Abstract

This study aims to compare the fatwa on the use of menstrual delay medicine for women in Ramadan issued by Dar al-Ifta' al-Misriyyah and the Indonesian Ulema Council (MUI) from the perspective of maqasid al-shari'ah. Both institutions play an important role in determining sharia law for Muslims in their respective countries. The main focus of this study is how the fatwas issued are in line with the principles of maqasid al-shari'ah, namely fulfilling the kulliyyat al-khams and i'tibar al-maal. The comparative method was used to analyse the similarities and differences in the legal approaches taken by these two institutions. Data collection was carried out through documentation and comparison methods, while data analysis was also carried out through descriptive qualitative methods by making maqasid al-shari'ah the main measuring stick. The result of the study shows that the fatwa of Dar al-Ifta' al -Misriyyah tends to be more open in allowing the use of drugs to delay menstruation in the month of Ramadan with certain conditions that prioritise health safety. In contrast, MUI's fatwa is more cautious, emphasises the health aspect as a priority, and does not recommend the use of period-delaying drugs in Ramadan except in emergencies. This difference reflects the diversity of understanding of maqasid al-shari'ah in responding to contemporary needs regarding women's acts of worship. It is hoped that the results of this study will provide a deeper understanding of the sharia implications of using a menstrual delay medicine in Ramadan and how maqasid al-shari'ah is applied in these fatwas.

Abstract

Abstract. This research aims to investigate Muhammadiyah's stance on bank interest as manifested through three legal fatwas issued during the Tarjih and Tajdid sessions. The first fatwa in 1968 declared interest as mutasyabihat. The second fatwa in 2006 concluded that interest is riba because it constitutes an addition to the principal capital lent. It was reinforced by Quranic principles, emphasizing the binding nature and agreed-upon additional terms. The third fatwa 2010 solidified the anti-interest stance. This study delves deeply into the fatwas and secondary sources using maqasid al-Shari'ah as the main criterion. The fatwa emphasizes the obligation to realize the welfare of society within the bounds of Islamic law. The fatwa's gradual and uncomplicated implementation underscores its moral imperative, requiring public awareness and understanding to collectively eliminate the practice of bank interest. Ultimately, Muhammadiyah's fatwa aims to align with the maqasid al-Shari'ah, promoting societal well-being while recognizing the importance of individual and communal understanding.  Abstrak. Penelitian ini bertujuan untuk mengeksplorasi sikap Muhammadiyah terhadap bunga bank yang tertuang dalam tiga fatwa hukum yang dikeluarkan pada sidang Tarjih dan Tajdid. Fatwa pertama pada tahun 1968 menyatakan bunga sebagai mutasyabihat. Fatwa kedua tahun 2006 menyimpulkan bahwa bunga adalah riba karena merupakan penambah modal pokok yang dipinjamkan. Keputusan ini diperkuat dengan prinsip-prinsip Al-Quran yang menekankan sifat mengikat dan syarat-syarat tambahan yang disepakati. Fatwa ketiga tahun 2010 memantapkan sikap anti-bunga. Studi ini menggali secara mendalam fatwa-fatwa dan sumber-sumber sekunder, dengan menggunakan maqasid al-Shari'ah sebagai kerangkautama. Fatwa tersebut menekankan pada kewajiban mewujudkan kesejahteraan masyarakat dalam batas-batas hukum Islam. Penerapan fatwa ini secara bertahap dan tidak rumit menggarisbawahi keharusan moralnya, yang membutuhkan kesadaran dan pemahaman masyarakat untuk bersama-sama menghilangkan praktik bunga bank. Pada akhirnya, fatwa Muhammadiyah bertujuan untuk menyelaraskan dengan maqasid al-Shari'ah, memajukan kesejahteraan masyarakat sambil mengakui pentingnya pemahaman individu dan komunal.

Abstract

This study examines the polemic of al-khurūj ‘alā al-ḥukkām (rebellion against rulers) as debated by Yūsuf al-Qaraḍāwī and Muḥammad Sa‘īd Ramaḍān al-Būṭī, particularly in the context of the Syria crisis and the Arab Spring. The theoretical framework employed is maqāṣid al-sharīʿah, encompassing the hierarchy of maṣlaḥah based on ḍarūriyyāt, ḥājiyyāt, and taḥsīniyyāt; the preservation of the kulliyyāt al-khams (religion, life, intellect, lineage, and property); the balancing of conflicting mafsadah; the application of sadd al-dharāʾiʿ (blocking the means to harm); and the consideration of maʾālāt (future consequences). Methodologically, the study employs a qualitative textual analysis of fatwa, jurisprudential writings, and theological arguments by scholars, situating their views within the broader maqāṣid framework. Within this framework, al-Qaraḍāwī justifies rebellion against unjust rulers as both a moral duty and a religious obligation to uphold justice, framing it within the maqāṣid imperative of resisting tyranny. Conversely, al-Būṭī employs the same maqāṣid tools to prohibit rebellion, prioritising the avoidance of bloodshed and societal collapse over immediate political reform. The findings reveal that although both scholars engage maqāṣid al-sharīʿah, their divergent prioritisation leads al-Qaraḍāwī to emphasise justice and activism as central to preserving Islam’s dignity. At the same time, al-Būṭī underscores stability and unity as essential safeguards against greater chaos.
