Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis mengapa permohonan praperadilan dengan Nomor Perkara 3/Pid.Pra/2017/PN.Kfm tidak digugurkan sesuai dengan Putusan Makhamah Konstitusi Nomor 102/PUU-XIII/2015 jo Pasal 82 ayat (1) huruf (d) Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Penelitian ini menggunakan metode penelitian hukum normatif atau doktrinal yang berfokus pada pendekatan Undang-undang, pendekatan konsep, dan pendekatan kasus. Dalam penelitian ditemukan, bahwa terdapat perbedaan penafsiran terhadap norma-norma hukum positif sehingga dapat menimbulkan ketidakpastian hukum baik kepada penegak hukum maupun pelaksana hukum itu sendiri. Saran yang diberikan oleh penulis ialah diharapkan para penegak hukum dalam menafsirkan norma hukum seyogiannya lebih mencermati makna dari norma-norma tersebut serta memperhatikan korelasi antara norma-norma yang saling berhubungan sehingga tidak terjadi perbedaan penafsiran dalam menegakkan hukum.

Abstract

This community service was motivated by the absence of an English language course institution in Mata Air Tarus Village. As a non-formal educational institution, a course institution plays an important role in improving the competence and skills of the community, especially in the field of English as an international language. However, the establishment of a course institution must comply with applicable regulations. This community service aims to provide an understanding to the Village Head and Village Officials of Mata Air Tarus, as well as the founders of the language course institution, regarding the legal aspects of establishing such an institution. The methods used in this community service include surveys, presentations, and discussions or question-and-answer sessions. The results of the community service and discussions revealed that the establishment of a course institution must comply with the Ministry of Education and Culture Regulation Number 81 of 2013 on the Establishment of Non-Formal Education Units to avoid conflicting with existing laws and regulations. The recommendations provided are the need for a unified understanding among the Village Head, Village Officials, Course Institution Founders, and the Education Office to ensure the implementation of Non-Formal Education that can improve the quality of the community.

Abstract

The purpose of the research is to analyze the judge's consideration so that case Number 268/Pdt.G/2021/PN.Kpg cannot be accepted because of ne bis in idem and to analyze the legal consequences of case Number 268/Pdt.G/2021/PN.Kpg which is declared ne bis in idem. Civil procedural law recognizes the principle of ne bis in idem which means that a case that has been decided by a judge and has permanent legal force cannot be resubmitted. The research method used is normative legal research which focuses on the law approach, concept approach, and case approach. The results of the study found that the basis for the consideration of declaring case Number 268/Pdt.G/2021 inadmissible due to ne bis in idem is that there are similarities in subjects, objects, legal relations, and courts and case Number 268/Pdt/2021/PN.Kpg has previously had a permanent legal decision and has a positive nature of the decision. The legal consequences of case Number 268/Pdt.G/2021/PN.Kpg which is declared ne bis in idem, namely first, the subject does not have legal standing to file a lawsuit against the same thing and the legal subject returns to its original state to obey the contents of the decision. Second, for the object, it cannot be re-filed in the same lawsuit and the legal object is legally valid. The suggestion given by the author is that there is a need for a basic understanding of ne bis in idem for parties who want or will file a lawsuit and there is a need to form a regulation that provides restrictions on cases that have ne bis in idem potential to not need to continue the examination until the subject matter.

Abstract

This activity was motivated by the fact that administrative records and financial management in Village-Owned Enterprises had not been properly and properly organized. This service aims to provide an explanation of administrative recording and financial management of village-owned enterprises (BUMDes) located in Pukdale Village. The method used is socialization, namely the service provider provides material and then has a question and answer discussion. The results of the service and discussion found that administrative recording activities consist of expeditions in the form of activities to record any information sent or received, both for internal and external purposes and archiving is a process of systematically organizing information storage so that it can be easily and quickly found if needed while financial management includes planning, organizing, implementing, and controlling financial activities. The suggestion given in this service is that the socialization that has been delivered by the dedication should be carried out by all village officials so as to create a quality pattern of administrative recording and financial management.

Abstract

ABSTRAK Kerukunan umat beragama tidak lahir secara kebetulan tetapi lahir karena sikap saling menghormati dan kerjasama antar umat beragama dan disebut toleransi. Dari perspektif agama, toleransi merupakan mekanisme sosial yang digunakan manusia dalam menyikapi keragaman dan pluralitas agama. Toleransi harus senantiasa dijaga antar umat beragama untuk menciptakan kedamaian dan keharmonisan. Pengabdian masyarakat ini bertujuan untuk semakin mengikat dan mempererat toleransi antar umat beragama di Kupang Nusa Tenggara Timur melalui diskusi konstruktif dan kolaborasi antara tokoh agama serta untuk mengumpulkan informasi terkait dengan toleransi sosio-agama yang ada di kota Kupang. Kegiatan abdimas ini dilaksanakan di 3 tempat ibadah yakni: Gereja GMIT Betel (Kristen), Masjid Raya Baiturahman (Islam), dan Pura Agung Giri Kertha Bhuwana temple (Hindu). Berdasarkan hasil evaluasi, dapat disimpulkan bahwa toleransi beragama telah diimplementasikan oleh umat beragama di 3 lokasi tersebut. Diskusi dan kolaborasi sangat efektif diterapkan dalam mempromosikan dan memperkuat rasa saling hormat menghormati dan toleransi antar umat beragama di Kupang. ABSTRACT Religious harmony did not come to existence by chance. It came from an attitude of mutual respect and cooperation among religious communities called tolerance. From the religious perspective, tolerance is a social mechanism that humans bring into play in responding to religious diversity and plurality. Tolerance must always be maintained by all religious communities in order to create peace and harmony. This community service aims to bind and strengthen inter-religious tolerance among religious communities in Kupang East Nusa Tenggara province through constructive discussion and collaboration with religious leaders and to gather information from the religious leaders concerning the socio-religious tolerance that took place in their surrounding areas. The program was carried out at three different places of worship i.e. Gereja GMIT Betel church (Christian), Masjid Raya Baiturahman mosque (Islam), and Pura Agung Giri Kertha Bhuwana temple (Hindu). Based on the evaluation, it was found that the religious communities (Kristen, Islam, Hindu) in the surrounding places have implemented inter-religious tolerance. Inter-religious discussion and collaboration are highly effective for promoting and strengthening mutual respect and tolerance among religious communities in Kupang.
