Abstract

In Indonesian civil law, there is the concept of civil liability and liability in cases of default and unlawful acts. This research aims to provide answers regarding civil liability and liability in the context of default and unlawful acts, as well as to prepare lawsuits related to these matters. The purpose of this study is to explain civil liability, liability in cases of default and unlawful acts, and to address issues related to default and unlawful acts, to effectively prepare lawsuits for these situations. This study uses a normative juridical approach, using secondary data that includes primary and secondary legal materials. This study found that parties who feel aggrieved can file a lawsuit for breach of contract and unlawful acts. The conclusion of this study is that any party facing a lawsuit must consider the civil law system in Indonesia to effectively defend their rights against claims that do not correspond to the actual losses incurred.ABSTRAKDalam hukum perdata Indonesia, terdapat konsep tanggung jawab perdata dan tanggung gugat dalam kasus wanprestasi dan perbuatan melawan hukum. Penelitian ini bertujuan untuk memberikan jawaban mengenai tanggung jawab perdata dan tanggung gugat dalam konteks wanprestasi dan perbuatan melawan hukum, serta untuk mempersiapkan gugatan yang berkaitan dengan hal-hal tersebut. Tujuan dari penelitian ini adalah untuk menjelaskan tanggung jawab perdata, tanggung jawab dalam kasus wanprestasi dan perbuatan melawan hukum, dan untuk mengatasi masalah-masalah yang berkaitan dengan wanprestasi dan perbuatan melawan hukum, untuk mempersiapkan tuntutan hukum secara efektif untuk situasi tersebut. Penelitian ini menggunakan pendekatan yuridis normatif, dengan menggunakan data sekunder yang meliputi bahan hukum primer dan sekunder. Penelitian ini menemukan bahwa pihak-pihak yang merasa dirugikan dapat mengajukan gugatan wanprestasi dan perbuatan melawan hukum. Kesimpulan dari penelitian ini adalah bahwa setiap pihak yang menghadapi gugatan harus mempertimbangkan sistem hukum perdata di Indonesia untuk secara efektif mempertahankan hak-hak mereka terhadap klaim yang tidak sesuai dengan kerugian yang sebenarnya terjadi.

Abstract

Insurance is a risk transfer agreement that is often used by society to this day, and is also used by leasing companies to reduce the risk of default that may occur in leasing financing activities. However, leasing companies often require prospective financing recipients to insure their lives. Is there an obligation for life insurance for the lessee in the main lease agreement? This is the core issue that will be addressed. This research uses a normative type with a descriptive nature, by qualitatively analyzing secondary data including primary legal materials and secondary legal materials directly related to insurance law and financing law obtained through visits to the Trisakti University Faculty of Law Library and internet searches. Credit life insurance is categorized as voluntary insurance that prioritizes the agreement of the parties in concluding the insurance, so the insurance obligation stipulated in a Lease Agreement is a mistake against the fulfillment of the halal causa requirement and the principle of freedom of contract, which results in the Lease Agreement being null and void by law, and the lessee is not required to have life insurance. The Leasing Company (lessor) can only offer the prospective lessee the option to choose credit life insurance or not.
