Abstract

The crime of sexual abuse against minors is a serious issue faced within the Indonesian legal system. This crime has long-term impacts on the victims and can potentially destroy the future of the child. This study aims to analyze the effectiveness of criminal law policies regarding sexual abuse of minors, as well as the underlying factors contributing to the occurrence of such crimes. This research uses a juridical-sociological approach by collecting secondary data through literature studies and legal documents, as well as primary data through interviews and questionnaires. The results show that although laws related to child protection are in place, the implementation of law enforcement still faces various challenges. Additionally, social and psychological factors influence the frequency of sexual abuse against children. This research recommends an increase in legal socialization and the strengthening of law enforcement to better protect children from sexual crimes.   Abstrak Kejahatan pencabulan terhadap anak di bawah umur merupakan masalah serius yang dihadapi dalam sistem hukum Indonesia. Kejahatan ini memiliki dampak jangka panjang terhadap korban dan dapat merusak masa depan anak. Penelitian ini bertujuan untuk menganalisis efektivitas kebijakan hukum pidana terkait pencabulan terhadap anak, serta faktor-faktor yang melatarbelakangi terjadinya kejahatan tersebut. Penelitian ini menggunakan pendekatan yuridis sosiologis dengan mengumpulkan data sekunder melalui studi pustaka dan dokumen hukum, serta data primer melalui wawancara dan kuesioner. Hasil penelitian menunjukkan bahwa meskipun peraturan yang berkaitan dengan perlindungan anak sudah ada, implementasi penegakan hukum masih menghadapi berbagai tantangan. Selain itu, faktor sosial dan psikologis juga memengaruhi frekuensi terjadinya pencabulan terhadap anak. Penelitian ini merekomendasikan peningkatan sosialisasi hukum dan penguatan penegakan hukum untuk melindungi anak-anak dari kejahatan seksual.

Abstract

This research examines the comparison of impeachment schemes and the position of the Constitutional Court of the Republic of Indonesia and the Federal Republic of Germany using comparative legal studies and the theory of legal objectives. The impeachment of the Head of State in this case the President in the constitutional system has tensions in normative and political aspects. Therefore, this research will describe how the position of the Constitutional Court as the Guardian of Constitution and Democracy in facing the issue of impeachment. With comparative legal studies, the researcher tries to compare the impeachment scheme between the Republic of Indonesia and the Federal State of Germany with a Normative Juridical Approach and uses qualitative data, through an analysis scheme that is infersial description by sourcing documents, books, and laws. The results show that the impeachment scheme between the Republic of Indonesia and the Federal State of Germany has similarities in that the Constitutional Court has the authority to adjudicate in processing impeachment mechanisms, although there are fundamental technical differences where the Court in Germany does not have a direct role in the dismissal of the Head of State but focuses on constitutional testing of laws, while in Indonesia the Court is integrally involved in substantive verification of charges against the president and vice president. In addition, the Constitutional Court has the responsibility to safeguard the proportionality of charges against the president and vice president from normative and political tensions. This aims to maintain the objectivity of case resolution, without political intervention and the vagueness of the norms in question as the concept of legal objectives in maintaining certainty, justice and expediency.   Abstrak: Penelitian ini mengkaji perbandingan skema pemakzulan atau impeachment serta kedudukan Mahkamah Kosntitusi Republik Indonesia dan Republik Federal Jerman menggunakan studi hukum komparatif dan teori tujuan hukum. Pemakzulan Kepala Negara dalam hal ini Presiden dalam sistem ketatanegaraan memiliki ketegangan secara aspek normatif dan politis. Oleh karena itu, penelitian ini akan menguraikan bagaimana kedudukan Mahkamah Konstitusi sebagai The Guardian of Constitution and Democracy dalam menghadapi persoalan impeachment. Dengan comparative legal studies peneliti mencoba membandingkan skema impeachment antara Negara Republik Indonesia dengan Negara Federal Jerman dengan Pendekatan Yuridis Normatif serta menggunakan data kualitatif, melalui skema analisis yang bersifat diskripsi infersial dengan bersumberkan dokumen-dokumen, buku, dan Undang-Undang. Hasil penelitian menunjukan bahwa skema impeachment antara Negara Republik Indonesia dan Negara Federal Jerman memiliki persamaan bahwa Mahkamah Konstitusi memiliki kewenangan di dalam proses mengadili dalam memproses mekanisme pemakzulan, meskipun terdapat perbedaan teknis mendasar dimana Mahkamah di Jerman tidak memiliki peran langsung dalam pemberhentia Kepala Negara melainkan berfokus pada pengujian konstitutional Undang-Undang, sedangkan di Indonesia Mahkamah terlibat secara integral terkait verifikasi substantif dakwaan terhadap presiden dan wakil presiden. Selain itu, Mahkamah Konstitusi memiliki tanggung jawab untuk menjalakan proporsionalitas dakwaan terhadap presiden dan wakil presiden dari adanya ketegangan secara normative dengan ketegangan politis. Hal tersebut bertujuan untuk menjaga obyektifitas penyelesaian perkara, tanpa adanya intervensi politis dan kekaburan norma yang dipermasalahkan sebagaimana konsep tujuan hukum dalam menjaga kepastian, keadilan, dan kemanfaatan

Abstract

The principle of constitutionalism is the main pillar in maintaining the balance of power and upholding the rule of law in a democratic system of government. In the Indonesian context, the dynamics of state administration show that this principle is increasingly relevant, especially amid the trend of widening executive and legislative powers and the challenges of the post-truth era of democracy. This research uses a descriptive qualitative method with a literature study approach, reviewing various literature and research results from 2020 to 2025 to understand the urgency, implementation, and challenges of constitutionalism in limiting power in Indonesia. The discussion begins with an elaboration on the nature of constitutionalism and its function in democracy, followed by an analysis of the mechanism for limiting power as a manifestation of constitutional principles, as well as the issue of term extension as an early symptom of the erosion of these principles. Furthermore, new challenges in the digital era involving the influence of technology and oligarchy in shifting the meaning of constitutionalism to mere formality are examined. The findings show that the weakening of the principle of constitutionalism does not only occur through normative violations, but also through political engineering of power hidden in the practice of procedural democracy. Thus, strengthening constitutionalism through legal reform, strict institutional control, and public political literacy is an urgent agenda in maintaining the integrity of a healthy and equitable democratic system.

Abstract

A child is someone who is not yet 18 years old, including a child who is still in the womb. Every child has the principle of basic rights, namely survival, non-discrimination, growth and development, and respect for participation. A child in conflict with the law is someone who is 12 years old, but not yet 18 years old who is suspected of committing a crime. Protection of the rights of children in conflict with the law needs to be carried out so that the child continues to receive their rights. This writing examines the basic rights of children for children in conflict with the law in Indonesia and the protection of the rights of children in conflict with the law in Indonesia. This writing uses a normative legal method, namely positive legal research, research on legal principles, clinical legal research, legal research examining legislation, and comparative legal research and synchronization of legislation. Handling of child cases is carried out based on the Juvenile Criminal Justice System so that the protection of the rights of children in conflict with the law in Indonesia can be implemented properly and children in conflict with the law continue to receive their rights in full.
