Abstract

This article discussed about the experience of al-Qodir Boarding School in SlemanYogyakarta in the effort to counter the radicalism through the approach of peacebuilding. Applying qualitative approach, this research using the methods ofobservation and deep interview in collecting data. With the theoritical frameworkof cognitive peace building, three factors of peace building became the focus; themechanism of internal group, among group and external group. The mainresearch finding here was the essential role of kiai in building participativedialogue with the community out of the boarding school which was implementedthrough social actions. It resulted in the ability of al-Qodir Boarding School informulating the strategy of radicalism counter which became a typical strategy ofpesantren among so many strategies to find out new formulations in avoiding themovement of radicalism in Indonesia.***Tulisan ini akan membahas tentang pengalaman Pondok Pesantren Al-Qodirterhadap upaya counter-radikalisme melalui pendekatan bina-damai di SlemanYogyakarta. Penelitian ini menggunakan metode kualitatif dengan melakukanpengamatan serta wawancara mendalam. Kerangka teoritik yang digunakanpeneliti adalah teori peace building. Perdamaian menurut teori ini bisa terciptakarena tiga faktor; mekanisme internal, antar kelompok dan eksternal. Temuandari riset ini adalah adanya peran penting kiai dalam membangun dialogpartisipatif dengan masyarakat luar pesantren yang terimplementasi melaluiaksi-aksi sosial. Hasilnya Pesantren Al-Qadir mampu merumuskan strategicounter-radikalisme yang khas pesantren ditengah upaya banyak pihak mencariformulasi baru dalam menangkal gerakan radikalisme di Indonesia.

Abstract

The condition of interfaith relations in Indonesia faces many challenges as intolerance increasingly occurs in various regions. The action can be seen from various violations of freedom of religion and belief, the prohibition of establishing houses of worship, and violence against minorities. One of the causes of these problems relates to the law and several regulations in interfaith relations in Indonesia. This article tries to look at the regulations and legal aspects of interfaith relations and their impact on the conditions of diversity in Indonesia. Using an empirical-legal approach, this article explores legal materials and phenomena related to the interfaith relation in Indonesia. This article reveals that the Constitution has been firmly guaranteeing and protecting all citizens from expressing their beliefs. Nevertheless, several cases show a contrary of the law objectives on interfaith relations in Indonesia. Moreover, in some particular cases, the state seemed to be absent in the locus of incident and favor of freedom violation victims instead.

Abstract

Abstract: The meaning and recognition of religions in Indonesia are closely related to politics. Political sentiment during the transition of power from the old order to the new order affects how the State interprets religion in the constitution. Especially during the New Order period, minority religions or beliefs received discriminatory treatment, this fact was evidenced by various regulations that were impartial and protected minority religions and until now these policies continue to be used. The state, in this case, the government is intensively campaigning for the idea and practice of diversity, tolerance, and religious moderation, along with which there are many cases of violence and discrimination based on religious backgrounds. Using a socio-juridical approach, the author then found many regulations related to religion and beliefs that are still discriminatory and do not protect all citizens of the nation, as mandated by the 1945 Constitution.Keywords: Religion, Regulation, Discrimination, Diversity, Government.Abstrak : Pemaknaan dan pengakuan Agama-agama di Indonesia sangat berkait erat dengan Politik. Sentimen politik saat peralihan kekuasaan dari orde lama ke orde baru berpengaruh terhadap bagaimana Negara memaknai Agama di dalam konstitusi. Terlebih di masa Orde baru agama atau kepercayaan minoritas mendapatkan perlakuan yang diskriminatif, fakta itu dibuktikan dengan berbagai macam regulasi yang tidak berpihak dan melindungi agama minoritas dan sampai sekarang kebijakan-kebijakan tersebut terus digunakan. Negara dalam hal ini pemerintah sedang gencar mengkampanyekan gagasan dan praktik kebhinekaan, toleransi, serta moderasi beragama, seiring dengan itu muncul banyak kasus kekerasan dan diskriminasi berlatar belakang agama. Dengan menggunakan pendekatan sosio-yuridis penulis kemudian menemukan  banyak regulasi-regulasi berkaitan dengan agama dan kepercayaan yang masih bernuansa diskriminatif dan tidak melindungi segenap warga bangsa, sebagaimana amanat UUD 1945.Kata Kunci: Agama, Regulasi, Diskriminatif, Kebhinekaan, Pemerintah.

Abstract

Establishing houses of worship in Indonesia continues to face various obstacles despite constitutional guarantees. Data indicates an increasing trend in religious freedom violations, with 389 cases (2020-2021), 329 cases (2023), and 23 cases (2024), where rejection of house of worship establishments remains the predominant case. This research aims to critically analyze the implementation of the Joint Ministerial Regulation of the Minister of Religious Affairs and Minister of Home Affairs Numbers 9 and 8 of 2006 (PBM), focusing on three aspects: the causal relationship between administrative requirements and obstacles in establishing houses of worship, the impact of Religious Harmony Forum (FKUB) composition on the fulfillment of religious freedom rights, and formulating recommendations for simplifying house of worship establishment requirements. The research employs a socio-legal approach using the parameters of the Center for Religious Freedom and the International Covenant on Civil and Political Rights. Data was collected through in-depth interviews, documentation studies, and source triangulation. The research findings identify three main issues: quantitative requirements becoming structural barriers for minority groups, FKUB's majority-based representation composition creating bias in decision-making, and the decentralization of religious affairs leading to disparate treatment across regions. Policy reformulation is needed through simplifying administrative requirements, restructuring FKUB composition, and strengthening the central government's role in protecting religious freedom to realize the constitutional guarantee of religious freedom.

Abstract

Indonesia is a constitutional country, its formation is based on legal principles and norms through a mutual agreement called the 1945 Constitution. The Constitution is one of the pillars of nationality in formulating the values and norms of the state. On the one hand, even though Indonesia is not a religion-based country, the 1945 Constitution substantially has very strong religious values and doctrines, especially Islam. Therefore, the author in this article will focus on analyzing how to harmonize religious values in the constitution through a comparative study of the text between the Qur'an and the content of the 1945 Constitution, specifically article 29 paragraphs 1 and 2. This research-based article uses normative juridical analysis with the type of literature research. The author traces sources in various literature, academic manuscripts, official documents, books of tafsir, then studied and then analyzed using the theory of legal harmonization. Conclusion of this article, the author finds that in principle there is a correspondence between the values of norms in article 29 paragraphs 1 and 2 of the 1945 Constitution with several verses of the Quran, for example in Al-Ikhlas, Al-Maidah, and Al-Baqarah. This connectedness can be seen in the spirit of prioritizing the values of justice and humanity. Keywords: Harmonization, UUD 1945, Islam, Qur`an, Justice.

Abstract

This article presents data on the religious attitudes of Muslim minority communities. Similar themes have been studied considerably, but most of them are researched in the Muslim majority areas. Therefore, the author tries to delve into the same topic, but it investigates a different locus, namely how the religious views and attitudes of Muslim minority youth in Manado. The findings reveal that the attitudes and behavior of Muslim youth in Manado towards diversity tend to be conservative with scriptural and puritanical features. However, their basic attitude is highly open towards moderate values and principles, with a decent respect for individual freedom and human rights, even though norms and culture constrain them, this shows a paradox. On the one hand, they show a tolerant attitude, but on other certain aspects or problems, their attitude tends to be intolerant. In its context, the attitudes and religiosity of these Muslim youths have sparked social change in the City of Manado.
