Abstract

Sexual violence crimes have become a significant concern in Indonesian society, particularly in tourist destinations like Bali, where cases involve both domestic and international victims. Despite existing legal frameworks, the investigation of sexual violence crimes in Bali faces numerous obstacles that may hinder effective law enforcement and the delivery of justice. This study aims to analyze the implementation role of police investigators in handling sexual violence crimes within the Bali Police jurisdiction and to identify the obstacles encountered during the investigation process. This research employed an empirical legal research method using qualitative descriptive analysis. Data were collected through in-depth interviews with investigators from Sub-directorate IV of the Directorate of Criminal Investigation of the Bali Police, field observations, and document analysis. The investigation process follows established legal procedures, including report reception, case administration, witness examination, evidence collection, arrest, search, seizure, suspect examination, and case completion. Key obstacles identified include internal factors (such as language barriers with foreign victims and limited specialized training) and external factors (including uncooperative victims due to trauma, lack of witnesses and evidence, delayed reporting, and challenges with victims having special needs). The findings highlight the need for enhanced training programs for investigators, improved victim support services, and strengthened inter-agency coordination to effectively address sexual violence crimes in diverse jurisdictional contexts.

Abstract

Crime is nothing new, its forms and types are increasingly developing along with the times. Various methods and efforts are made to find effective and appropriate ways to overcome this problem. The Indonesian National Police as law enforcers have the duty and responsibility to take action to prevent and overcome criminal acts. The police also have an important role as investigators. This is in accordance with the statement of Article 1 number 1 of the Criminal Procedure Code, Investigation is a subsystem of the investigation which aims to collect initial evidence which will later be used at the investigation stage. In an effort to collect tools and evidence that are indicated as traces of a crime, one of the means used by the Police is the use of tracking dogs or known as the K-9 Animal Unit.

Abstract

This research discusses the legal protection of protected animals under the Law on Conservation of Living Natural Resources and Ecosystems in Indonesia. The existence of protected animals is increasingly threatened, so an understanding of the applicable law is important to prevent violations. The objectives of this study are to (1) determine the legal protection of protected animals, and (2) evaluate the legal consequences of Decision Number 809/PID.SUS/2024/PN DPS on the protection of protected animals. The research method used is normative legal research with a statutory approach, case approach, and conceptual approach. Data collection was conducted through a literature study that involved reading, reviewing, and recording relevant legal sources. The results showed that the legislative framework in Indonesia for the protection of protected animals is regulated in Law No. 5 of 1990, which has been amended into Law No. 32 of 2024. Decision number 809/PID.SUS/2024/PN DPS shows that there are positive and negative impacts on animal protection, where although there are considerations of justice, there is potential for future law violations. This research concludes that the legal protection of protected animals in Indonesia requires strengthening in law enforcement and increasing public awareness. Recommendations are proposed to increase socialization on the types of protected animals and the sanctions that apply to violations.
