Abstract

ABSTRACT It cannot be denied that currently, environmental management is still quite often carried out with no regard to laws and regulations and environmental sustainability, which can lead to disputes. In Indonesia, the parties who are impacted by environmental damage can seek a settlement that goes into the civil realm by filing a lawsuit to the court. One of these lawsuits can be filed by environmental organizations based on their legal standing. The legal status of environmental organizations in resolving environmental disputes in Indonesia is a matter of concern in the context of environmental protection in this country. Therefore, this article aims to explore the existence and dynamics of environmental organizations in Indonesia in actively participating in environmental protection efforts by conducting legal standing related to disputes in the existing environmental scope. This article is based on a normative juridical method in which the data collection approach is carried out by examining primary legal materials and secondary legal materials. Keywords: Legal Standing, Environmental Organization, Environmental Dispute. ABSTRAK Tidak bisa dipungkiri bahwa saat ini pengelolaan lingkungan hidup masih cukup sering dilaksanakan dengan tidak memperhatikan peraturan perundangan dan kelestarian lingkungan sehingga dapat menimbulkan sengketa. Di Indonesia, pihak yang terdampak atas kerusakan lingkungan dapat mengupayakan penyelesaian yang masuk ke ranah keperdataan dengan mengajukan gugatan ke pengadilan. Gugatan tersebut salah satunya dapat diajukan oleh organisasi lingkungan hidup berdasarkan adanya kewengan menggugat atau legal standing yang dimiliki. Status hukum organisasi lingkungan hidup dalam penyelesaian sengketa lingkungan hidup di Indonesia merupakan hal yang mendapat perhatian dalam konteks perlindungan lingkungan hidup di negeri ini. Oleh karena itu, artikel ini bertujuan untuk mengupas mengenai bagaimana keberadaan dan dinamika organisasi lingkungan di Indonesia dalam berpartisipasi secara aktif untuk melakukan upaya perlindungan lingkungan dengan melakukan legal standing terkait sengketa di lingkup lingkungan hidup yang ada. Artikel ini menggunakan metode yuridis normatif yang pendekatan pengumpulan datanya dilakukan dengan menelaah bahan hukum primer dan bahan hukum sekunder. Kata Kunci: Legal Standing, Organisasi lingkungan,Sengketa Lingkungan Hidup.

Abstract

Children as victims of abuse require comprehensive legal and psychosocial protection. This study discusses the importance of legal assistance for minors within the framework of restorative justice, an approach oriented towards recovery rather than mere punishment. Legal representatives play a role in ensuring that legal processes are fair and child-friendly, while psychosocial support helps restore the emotional and mental condition of child victims. This approach aligns with the principle of the best interests of the child, as outlined in various national and international regulations. The study's findings suggest that the synergy between legal and psychosocial assistance can strengthen child protection and enhance the effectiveness of case resolution through restorative pathways. However, challenges such as the lack of understanding among law enforcement officials and societal resistance remain obstacles to implementation. Therefore, efforts are needed to strengthen integrated support systems and cross-sector education to achieve comprehensive legal protection for children.
