Abstract

Law No. 1 of 1974, as does the Compilation of Islamic Law, concerning marriage mandates the registration of every marriage to obtain legal validity such as a marriage certificate, which later becomes a requirement for making a family card. A family card is obtained if a marriage is registered in accordance with applicable laws and regulations. Siri (i.e., unregistered) marriage previously had various consequences, including children not having birth certificates, not having family cards, and, not being able to obtain their rights as husband and wife in the event of marital disputes. Therefore, marriage must be officially registered in order to obtain all the documents needed to create a family card. This will minimize the prevalence of siri marriage. However, the issuance of Minister of Home Affairs Regulation (PERMENDAGRI) No. 108 of 2019, which adds the status of unregistered marriage and unregistered divorce to the provision of family card, has allowed the registration of a family card without attaching a marriage certificate and accommodated providing family cards for unregistered marriages. On the one hand, having family cards is deemed necessary; yet, on the other hand, it is contrary to Law No. 1 of 1974 on Marriage. From a sociological point of view, it can have a negative impact on the increase of siri marriage as it no longer has any consequence at all. Thus, it is important to review the application of PERMENDAGRI No. 108 of 2019 sociologically from the perspective of Islamic family law using the theory of maslahah (benefit). This empirical study used the descriptive qualitative approach, which took place in Banda Aceh City. The study collected legal materials through document study. Sociologically, many negative effects have occurred on the issuance of family cards from the perspective of Islamic family law as well as the consequences of the implementation of PERMENDAGRI No. 108 of 2019 for women and children.

Abstract

The existence of rights to the management of jointly inherited rice fields and the concept of legal reconstruction of the control of inherited rice fields is qualitative research; the approach used is social, legal research, data collection through interviews, observation, and documentation. Data analysis includes data reduction, data presentation, and conclusion drawing. The study results describe the management of jointly inherited rice fields using three systems: the individual inheritance system, the mayoral inheritance system, and the collective inheritance system, especially in the community where there is a habit of using the collaborative inheritance management system for rice fields. The management of the jointly inherited rice fields still exists where the rice fields are not sold only with an agreement that the inheritance will be received in turn with relatives and become a souvenir from the parents. Conflicts often arise because the collective inheritance system is carried out only verbally. Hence, there is a need for legal reconstruction to make a written agreement involving witnesses and the local government so that no party is harmed.

Abstract

Berdasarkan putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 tentang yudicial review Undang-Undang Administrasi Kependudukan, para penganut aliran kepercayaan telah dibolehkan untuk mencantumkan keyakinannya pada kolom agama di Kartu Keluarga (KK) dan Kartu Tanda Penduduk Elektronik (KTP elektronik). Penelitian ini bermula dari diskriminasi yang dirasakan penghayat kepercayaan sehingga sulit dalam menunjukkan eksistensinya. Pasca dikeluarkannya Putusan MK yang merupakan titik balik presensi para penghayat kepercayaan, kini pemeluk agama dan penganut kepercayaan dianggap setara, dengan catatan Penghayat Kepercayaan tetap harus dibedakan secara hak bernegara dan administratif. Meski telah dilegalkan secara administratif oleh Negara melalui peraturan perundang-undang, namun masih saja terdapat pembeda dalam pemenuhan hak sipil bagi kaum minoritas ini karena dianggap rentan terhadap stigma negatif masyarakat. Melalui penelitian pustaka (Library Research) penulis hendak menganalisa bagaimana bentuk pemenuhan hak sipil penghayat kerpercayaan pasca Putusan MK No. 97/PUU-XIV/2016 serta meninjau perbeedaan perlakuan yang dirasakan penghayat kepercayaan setelah dan sebelum dikeluarkannya putusan ini.

Abstract

This research aims to analyze the form of regulation and provision of ethical sanctions given to correctional officers who violate positive law and Islamic law and the role of the ministry of law and human rights in preventing violations by correctional officers at the Class II A Watampone Penitentiary. In the research, the author uses qualitative research, namely a type of research that qualitatively describes the object being discussed according to the reality that exists in society. The results of the research show that the role of the Ministry of Law and Human Rights is that the success of correctional officers in carrying out their duties of service, guidance and mentoring of correctional inmates, management of confiscated and confiscated objects as well as in daily life interactions, one of which is determined by moral integrity and exemplary attitudes and behavior of correctional employees. Abstract

Stunting is a health problem requiring special attention from the Bone Regency Government. Using empirical legal research, this study shows that the Bone Regency Government has adopted several strategies to reduce stunting rates, including issuing and enacting Regent Regulation No. 3 of 2020 as a solid basis for legitimacy and a normative framework for regional stakeholders to address stunting. In addition to the normative framework, massive efforts are being made on the ground, such as (i) the 4 T campaign program, (ii) distribution of bloodboosting tablets, (iii) improvement and attention to maternal health conditions during the 1000 days before birth; (iv) support in the form of supplementary feeding for pregnant women; (v) education related to stunting; (vi) child growth monitoring programs. These programs have impacted the yearon-year decline in stunting rates in Bone Regency

Abstract

Penelitian ini membahas tentang fungsi pengawasan DPRD terhadap pelaksanaan Peraturan Daerah Nomor 5 Tahun 2017 tentang Perlindungan dan Pemenuhan Hak Penyandang Disabilitas. Penelitian ini bertujuan untuk mengetahui dan memahami sejauh mana pelaksanaan fungsi pengawasan DPRD terhadap Peraturan Daerah Nomor 5 Tahun 2017 tentang Perlindungan dan Pemenuhan Hak Penyandang Disabilitas di Kabupaten Bone. Penelitian ini merupakan penelitian yuridis empiris dan dibahas dengan menggunakan pendekatan deskriptif analitis. Hasil penelitian menujukkan bahwa secara yuridis, Peraturan Daerah Nomor 5 Tahun 2017 tentang Perlindungan dan Pemenuhan Hak Penyandang Disabilitas telah mengakomodir perlindungan dan pemenuhan hak penyandang disabilitas di Kabupaten Bone. Namun, pelaksanaan fungsi pengawasan yang dilakukan DPRD Kabupaten Bone tidak terealisasi sepenuhnya dan masih belum optimal.

Abstract

Guarantee of rights is not only given to citizens who have physical and mental perfection but also to vulnerable groups such as persons with disabilities. Persons with disabilities have equal rights and opportunities and must be protected and fulfilled. Efforts to fulfill the rights of persons with disabilities in Bone district as in item 1) Inclusive Education; 2) Sports Development; 3) Legal Protection; 4) Care Program for Persons with Disabilities.Obstacles to the Association of People with Disabilities of Indonesia (PPDI) Bone Regency in Fulfilling the Rights of Persons with Disabilities Based on Regional Regulation of Bone Regency Number 5 of 2017 concerning Protection and Fulfillment of Rights of People with Disabilities are 1) People with Disabilities; 2) Families of Persons with Disabilities; 3) Budget Constraints; 4) Government.
