Abstract

The Constitutional Court's Decision Number 168/PUU-XXI/2023 concerning the testing of the Job Creation Law has had a significant impact on various aspects of employment in Indonesia, including the protection of workers' rights and the role of trade unions in strategic industries. The purpose of this study is to analyze the impact of the Constitutional Court's decision Number 168/PUU-XXI/2023 on industrial relations between workers and entrepreneurs in the semiconductor manufacturing sector in Indonesia. This study uses a qualitative approach with a case study design to analyze the impact of the Constitutional Court's decision Number 168/PUU-XXI/2023 on labor unions and worker protection in the semiconductor manufacturing sector. The results of this study show that the Constitutional Court Decision Number 168/PUU-XXI/2023 provides more flexibility for employers in regulating employment, which has an impact on the tension of industrial relations between workers and employers, especially related to the increase in workload and reduced protection of workers' rights. This can be seen from data that shows a decline in workers' trust in trade unions and an increase in dissatisfaction with working conditions. Although unions have great potential in protecting workers' rights, they face major challenges in increasing member participation and their relevance to workers' needs. Employers who neglect worker welfare risk lower employee retention and productivity, while companies that care about worker welfare show more positive relationships with unions as well as better stability. The government also plays an important role in creating a balanced labor policy, prioritizing the welfare of workers without neglecting flexibility for employers

Abstract

Abstract

Background: The increasing utilization of Kredit Pemilikan Rumah (KPR) schemes in Indonesia has generated complex legal relationships among consumers, banks, and property developers, particularly within Buy Back Guarantee (BBG) arrangements. Legal disputes emerge when debtors experience default while land certificates remain registered under developers’ names, and developers settle debtor obligations through BBG mechanisms. Through subrogation, developers may obtain creditor positions while maintaining formal ownership, creating uncertainty regarding unilateral cancellation of Perjanjian Pengikatan Jual Beli (PPJB), property repossession, and enforcement of rights over financed assets. Objective: This study examines the legality of unilateral PPJB cancellation and property repossession conducted by developers based on subrogation deeds, as well as the legal consequences arising from the dual position of developers as formal property owners and substituted creditors. Methods: This research applies a normative juridical approach using statutory, conceptual, and case approaches. Legal materials consist of primary legal sources, secondary legal literature, and judicial decisions related to mortgage financing, subrogation, PPJB, and BBG mechanisms. Results: The findings indicate that subrogation does not automatically grant developers the authority to unilaterally cancel PPJBs or repossess properties without fulfilling contractual obligations and applicable legal procedures. The developer’s role as a substituted creditor must be separated from its capacity as the registered owner of the property. Conclusion: Legal certainty in KPR practices requires compliance with good faith principles, judicial oversight, and clear contractual arrangements regarding default and subrogation consequences. This study contributes to strengthening legal understanding of the relationship between property rights, contractual obligations, and creditor protection in Indonesian housing financing.

Abstract

Background:The rapid growth of online ride-hailing platforms in Indonesia has produced millions of driver-partners whose working arrangements do not fully align with existing legal categories. Prevailing debate tends to frame platform partners within an employment relationship under Law Number 13 of 2003 on Manpower. This study argues that such an approach is conceptually flawed, since not all elements of an employment relationship, particularly wages and command/subordination, are cumulatively satisfied in the partner-platform relation. Methods:Using a normative juridical method with conceptual, statutory, and comparative approaches, this article demonstrates that digital platform partners are, in fact, more accurately constructed as micro-business actors as defined under Law Number 20 of 2008 on MSMEs, given that they own their own operational assets, provide services directly to consumers, are free to accept or reject orders, and independently bear business risk. Results:The implication of this reconstruction is that MSME regulation, particularly Government Regulation Number 7 of 2021 and existing partnership schemes, offers a more relevant legal basis for protecting platform partners than the Manpower Law. Conclusion:The article concludes by formulating a direction for ius constituendum, namely the need to recognize the category of "platform partner" as a sub-category of micro-business actor equipped with minimum social security and fair partnership standards

Abstract

Background: The development of vertical housing in Indonesia has increased the need for legal certainty for holders of Apartment Ownership Certificates (SHMSRS). Problems arise because SHMSRS do not stand alone but are instead embedded in joint rights to common areas, common objects, and common land. Objective: This study examines the epistemological shift from human judgment to algorithmic knowledge in the implementation of Financial Accounting Standards (SAK) and Quality Management Systems (SMM). Drawing on positivism, interpretivism, and pragmatism, it explores whether AI-generated outputs constitute valid accounting knowledge or merely computational representations of professional judgment. Methods: This study employs a qualitative-interpretive approach through conceptual analysis and examination of practitioners’ perspectives on the reliability, transparency, explainability, and trustworthiness of AI-assisted decision-making. Results: The findings show that AI enhances efficiency, predictive accuracy, and analytical capabilities in accounting and auditing. However, its application also creates epistemological challenges, including limited algorithmic transparency, reduced explainability, and the potential weakening of professional skepticism. The shift from assessment-based expertise to data-driven inferential knowledge alters the traditional epistemic authority of accountants and auditors. The implementation of SAK and SMM consequently requires clearer professional responsibility, human oversight, and accountability to maintain the quality of financial reporting and audit processes. Conclusion: Legal protection needs to be built through preventive and repressive mechanisms, namely the obligation for transparency of land status by developers, strengthening of PPJB clauses, the role of notaries and PPAT, government supervision, access to consumer dispute resolution, and proportional compensation mechanisms if unit owners suffer losses.
