Abstract

Penelitian ini bertujuan untuk menganalisis dinamika perlindungan hukum terhadap korban kekerasan berbasis gender (KBG) di era digital, dengan fokus pada kebijakan hukum yang ada dan tantangan dalam implementasinya. Dalam penelitian ini, digunakan pendekatan kualitatif dengan wawancara mendalam terhadap ahli hukum, aktivis gender, dan korban kekerasan berbasis gender digital. Temuan utama penelitian ini menunjukkan bahwa meskipun regulasi hukum terkait kekerasan berbasis gender di dunia digital sudah ada, penerapannya masih terkendala oleh ketidakjelasan prosedur, kurangnya pemahaman tentang hak-hak korban, serta keterbatasan aparat penegak hukum dalam menangani kasus digital. Penelitian ini juga mengungkapkan bahwa faktor budaya dan sosial memainkan peran besar dalam menghambat korban untuk melaporkan kekerasan berbasis gender digital. Berdasarkan temuan tersebut, penelitian ini merekomendasikan penguatan regulasi perlindungan hukum yang lebih komprehensif dan responsif terhadap perkembangan teknologi, serta peningkatan edukasi kepada masyarakat mengenai hak-hak korban dan cara melaporkan kekerasan berbasis gender di dunia maya. Penelitian ini diharapkan dapat memberikan kontribusi dalam pengembangan kebijakan yang lebih efektif untuk melindungi korban kekerasan berbasis gender di dunia digital.

Abstract

Studi ini mengevaluasi efektivitas penerapan mekanisme diversi dalam sistem peradilan pidana anak di Indonesia, dengan tujuan memahami sejauh mana diversi mendukung rehabilitasi anak dan perlindungan hak-haknya. Menggunakan pendekatan yuridis normatif, penelitian ini menganalisis regulasi, data empiris, dan literatur yang relevan untuk mengidentifikasi tantangan implementasi serta solusi yang potensial. Temuan penelitian menunjukkan bahwa meskipun kerangka hukum Indonesia, termasuk Undang-Undang No. 11 Tahun 2012, telah mengadopsi prinsip keadilan restoratif, penerapan diversi masih menghadapi hambatan yang signifikan. Tantangan tersebut meliputi kurangnya pemahaman di kalangan aparat penegak hukum dan masyarakat, keterbatasan infrastruktur, serta data evaluasi yang terfragmentasi. Studi ini menyoroti bahwa keberhasilan diversi sangat bergantung pada kolaborasi lintas sektor, keterlibatan keluarga, dan pendekatan berbasis komunitas. Dibandingkan dengan praktik di negara-negara seperti Belanda dan Swedia, Indonesia perlu meningkatkan pelatihan bagi aparat penegak hukum, mengembangkan infrastruktur rehabilitasi, dan memperkuat dukungan komunitas. Penelitian ini berkontribusi terhadap literatur dengan memberikan wawasan tentang penerapan diversi dalam konteks lokal Indonesia serta menawarkan rekomendasi kebijakan berbasis bukti. Selain itu, penelitian ini mendorong pengembangan sistem evaluasi berbasis data dan fokus pada dampak jangka panjang dari diversi untuk reformasi yang lebih efektif dalam sistem peradilan pidana anak.

Abstract

Children, as the future of a nation, need special attention to ensure they grow into capable and well-rounded individuals. This requires not only proper guidance but also legal support to address any challenges they may face. When children come into conflict with the law, resolving their cases through diversion—using a restorative justice approach—can be a more constructive alternative. This approach focuses on healing and requires the consent of the victim and/or their family, as well as the child’s willingness to participate. This study takes a qualitative approach, gathering data through a literature review using sources from Google Scholar. The research method involves collecting and analyzing relevant written documents. Findings suggest that restorative justice offers a more humane and forward-thinking way to handle juvenile cases. By prioritizing rehabilitation, fostering responsibility, and involving all relevant parties, this method has the potential to create meaningful change for children, victims, and society as a whole.

Abstract

Establishing houses of worship in Indonesia continues to face various obstacles despite constitutional guarantees. Data indicates an increasing trend in religious freedom violations, with 389 cases (2020-2021), 329 cases (2023), and 23 cases (2024), where rejection of house of worship establishments remains the predominant case. This research aims to critically analyze the implementation of the Joint Ministerial Regulation of the Minister of Religious Affairs and Minister of Home Affairs Numbers 9 and 8 of 2006 (PBM), focusing on three aspects: the causal relationship between administrative requirements and obstacles in establishing houses of worship, the impact of Religious Harmony Forum (FKUB) composition on the fulfillment of religious freedom rights, and formulating recommendations for simplifying house of worship establishment requirements. The research employs a socio-legal approach using the parameters of the Center for Religious Freedom and the International Covenant on Civil and Political Rights. Data was collected through in-depth interviews, documentation studies, and source triangulation. The research findings identify three main issues: quantitative requirements becoming structural barriers for minority groups, FKUB's majority-based representation composition creating bias in decision-making, and the decentralization of religious affairs leading to disparate treatment across regions. Policy reformulation is needed through simplifying administrative requirements, restructuring FKUB composition, and strengthening the central government's role in protecting religious freedom to realize the constitutional guarantee of religious freedom.

Abstract

This study examines the effectiveness of penal sanctions for recidivist drug offenders in Indonesia from the perspective of penitentiary law. The findings reveal that Indonesia’s punitive approach, characterized by severe incarceration measures, has failed to reduce recidivism rates, which remain among the highest globally. Comparative analysis with jurisdictions such as Norway, Portugal, and the Netherlands demonstrates that rehabilitation-based justice models, incorporating structured treatment programs and alternative sentencing, have yielded significantly lower recidivism rates. The study identifies key challenges within Indonesia’s criminal justice system, including prison overcrowding, lack of access to rehabilitation programs, and post-incarceration social exclusion, all of which contribute to the cycle of reoffending. The research suggests that a shift toward evidence-based rehabilitative measures, including diversion programs, proportional sentencing, and community-based reintegration efforts, is crucial for improving Indonesia’s approach to drug-related recidivism. By aligning its legal framework with international best practices, Indonesia can develop a more effective and sustainable criminal justice strategy that prioritizes rehabilitation over punitive incarceration.

Abstract

Indonesia is a constitutional country, its formation is based on legal principles and norms through a mutual agreement called the 1945 Constitution. The Constitution is one of the pillars of nationality in formulating the values and norms of the state. On the one hand, even though Indonesia is not a religion-based country, the 1945 Constitution substantially has very strong religious values and doctrines, especially Islam. Therefore, the author in this article will focus on analyzing how to harmonize religious values in the constitution through a comparative study of the text between the Qur'an and the content of the 1945 Constitution, specifically article 29 paragraphs 1 and 2. This research-based article uses normative juridical analysis with the type of literature research. The author traces sources in various literature, academic manuscripts, official documents, books of tafsir, then studied and then analyzed using the theory of legal harmonization. Conclusion of this article, the author finds that in principle there is a correspondence between the values of norms in article 29 paragraphs 1 and 2 of the 1945 Constitution with several verses of the Quran, for example in Al-Ikhlas, Al-Maidah, and Al-Baqarah. This connectedness can be seen in the spirit of prioritizing the values of justice and humanity. Keywords: Harmonization, UUD 1945, Islam, Qur`an, Justice.
