Abstract

This research addresses the case of a Civil Servant who was previously dismissed honorably not at their own request but later had their civil servant status restored based on Decision Number 17/G/2023/PT.TUN.JKT. The research problem focuses on whether the reinstatement of the civil servant's status aligns with legal regulations and what the legal consequences of this reinstatement are. The study employs a normative legal research method with a descriptive nature. It uses secondary data, analyzed through qualitative methods, and draws conclusions using deductive reasoning. The findings and results is indicate that the reinstatement of the civil servant's status does not comply with legal regulations, as it does not involve the imposition of disciplinary penalties twice. The legal consequence is the emergence of an obligation for the Civil Service Consideration Board to issue a Decree concerning the revocation of the decision of Honorable Dismissal Not at One’s Own Request for ZPA, and ZPA's reinstatement as a Civil Servant.

Abstract

Theoretically and conceptually the final decision means that the Constitutional Court’s decision is the first resort as well as the last resort for justice seekers. If it is related in the context of upholding the supremacy of the constitution, it certainly does not only stop at the cancellation of a norm of law that is contrary to the constitution, but rather how the decision on annulment is then obeyed and implemented. That is because the nature of the final MK decision. However, in the recent constitutional issues, compliance by state institutions in implementing the Constitutional Court’s decision becomes a problem because there are indications of non-compliance to follow up on the final and binding Constitutional Court’s decision. Based on this, the formulation of the problem to be answered in this study is how the level of compliance with the implementation of the judicial review decision in the Constitutional Court for the period 2013-2018. The research is a juridical normative research, with the main data source, namely secondary data, data analysis using analysis Qualitative and approach methods use the statute approach and conceptual approach. The results of this study indicate that there are three categories of levels of compliance with the implementation of the 2013-2018 PUU MK ruling, namely: full compliance; partially obeyed and not obeyed. The results of the study of the authors show that the majority of MK PUU decisions were complied with totaling 59 decisions or 54.12%. However, there are also some decisions that are not obeyed in whole or in other words only partially complied with as many as 6 decisions or equal to 5.50%. Whereas the decisions that were not complied with amounted to 24 decisions or 22.01%. The remaining 20 decisions, or 18.34%, have yet to be identified in terms of compliance because of two things, namely: 1) the constitutionality period given by the Constitutional Court in its decision has not been exceeded, meaning that the legislators still have time / opportunity to follow up; 2) there has been no follow-up at all from the adressat of the decision both normatively and praxis. Thus it can be concluded that the level of compliance with PUU MK decisions for the period 2013 - 2018 is still higher than the level of non-compliance with a ratio of 54.12% compared to 22.01%.

Abstract

In Indonesian civil law, there is the concept of civil liability and liability in cases of default and unlawful acts. This research aims to provide answers regarding civil liability and liability in the context of default and unlawful acts, as well as to prepare lawsuits related to these matters. The purpose of this study is to explain civil liability, liability in cases of default and unlawful acts, and to address issues related to default and unlawful acts, to effectively prepare lawsuits for these situations. This study uses a normative juridical approach, using secondary data that includes primary and secondary legal materials. This study found that parties who feel aggrieved can file a lawsuit for breach of contract and unlawful acts. The conclusion of this study is that any party facing a lawsuit must consider the civil law system in Indonesia to effectively defend their rights against claims that do not correspond to the actual losses incurred.ABSTRAKDalam hukum perdata Indonesia, terdapat konsep tanggung jawab perdata dan tanggung gugat dalam kasus wanprestasi dan perbuatan melawan hukum. Penelitian ini bertujuan untuk memberikan jawaban mengenai tanggung jawab perdata dan tanggung gugat dalam konteks wanprestasi dan perbuatan melawan hukum, serta untuk mempersiapkan gugatan yang berkaitan dengan hal-hal tersebut. Tujuan dari penelitian ini adalah untuk menjelaskan tanggung jawab perdata, tanggung jawab dalam kasus wanprestasi dan perbuatan melawan hukum, dan untuk mengatasi masalah-masalah yang berkaitan dengan wanprestasi dan perbuatan melawan hukum, untuk mempersiapkan tuntutan hukum secara efektif untuk situasi tersebut. Penelitian ini menggunakan pendekatan yuridis normatif, dengan menggunakan data sekunder yang meliputi bahan hukum primer dan sekunder. Penelitian ini menemukan bahwa pihak-pihak yang merasa dirugikan dapat mengajukan gugatan wanprestasi dan perbuatan melawan hukum. Kesimpulan dari penelitian ini adalah bahwa setiap pihak yang menghadapi gugatan harus mempertimbangkan sistem hukum perdata di Indonesia untuk secara efektif mempertahankan hak-hak mereka terhadap klaim yang tidak sesuai dengan kerugian yang sebenarnya terjadi.

Abstract

The re-existence of the TAP MPR has sparked academic interest, but there are still aspects that have gone unnoticed, namely those related to the study of the legislative struggle and why the TAP MPR is included in the types and hierarchy of laws and regulations. The re-existence of the TAP MPR ultimately has legal implications, so it is important to initiate the direction of its content material in the future. Therefore, this paper examines these issues with the aim of enriching the academic space for discussion regarding the re-existence of the TAP MPR. This study was carried out in a juridical-normative manner using a statutory approach and using secondary legal sources in the form of primary legal materials of the 1945 Constitution of the Republic of Indonesia, Law No. 12 of 2011 and UU No. 13 of 2022, minutes on the formation of laws and decisions of the Constitutional Court, and secondary legal materials, which include text books and law journals. This study found that the re-existence of the TAP MPR, apart from being a guideline for establishing a state in Indonesia, is also a direction so that the formation of laws and regulations does not deviate from the basis of the state. As for the future TAP MPR content model, this can be realized through beschickking and regelling. The two models of content material must be guided by strict requirements so that their formation is in line with the principle of conformity between types, hierarchies, and content material of laws and regulations. So it can be concluded that there are still various MPR TAPs that are relevant to be used as guidelines in the state, so it is important to emphasize them in the cluster of laws and regulations. Aside from being a foundation for the state to be in line with the law, it is also a direction so that the formation of the PUU under it does not deviate from the basic direction of the state.
