Abstract

Hukum kesehatan di Indonesia telah memiliki dasar normatif yang kuat melalui regulasi seperti Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran dan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Namun, implementasinya di lapangan masih menghadapi berbagai tantangan. Penelitian ini mengungkapkan adanya kesenjangan antara ketentuan hukum yang tertulis dengan praktik yang terjadi di fasilitas pelayanan kesehatan. Beberapa isu utama yang ditemukan meliputi rendahnya pemahaman hukum di kalangan tenaga medis, lemahnya penegakan terhadap pelanggaran etik dan profesi, serta konflik antara norma hukum dan prinsip etika dalam situasi medis tertentu. Di sisi lain, kasus pelanggaran hak pasien, penerapan prosedur informed consent yang minim komunikasi, serta kriminalisasi tenaga medis yang telah menjalankan standar prosedur menjadi permasalahan serius. Hasil penelitian menunjukkan bahwa keberadaan regulasi belum diimbangi dengan pelaksanaan yang konsisten dan perlindungan hukum yang seimbang. Oleh karena itu, diperlukan reformasi menyeluruh, termasuk penguatan literasi hukum kesehatan, integrasi hukum dalam pendidikan profesi medis, serta pembentukan lembaga penyelesaian sengketa medis yang independen. Sinergi antar pemangku kepentingan menjadi faktor penting dalam membangun sistem hukum kesehatan yang adil, profesional, dan berorientasi pada perlindungan hak seluruh pihak.

Abstract

Maternal healthcare services may involve practices that affect women’s autonomy, dignity, and rights, while obstetric violence remains insufficiently recognized within the Indonesian legal framework. This research aims to understand women’s experiences in maternal health care and to analyze the urgency of establishing specific regulations regarding obstetric violence, with a focus on Palu City and Sigi Regency, Central Sulawesi. This study employs a qualitative approach combining phenomenological and socio-legal designs. Data were collected through online in-depth interviews and pre-interview questionnaires involving women who had accessed maternal healthcare services and healthcare professionals selected through purposive sampling. Data were analyzed thematically to identify patterns of experience, power relations, and potentially harmful practices, which were then examined within the applicable legal framework. The findings indicate that women experience limited decision-making autonomy, disrespectful communication, and inadequate health information. These experiences reveal a gap between legal principles protecting patient rights and actual healthcare practices. The findings further demonstrate that obstetric violence is influenced not only by individual actions but also by paternalistic healthcare structures. Therefore, specific regulations recognizing obstetric violence are urgently needed to strengthen legal protection, promote women’s autonomy and dignity, and encourage more empathetic, respectful, and rights-based maternal healthcare practices.

Abstract

Video recording in emergency referrals is expanding through telemedicine but raises ethical, legal, and patient safety concerns. This study aims to systematically analyze the ethical and legal dilemmas of utilizing clinical video in emergency referral services, as well as its impact on patient safety and the referral administration process. This research employs a Systematic Literature Review method guided by the PRISMA 2020 framework. The literature search covered PubMed, Scopus, ScienceDirect, and Google Scholar using the keywords “emergency referral,” “video recording,” “telemedicine,” “ethical issues,” and “legal aspects.” A total of 14 articles were analyzed using thematic synthesis. The results indicate that clinical video expedites communication and supports triage in emergency referral systems. However, the study identified ethical dilemmas related to informed consent and patient privacy, legal regulatory gaps, and negative impacts in the form of delayed referrals, patient refusals, and increased administrative burdens. On the other hand, video can also enhance the efficiency of clinical communication if implemented with appropriate standards. These findings imply the need for clear regulations, standardized procedures, and safeguards to balance administrative efficiency with patient safety and rights.

Abstract

The Smoke-Free Areas policy is a legal instrument that protects the public’s right to a healthy environment, including in public facilities. In the City of Bandung, regulations on Smoke-Free Areas have been established through regional legislation; however, violations of these provisions are still frequently found, particularly in urban parks as open public spaces. This condition indicates a gap between normative legal regulations and policy implementation in the field, especially in terms of sanction enforcement. This study generally aims to analyze the implementation of the Smoke-Free Areas policy in urban parks in the City of Bandung. The study employs normative juridical research supported by literature review and field observation. Data are analyzed qualitatively through editing, interpretation, and data systematization. The findings indicate that Smoke-Free Areas implementation in Bandung’s urban parks remains suboptimal despite an established legal framework. Limited supervision, inadequate supporting facilities, unclear technical mechanisms, and inconsistent sanctions constrain enforcement, reducing the policy’s deterrent effect. The study concludes that effective implementation requires stronger institutional supervision, clearer enforcement mechanisms, adequate facilities, and consistent sanctions. The study contributes by highlighting the importance of aligning normative legal provisions with practical enforcement mechanisms to strengthen compliance with Smoke-Free Areas in urban public spaces.

Abstract

Legal protection for specialist dentists in independent practice is an important aspect of ensuring legal certainty, professional accountability, and the quality and safety of healthcare services. The increasing legal awareness of the public, combined with the complexity of dental procedures, has heightened the potential for medical disputes between patients and specialist dentists. This study aims to analyze the forms of legal protection afforded to specialist dentists in independent practice and identify the obstacles to its effective implementation. This study uses a normative juridical method and a statutory and conceptual approach, examining relevant legislation, legal principles, and scholarly perspectives on healthcare and professional protection. The findings indicate that legal protection is provided through various regulatory instruments governing professional rights, informed consent, professional standards, dispute resolution, and legal accountability. However, implementation remains suboptimal because of regulatory fragmentation, limited understanding of legal rights and obligations, and weaknesses in preventive mechanisms and dispute resolution. The study suggests that stronger preventive and repressive legal protections are needed to balance protection for patients and specialist dentists while promoting professional accountability and legal certainty in independent dental practice.

Abstract

Drug trafficking remains a serious challenge for Indonesia’s correctional system, particularly due to the high recidivism rate among female inmates. The Class IIA Pekanbaru Women’s Correctional Institution has implemented rehabilitation programs to address addiction and support social reintegration. However, their effectiveness needs evaluation, particularly in reducing relapse rates. Drug rehabilitation programs in correctional institutions are essential for helping inmates overcome addiction and improve their quality of life. This study analyzes the effectiveness of the drug rehabilitation program at the Pekanbaru Women’s Correctional Institution. The research method used a qualitative case study approach. Data were collected through in-depth interviews with inmates and correctional officers, as well as through rehabilitation program documents. The results indicate that the drug rehabilitation program at the Pekanbaru Women’s Correctional Institution has several weaknesses, such as a lack of resources, inadequate training for officers, and a lack of family support. However, the program also has several strengths, such as counseling, group therapy, and religious activities. This study recommends that the drug rehabilitation program at the Pekanbaru Women’s Correctional Institution needs to be improved by increasing resources, training for officers, and family support.
