Abstract

ABSTRAKBullying di kalangan remaja sekolah merupakan masalah serius yang perlu ditangani dengan perhatian dan pendekatan yang tepat. Dalam rangka pemahaman dari aspek hukum pencegahan Bullying dalam guna memberikan pemahaman dalam Upaya meminimalisir dampak negative bullying serta melindungi generasi muda, Penyuluhan hukum tentang pencegahan Bullying dikalangan remaja sekolah di daerah merupakan salah satu solusi terhadap permasalahan yang dihadapi sekarang ini. Abstract

Referring to Article 1, Paragraph 2 of Law No. 31 of 2014 of the Republic of Indonesia, “witness-perpetrator” is suspect, defendant, or convict cooperates in supporting the law enforcement process to uncover a criminal act in the same case. The legal issue regarding the construction of pretrial procedures concerning the designation of “witness-perpetrator” in corruption follows: when a witness false testimony, there are provisions in the under Criminal Procedure Code (KUHAP) strictly regulated, emphasizing and essential function of reviewing the legality of the process, based on the initial actions arrest and detention, which are considered coercive measures under the law.

Abstract

Fraud through electronic transaction media is one of the crimes that is growing rapidly in the digital era. Advances in information technology provide opportunities for perpetrators to utilize digital platforms such as e-commerce and social media to carry out various modes of fraud. This research aims to analyze the investigation mechanism carried out by the police regarding this criminal act in the criminal justice system in Indonesia. Using normative legal research methods, this research examines relevant laws and regulations, such as the Criminal Procedure Code and the ITE Law, as well as the obstacles faced in carrying out investigations, such as technological limitations, apparatus competence, and difficulties in tracking the perpetrator's digital footprints. The research results show that although regulations have provided a legal basis for cracking down on electronic transaction fraud, there are technical and administrative obstacles that hamper the effectiveness of law enforcement. To overcome this, regulatory updates are needed, strengthening the capacity of law enforcement officers, and increasing public digital literacy. In conclusion, the success of investigative mechanisms depends greatly on the synergy between adaptive regulations, adequate technology, and effective cross-institutional cooperation to create justice for victims and a sense of security in online transactions.

Abstract

The aim of this research is to determine the factors that influenced the judge's decision in the case of criminal threats on social media in Decision Number: 172 / PID.SUS / 2019 / PN.JKT.SEL against children as sexual abuse perpetrators in South Jakarta City to analyze and analyze the decision. The statutory and case approaches are two examples of the normative research methodology that is employed. The information was gathered from theses, journals, legislation, and literature. In this study, data management and analysis were done in a deductive manner. According to the study's findings, the court continues to violate the proportionality principle while imposing a sentence on the offender. The judge's decision is then influenced by a number of factors, such as: 1. Elements that come from the judge. 2. Elements that come from the accused.

Abstract

Investigation is a crucial stage in criminal law to find the suspect, as stipulated in Article 1 paragraph (2) of the Criminal Procedure Code and the Chief of Police Regulation Number 6 of 2019. However, Articles 14 paragraphs (2), (3), and (4) of this Police Regulation demonstrate inharmonicity. Paragraph (2) states that a suspect can be determined in the Investigation Commencement Order (SPDP), while paragraph (3) states the opposite. Paragraph (4) regulates the notification of a suspect after 7 days of issuing the Investigation Order. Ideally, the determination of a suspect should refer to Article 10 paragraph (1) of the said Police Regulation so that the criminal justice system can run more firmly and consistently.

Abstract

The restorative justice approach offers a progressive solution within Indonesia's criminal justice system to address the shortcomings of the retributive approach, which focuses primarily on punishment. This principle emphasizes victim recovery, offender accountability, and community involvement, thereby fostering more inclusive and substantial justice. The prosecution has strategic authority to discontinue prosecutions based on restorative justice, as stipulated in Article 14 Criminal Procedure Code and the Attorney General’s Regulation No. 15 of 2020. This study aims to examine the urgency of restorative justice principles in resolving criminal cases and the prosecutorial authority in discontinuing prosecutions under this approach. The findings indicate that restorative justice holds significant potential to overcome the weaknesses of the retributive criminal justice system. This approach effectively reduces court caseloads, prison overcrowding, and offender stigmatization while delivering more substantive justice for victims. The prosecutorial authority to discontinue prosecutions through this approach has proven to be an essential instrument in creating a more efficient, inclusive, and socially harmonious justice system.

