihan Umum dan Badan Pengawas Pemilu. Peran DKPP tidak hanya terbatas pada pemberian sanksi, tetapi juga mencakup fungsi korektif, preventif, dan edukatif dalam membangun budaya etik penyelenggara pemilu. Temuan artikel ini menegaskan bahwa efektivitas akuntabilitas pemilu sangat bergantung pada konsistensi penegakan etik, pelaksanaan putusan, transparansi proses, dan pembinaan etik berkelanjutan. Oleh karena itu, penguatan DKPP diperlukan untuk menjaga kepercayaan publik serta mewujudkan pemilu yang demokratis, akuntabel, dan bermartabat.

Abstract

This study aims to analyze the regulation of participatory democracy in the formation of Regional Regulations and examine the role of the Regional House of Representatives (DPRD) of Bima Regency in realizing responsive local governance. The research employs an empirical juridical method with statutory, conceptual, and socio-legal approaches. The findings indicate that public participation in the formation of Regional Regulations has been normatively guaranteed under Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan and Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah; however, its implementation in Bima Regency has not been fully optimal. The DPRD of Bima Regency has implemented several mechanisms of public participation, including public consultations and public hearings, yet these mechanisms remain largely formalistic and have not fully provided substantive participatory space for the community. The study finds that obstacles to participatory democracy are influenced by juridical, structural, cultural, and technical factors, including weak technical regulations on public participation, domination of political elites, limited access to information, low public legal awareness, paternalistic political culture, limited participation forums, as well as budgetary and socialization constraints. Strengthening the role of the DPRD is necessary through optimizing public hearings, digitalizing local legislation, enhancing transparency in the Regional Legislative Program, involving vulnerable groups, and reinforcing transparency and accountability in local legislative processes to achieve more responsive, participatory, and democratic local governance.

Abstract

Debates regarding the position and role of the Constitutional Court within the Indonesian constitutional system have become a crucial issue, particularly in the effort to realize a democratic rule of law state. As the guardian of the constitution, the Constitutional Court holds strategic authority in upholding constitutional supremacy while ensuring that democratic principles are properly maintained. This study aims to analyze the position of the Constitutional Court within the Indonesian legal system and its contribution to the realization of a democratic rule of law state. The research employs a normative juridical method with statutory and conceptual approaches, supported by an analysis of Constitutional Court decisions. The results indicate that the Constitutional Court plays a central role in maintaining the constitutionality of laws, protecting the constitutional rights of citizens and controlling the exercise of power to prevent deviations from democratic principles. However, in practice, the Constitutional Court also faces various challenges, including the potential expansion of authority through constitutional interpretation and political dynamics that may affect its independence. Therefore, strengthening the position of the Constitutional Court is necessary through clarifying the limits of its authority, enhancing the integrity of constitutional judges and ensuring consistency in placing the constitution as the primary basis for all decisions. This study affirms that the Constitutional Court is a fundamental pillar in realizing a democratic rule of law state in Indonesia.

Abstract

This study aims to analyze the criminal liability of perpetrators of money laundering under Indonesian criminal law. The research method used is a normative legal approach, involving an examination of relevant legislation and legal literature. The results of the study indicate that the criminal liability of money laundering perpetrators is based on Law No. 8 of 2010 as a special provision and is supported by general provisions in Law No. 1 of 2023 on the Criminal Code regarding criminal liability and the capacity to be held accountable. Its implementation still faces evidentiary challenges, thus requiring strengthened coordination between the Financial Transaction Reports and Analysis Center (PPATK) and law enforcement agencies, as well as enhanced oversight of financial transactions.
