Abstract

Based on Law Law No. 12/2006 on Citizenship of the Republic of Indonesia has determined the status of children born from mixed marriages of different nationalities is the granting of dual citizenship to the child until the child is 18 years old or before the age of 18 years but has been married and the limit of applying for citizenship elections to choose and follow the citizenship of the mother or the citizenship of the father is for 3 years after the age of 21 years. and for the right to inherit children born from mixed marriages of different nationalities is to use BW (Burgelijk Weetbook) inheritance law, namely children born from mixed marriages of different nationalities will inherit the assets of their parents using the division of inheritance group I (one), which is based on the nuclear family of inheritance division whose heirs only consist of the husband / wife of the heir and the children of their parents / the heirDOI: https://doi.org/10.26905/mlj.v3i1.7930

Abstract

Enhancing transparency and efficiency in zakat management is an urgent necessity, considering challenges such as non-transparent reporting, regulatory uncertainty, and societal resistance. This study aims to explore the application of blockchain technology as a solution to these challenges. The main questions addressed in this research are how blockchain technology can improve the transparency, accountability, and efficiency of zakat distribution and the extent to which this technology aligns with Islamic legal principles. The research methodology employs a normative juridical approach by analyzing relevant zakat regulations. Data were collected through literature studies. The results show that blockchain features such as decentralization, immutability, and audit trails can significantly enhance accountability and trust in zakat institutions. However, technical challenges such as inadequate infrastructure and training needs, as well as insufficient regulatory support, remain major obstacles. These findings provide important contributions to understanding how blockchain can be adapted to support sharia-compliant zakat management. In conclusion, the adoption of blockchain has the potential to revolutionize zakat management systems with better transparency and efficiency, but it requires regulatory support, training, and global collaboration. Future research is recommended to focus on developing technical standards and evaluating implementation in various local and international contexts. Keywords: Blockchain, Zakat, Islamic Law.

Abstract

This research analyzes the validity of the subject matter of the agreement, intellectual property rights (IPR) protection, as well as ethical issues and legal certainty in the cooperation agreement between influencers and social media platforms. Using a normative legal research method with legislative and conceptual approaches, this study aims to understand the legal aspects governing the relationship between influencers and platforms in the context of digital marketing. The main focus of this research is on the fulfillment of the requirements for a valid agreement as stipulated in Article 1320 of the Civil Code (KUHPerdata), and the necessity for clarity and transparency regarding the subject matter of the agreement, such as digital content and promotional services. The research also explores the potential violations of intellectual property rights by both the platform and the influencer, including the unauthorized use of content and plagiarism. The issue of imbalance in negotiating positions, where influencers are generally weaker compared to the platforms with greater bargaining power, is a key point of focus in this discussion. The study recommends enhancing transparency in agreements, standardizing intellectual property protection clauses, and harmonizing regulations related to digital contracts and consumer protection. Overall, the research concludes that improvements in the legal framework governing these collaborations are necessary to create a fairer environment and provide legal certainty for all parties involved. Penelitian ini menganalisis keabsahan objek perjanjian, perlindungan hak kekayaan intelektual (HKI), serta isu etika dan kepastian hukum dalam perjanjian kerjasama antara influencer dan platform media sosial. Menggunakan metode penelitian hukum normatif dengan pendekatan legislatif dan konseptual, penelitian ini bertujuan untuk memahami aspek-aspek hukum yang mengatur hubungan antara influencer dan platform dalam konteks pemasaran digital. Fokus utama penelitian ini adalah pada pemenuhan syarat sah perjanjian menurut Pasal 1320 Kitab Undang-Undang Hukum Perdata (KUHPerdata), serta perlunya kejelasan dan transparansi terkait objek perjanjian, seperti konten digital dan layanan promosi. Penelitian juga mengeksplorasi potensi pelanggaran HKI baik oleh platform maupun influencer, termasuk penggunaan konten tanpa izin dan plagiarisme. Isu ketidakseimbangan posisi negosiasi, di mana influencer cenderung lebih lemah dibandingkan dengan platform yang memiliki kekuatan tawar lebih besar, menjadi sorotan utama dalam pembahasan ini. Penelitian ini merekomendasikan peningkatan transparansi dalam perjanjian, standarisasi klausul perlindungan HKI, serta harmonisasi regulasi yang berkaitan dengan kontrak digital dan perlindungan konsumen. Secara keseluruhan, penelitian ini menyimpulkan bahwa perbaikan dalam kerangka hukum yang mengatur kerjasama ini diperlukan untuk menciptakan lingkungan yang lebih adil dan memberikan kepastian hukum bagi semua pihak yang terlibat.

Abstract

Marriage without official registration in Indonesia causes legal conflicts, particularly regarding property ownership and joint assets. The unclear legal status of couples in unregistered marriages complicates the resolution of property disputes in court. This study examines the legal implications of unregistered marriages and the impact of digitalization on resolving property disputes. The results indicate that digitalization can expedite marriage registration and dispute resolution processes, although challenges in regulation and accessibility remain. Legal reform regulating unregistered marriages and the integration of technology are necessary to enhance justice in Indonesia's family law system.

Abstract

The aim of this study is to critically examine the normative vacuum regarding the civil representation of indigenous peoples in Indonesia, with a particular focus on disputes over communal land rights The method used is a normative legal approach by examining legislative instruments, jurisprudence, and analysis of selected cases, which aims to reveal systemic weaknesses in the legal recognition of indigenous peoples' representatives in the national legal structure. The novelty lies in its direct involvement in unresolved issues regarding the legitimacy of indigenous community representation in formal judicial and administrative processes, a dimension that has often been overlooked in previous legal studies. The results of the study propose a reform agenda that includes formal legal recognition of customary leadership structures, the establishment of regulatory norms based on the principle of Free, Prior, and Informed Consent (FPIC), and the adjustment of civil law principles to better reflect the customary-based collective governance systems that exist within indigenous communities and Informed Consent/FPIC), and the adjustment of civil law principles to better reflect the collective customary-based governance system that prevails within indigenous communities. The conclusion of the research is that in order to respond to these challenges, this paper proposes a reform agenda that includes formal legal recognition of traditional leadership structures, the establishment of regulatory norms based on the principles of Free, Prior, Prior, and Informed Consent (FPIC) principles, and the adjustment of civil law principles to better reflect the collective and customary governance systems common among indigenous communities.
