Abstract

The purpose of this study is to examine the legal safeguards available to homebuyers. During the process of buying and owning a house, housing customers frequently encounter complicated risks and concerns. For this reason, sufficient legal protection is necessary to safeguard the rights of consumers in real estate transactions.An examination of relevant legal documents and a review of the literature served as the research methodology for this project. Researchers gathered information about the legal protection of homebuyers from a range of legal sources, including statutes, rules, and court rulings. Subsequently, a qualitative analysis is conducted to pinpoint the advantages and disadvantages of the current legal safeguards.The findings of the study demonstrate that despite the existence of several laws and rules protecting housing customers legally, there are still issues and difficulties with their application. Abstract

Usaha Mikro, Kecil, dan Menengah (UMKM) merupakan pilar utama perekonomian Indonesia, dengan kontribusi lebih dari 99% terhadap total pelaku usaha dan menyerap lebih dari 97% tenaga kerja nasional. Salah satu sektor UMKM yang berkembang pesat adalah industri kreatif, termasuk produk kosmetik seperti pomade. Penelitian ini mengkaji perlindungan hukum terhadap konsumen produk kosmetik lokal melalui studi kasus King Pomade di Kota Medan. Meskipun memberikan kontribusi signifikan terhadap perekonomian lokal, banyak pelaku usaha di sektor ini belum mematuhi standar hukum dan regulasi seperti nomor notifikasi Badan Pengawas Obat dan Makanan (BPOM), pencantuman komposisi bahan, dan informasi kedaluwarsa. Ketidaksesuaian ini berpotensi menimbulkan risiko kesehatan bagi konsumen serta melanggar hak-hak mereka sebagaimana diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Penelitian ini menggunakan pendekatan yuridis normatif dan empiris untuk menganalisis tingkat kepatuhan pelaku usaha serta hambatan dalam implementasi regulasi, termasuk peran dan efektivitas lembaga seperti Badan Penyelesaian Sengketa Konsumen (BPSK). Hasil penelitian diharapkan dapat memberikan kontribusi teoritis bagi pengembangan kajian hukum perlindungan konsumen, serta menawarkan rekomendasi edukatif dan korektif bagi UMKM dan pemerintah daerah dalam membangun ekosistem usaha yang aman, legal, dan berkelanjutan. Penelitian ini juga mendorong peningkatan literasi hukum baik di kalangan pelaku usaha maupun konsumen sebagai langkah strategis dalam mewujudkan keadilan sosial dan perlindungan konsumen yang menyeluruh.

Abstract

This study aims to analyze the legal aspects of consumer personal data protection in the context of the development of digital technology and artificial intelligence (AI). With rapid technological advances, the collection and processing of personal data are becoming increasingly complex, posing new challenges in protecting consumer privacy rights. This study uses a qualitative approach, examining existing regulations, including the Personal Data Protection Act and international standards such as the GDPR. Through an analysis of various legal cases and industry practices, this study identifies gaps in existing legal protections and provides recommendations for strengthening existing regulations. The findings indicate that despite sufficient regulations, implementation and compliance remain challenges. This study concludes that a more adaptive and comprehensive legal framework is needed to protect consumer personal data in the digital and AI era, as well as the need for consumer awareness and education regarding their rights in this context.

Abstract

Pengabdian kepada masyarakat ini dilaksanakan sebagai wujud kontribusi dunia pendidikan dalam memberikan informasi yang bermanfaat bagi masyarakat, sekaligus sebagai dukungan akademisi terhadap perkembangan peradaban. Zakat merupakan kewajiban bagi seorang muslim, namun masih banyak masyarakat yang belum memahami tentang transaksi keuangan halal berbasis teknologi keuangan (financial technology). Berdasarkan hasil observasi, ditemukan bahwa masyarakat muslim di Kelambir Lima Kebun masih banyak yang belum memahami tentang zakat, riba, serta pengelolaan keuangan berbasis syariah. Kegiatan ini bertujuan untuk memberikan pemahaman kepada ibu-ibu rumah tangga di Desa Klambir V Kebun, Kabupaten Deli Serdang tentang zakat, infak, sedekah, serta konsep transaksi keuangan halal secara konsep dan praktik melalui literasi keuangan syariah. Kegiatan dilaksanakan pada bulan November 2023 dengan metode ceramah dan Focus Group Discussion (FGD) yang dihadiri oleh puluhan ibu-ibu rumah tangga di Dusun XV Desa Kelambir Lima Kebon. Hasil kegiatan menunjukkan peningkatan pemahaman peserta mengenai pengelolaan keuangan yang terbebas dari riba serta pentingnya transaksi keuangan halal berbasis teknologi.

Abstract

The development of information and communication technology has encouraged the emergence of various electronic commerce platforms (e-commerce), one of which is TikTok Shop. The ease of online shopping carries its own legal consequences, especially when there is a discrepancy between the quality of the goods advertised and the goods received by consumers. This study aims to analyze the form of legal protection provided to consumers for the inconsistency in the quality of goods purchased through the TikTok Shop application, as well as legal remedies that consumers can take in order to fight for their rights. The research method used is normative legal research with a statutory approach and a conceptual approach. Data sources include primary legal materials such as Law Number 8 of 1999 concerning Consumer Protection, Law Number 11 of 2008 jo. Law Number 19 of 2016 concerning Electronic Information and Transactions, Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, and Regulation of the Minister of Trade Number 31 of 2023 concerning Business Licensing, Advertising, Coaching, and Supervision of Business Actors in Trade through Electronic Systems. The results of the study show that consumers who experience a discrepancy in the quality of goods are entitled to legal protection both preventively and repressively. Preventively, the state has provided regulations that require business actors to provide true, clear, and honest information. Repressively, consumers can take the dispute resolution route through the Consumer Dispute Resolution Agency (BPSK), district courts, or the settlement mechanism provided by the TikTok Shop platform itself. This study recommends strengthening government supervision of electronic commerce and improving consumer digital literacy.
