Abstract

The presumption of innocence (APTB) is a well-known principle that guarantees human rights. This principle is also used in criminal law to protect suspected criminals. The problem is that law enforcement officials do not fully understand this principle in criminal proceedings, as they tend to believe that the presumption of guilt applies to suspected criminals. Law enforcement officials believe that the judicial process cannot proceed if the presumption of guilt principle is not applied. However, the APTB is not the opposite of the presumption of guilt principle; rather, it is a principle that can bring balance to the criminal justice process by prioritizing legal protection for those seeking justice to prevent them from facing arbitrary actions by law enforcement officials. This method employs normative research, prioritising the analysis of secondary data/literature supported by other literature and cases drawn from internet sources. The findings of this study explain that law enforcement officials' understanding of APTB is crucial in the criminal justice process as a form of legal protection for those seeking justice. Applying the principle must be supported by clearly incorporating APTB into the provisions of the Criminal Procedure Code (KUHAP) for the future. Currently, APTB is not regulated in the provisions of the KUHAP, so in the future, when the principle is regulated, law enforcement officials in the criminal justice process will have a strong basis for not disregarding the presumption of innocence principle.

Abstract

This study examines the legal aspects of the digital transformation of coffee and tobacco products in Batursari Village, Kledung, Temanggung, Indonesia, with a focus on enhancing the welfare of local entrepreneurs. Batursari Village, rich in natural resources, has significant potential for growth in its coffee and tobacco industries. The research aims to develop strategies for improving the welfare of these entrepreneurs through product digitalization, aligning with the mandate of Article 33 of the 1945 Constitution, which emphasizes the principle of kinship in the economy. Utilizing a mixed-methods approach, including surveys and focus group discussions with local entrepreneurs, the study identifies key challenges and opportunities in digital transformation. While the potential for expanding market access and increasing productivity through digital tools is evident, a lack of digital literacy and limited technological access have been significant barriers. The research highlights the importance of addressing legal aspects related to digital marketing, e-commerce regulations, and compliance with product standards. The study concludes that empowering local entrepreneurs with training in digital marketing and e-commerce can significantly improve market access, productivity, and overall welfare. Recommendations include implementing technical guidance sessions and providing ongoing support to facilitate the adoption of digital tools. Additionally, addressing legal and policy challenges is crucial to create a supportive environment for digitalization in rural economies. This research contributes valuable insights into how digital transformation can be harnessed to boost economic growth and welfare in rural agricultural communities, with a specific focus on Batursari Village’s coffee and tobacco industries.

Abstract

The development of tourism villages often creates a paradox: economically successful yet exclusive towards vulnerable groups. Lerep Village, as a premier destination, faces an acute normative-empirical gap between legal ideality (Semarang Regency Regional Regulation No. 12/2021) and the reality of infrastructural exclusion for persons with disabilities. This community service research aims to (1) analyze the factors causing this exclusion and (2) evaluate the effectiveness of the Community Law Laboratory (LHM) as a participatory socio-legal intervention to bridge this gap. Employing a socio-legal approach operationalized through the Participatory Rural Appraisal (PRA) methodology, the intervention was conducted over a 12-month period (October 2025 – October 2026). The methodology was executed through a six-step systematic framework: normative assessment, stakeholder mapping, participatory mapping (including transect walks), pair-wise ranking for problem prioritization, action plan formulation, and evaluation. The program engaged approximately 100 participants, alongside 30 village officials and tourism managers. The LHM effectively acted as a "socio-legal incubator". Through these specific PRA techniques, the intervention successfully dismantled the charitable paradigm among the village apparatus, shifting it toward a human rights-based approach. This collective awareness resulted in the participatory formulation of an Inclusive "Design and Build" Action Plan, designed for integration into the Village Budget (APBDes). By transforming abstract legal norms into concrete local policies, the PRA-based LHM model provides a scalable framework for other tourism villages in Indonesia to actively advance the Sustainable Development Goals (SDGs), specifically SDG 10 (Reduced Inequalities), SDG 11 (Sustainable Cities and Communities), and SDG 16 (Peace, Justice, and Strong Institutions).
