Abstract

ABSTRACTHusband violence is behavior that cannot be justified in the Qur'an. Even if there is a verse that allows beating a nusyuz wife, the verse has the intention of advice. There are several verses of the Qur'an discussing the concept of nuysuz and providing what actions are taken on nusyuz wives, using the maudhu'i tafsir method in examining verse by verse collected and providing an interpretation that the nusyuz wife is not violence as a first step until the husband acts arbitrarily on the wife even as the leader of the household. This study discusses how husband's violence on nusyuz wife and how the husband's actions on nusyuz wife according to the Qur'an. This research is a descriptive qualitative research, namely the type of writing that describes through secondary data sources that are analyzed.  The results of this study come from literature taken from classic books or books that are old and still accessible. The secondary data used in this study can answer library research questions. This research results in the finding that beating a husband because his wife acts nusyuz should be a lesson that husbands should not hurt their wives because of it, not to provide pain or violence. Violence or beatings that torment the wife will only increase the wife's nusyuz and not provide a solution. Rather, the concept found in the Qur'an is the means by which family conflicts are resolved, ranging from giving advice, cutting the bed to hitting her, and sending a hakam to reconcile. The whole purpose of all that is to fulfill his sincere desire to make his household united.

Abstract

This research aims to analyze the application of the principles of maqāṣid al-syarīʻah by mediator judges in the mediation process of divorce cases at the Class 1A Watampone Religious Court.  The principles that make the application of the five basic maqāṣid al-syarīʻah (ḥifẓ al-dīn, ḥifẓ al-nafs, ḥifẓ al-‘aql, ḥifẓ al-nasl, and ḥifẓ al-māl) internalized in the mediation strategy and approach by the mediator judge to maintain the integrity of the household and prevent divorce. This research uses a qualitative approach with a field study design. Data was collected through interviews, observation and documentation, then analyzed using Miles and Huberman's interactive model. The results of the study indicate that although mediation has great potential in reducing divorce rates, its effectiveness is highly dependent on the competence of the mediator judge and the emotional readiness of the parties. The principle of maqāṣid al-syarīʻah is used by the mediator judge as a value-oriented mediation approach from the beginning of the mediation process until the divorce trial process becomes a reflection to avoid harm, promote peace and consider the socio-spiritual impact on children. However, the effectiveness of conflict resolution still requires institutional support and ongoing training for mediators. Therefore, this study recommends strengthening the capacity of mediator judges through contextual and solution-based maqāṣid training to create a more beneficial and long-term oriented mediation approach.

Abstract

Drug abuse by minors is a multidimensional problem that significantly impacts national resilience. This study aims to examine the legal and strategic implications of child involvement in drug abuse, with a geographic focus on South Sulawesi Province. This study highlights the effectiveness of law enforcement, the implementation of rehabilitation policies, and the social challenges faced in fostering the younger generation as the foundation of national resilience. Using a juridical-normative and sociological approach, this study analyzes the applicable legal framework, specifically Law No. 11 of 2012 concerning the Juvenile Criminal Justice System and Law No. 35 of 2009 concerning Narcotics, as well as the dynamics of their implementation at the local level. The study’s findings indicate that drug abuse in South Sulawesi is concentrated among productive-age males in urban areas with secondary education and involvement in the informal sector, with children in this vulnerable environment. Although the legal framework formally positions children as victims entitled to diversion, rehabilitation, and exceptional protection, law enforcement practices are still dominated by repressive approaches, limited use of restorative justice, and weak inter-agency coordination. Structural constraints, including budget constraints, inadequate facilities, overlapping authority with the police, information leaks, and strong social stigma, significantly hamper the effectiveness of rehabilitation and social reintegration of child victims of drug abuse. From a national resilience perspective, these weaknesses could create an alienated and unproductive generation. This article emphasizes that an integrated penal and non-penal strategy centered on the best interests of children and community-based prevention is a crucial prerequisite for strengthening national resilience in the face of the threat of narcotics.

Abstract

Abstract

This article examines the acculturation of Islam and Javanese culture at the Masjid Saka Tunggal Baitussalam in Cikakak Village, Wangon District, Banyumas Regency. The research is driven by a theoretical gap in previous studies, which tended to analyze the mosque's architecture and the social rituals of the Aboge (Alif Rebo Wage) community separately. Using a qualitative-descriptive approach with an ethnographic-historical method, data were gathered through direct observation, in-depth interviews with the mosque's custodian (juru kunci) and local residents, and documentation. The study reveals three main findings. First, historically, the mosque’s establishment in 1288 AD reflects an early and accommodative Islamization strategy through the spatial adaptation of a pre-Islamic sacred site marked by ancient menhirs. Second, architecturally, the single pillar (saka tunggal) and its four-winged carvings serve as a visual dawah medium that synthesizes Islamic monotheism (tawhid) with the Javanese cosmological concept of papat kiblat lima pancer. Third, socially, this material space provides historical legitimacy for the Aboge community to maintain their unique living Islam rituals, such as Javanese-intoned dhikr and simultaneous adhan by four muezzins without amplification. This study offers an integrative perspective showing how a historical sacred space functions as a supporting medium for contemporary social harmony and cultural resilience.