Abstract

Prosecution of children's cases in the juvenile criminal justice system in Indonesia focuses on the principles of restorative justice, which aims at the rehabilitation and social reintegration of children. Even though Law no. 11 of 2012 concerning the Juvenile Criminal Justice System (JCJS) regulates the protection of children's rights, prosecution practices often face obstacles, such as a lack of understanding by law enforcement officials regarding restorative approaches and limited rehabilitation facilities. This research aims to analyze the prosecution mechanism, the role of prosecutors, and the challenges that exist in the juvenile criminal justice system. The research results show the need to strengthen the capacity of law enforcement officers, improve rehabilitation facilities, and community understanding to realize the goals of an effective and fair juvenile criminal justice system.

Abstract

Malpractice is an error or negligence committed by professional staff, such as doctors, lawyers, accountants, dentists or veterinarians, which do not comply with professional standards. In reality, malpractice still often occurs, both in hospitals and medical personnel, even though there are several legal instruments that regulate hospitals and medical practice with sanctions for violators of health laws. The aim of this research is to explore existing deficiencies in legal policies, and propose new legal policies in order to optimally prevent and overcome hospital malpractice. The research method used is a normative research method by examining aspects of criminal law in health law regarding malpractice, as well as theories and expert opinions for better legal policy proposals. From the qualitative analysis of data on primary and secondary legal materials, the following results were obtained: first, there are weaknesses in the health law policy so that it cannot prevent and deal with malpractice optimally, namely the lack of completeness and lack of clarity regarding the formulation of malpractice and its strict sanctions, and a turn towards acts of resistance. the law and limitations of the hospital's responsibility for malpractice committed by doctors or medical personnel. Second, a new legal policy that can be proposed is by formulating clearly and in detail the limits of hospital malpractice in health law, accompanied by strict sanctions or accountability both criminally, civilly and administratively, hospitals.

Abstract

The integration of the legality principle and the opportunity principle in prosecutorial practice in Indonesia is a complex issue that requires in-depth study. The legality principle, which demands legal certainty, often clashes with the opportunity principle, which grants prosecutors discretion in decision-making. This study analyzes the dynamics of the interaction between these two principles through a literature review and case studies. The findings indicate challenges in achieving a balance between the two, particularly in defining the boundaries of prosecutorial authority and objective criteria for applying the opportunity principle. The study concludes that there is a need for regulatory improvements, increased transparency, and effective oversight mechanisms to ensure that the application of the opportunity principle does not deviate from the principles of justice and legal certainty.

Abstract

Freedom of opinion and protection of whistleblowers are two critical aspects in maintaining transparency and accountability in Indonesia, particularly within the context of a healthy democracy. Article 28E, Paragraph (3), and Article 28F of the 1945 Constitution guarantee the right of every individual to express opinions, access information, and communicate freely. However, the implementation of freedom of opinion often faces obstacles, especially in relation to the ITE Law, which contains multi-interpretive articles, such as Article 27, Paragraph (3), and Article 28, Paragraph (2). These provisions are frequently used to criminalize individuals who express criticism or file public reports. This creates an imbalance between the right to freedom of expression guaranteed by the constitution and the inconsistent application of the law. This article also underscores the importance of legal protection for whistleblowers, who often face both physical and legal threats. While existing legal protections, such as Law No. 13 of 2006 in conjunction with Law No. 31 of 2014 regarding Witness and Victim Protection, provide a legal foundation, their implementation remains limited in the digital context. Therefore, harmonizing regulations, including revising the ITE Law, is essential to ensure that both freedom of expression and whistleblower protection are properly safeguarded. Reform in Indonesia's legal system is urgently needed to create a safe environment for the public to voice their opinions and report violations. This, in turn, will strengthen transparency, prevent corruption, and bolster democracy in Indonesia.
