Abstract

Children are the next generation of a nation, so that the growth and development of children must be properly considered, not only the responsibility of the family and parents but also the responsibility of society and the state, considering that Indonesia is a welfare state that has an obligation to guarantee the rights of its citizens properly. In this case, including the rights of children in conflict with the law (ABH), even though they are children who have problems with the law, they are children who must be protected to fulfill their rights. This study was conducted using literature and document study methods, in the form of books, journal articles, or other types of writings and various laws and regulations relating to cases of children in conflict with the law (ABH). The results of the study showed that the fulfillment of the rights of correctional students consisting of the right to survive and develop, the right to protection and the right to participate has been carried out well by LPKA. Although there is still a shortage of correctional social workers in LPKA who act as facilitators and bridges for ABH to get education and carry out the rehabilitation process according to the needs of children.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) are the backbone of the Indonesian economy, but in digital business practices, they often face legal challenges in business contracts, whether with suppliers, distributors, or marketplace platforms. This article examines aspects of legal protection for MSMEs in digital business contracts and identifies inequalities that occur in business relationships with large companies. This study uses a normative-juridical research method by analyzing business contract regulations in Indonesia as well as comparative studies with legal systems in other countries. This study concludes that MSMEs need more proactive regulations in ensuring fairness in digital business contracts so as not to experience exploitation from more dominant parties.

Abstract

This study aims to analyze the contributing factors that lead children to come into conflict with the law and to evaluate the effectiveness of diversion programs in reducing recidivism among juvenile offenders. Using a socio-legal approach and qualitative method, data were collected through literature review, interviews with law enforcement officers and community counselors, and direct observation of diversion implementation in several regions. The findings indicate that the causes of juvenile delinquency are multifaceted, including social, economic, psychological, educational, and media-related influences. Diversion programs, when implemented holistically and based on restorative justice principles, have proven effective in reducing recidivism rates. Nevertheless, several challenges persist, such as limited understanding of restorative justice among legal practitioners, inadequate facilities, and societal stigma against children in conflict with the law. Therefore, a collaborative and continuous effort is needed to enhance the quality of diversion practices, strengthen regulations, improve infrastructure, and increase community involvement to establish a juvenile justice system that prioritizes the best interests of the child.

Abstract

This study discusses the effectiveness of medical and psychosocial interventions in the rehabilitation of drug addicted children. Drug abuse in children is a serious problem that can damage a person's physical and mental health and threaten the future of the nation. The main solution in a situation like this is rehabilitation, which aims to eliminate the child's physical dependence and also restore the child's social and psychological condition so that they can interact with others normally again. This study examines how rehabilitation programs are implemented in Indonesia. This study examines problems such as limited facilities, social stigma, lack of personnel, and the ineffective combination of medical and psychosocial approaches. In addition, this study examines Law Number 35 of 2009 concerning Narcotics which regulates the rehabilitation of drug addicted children. This study shows that successful rehabilitation must combine medical treatment and psychological and social support from families, health workers, psychologists, and the surrounding environment and society also need to help. This method not only helps children recover from addiction, but also prevents them from being treated as criminals and helps them be accepted back into the social environment. Therefore, in order for this program to be more friendly, continue to run well, and provide long-term benefits for children and society, cooperation from various parties and improvement of the quality of rehabilitation services are needed.

Abstract

The distribution and abuse of narcotics among children has become an increasingly alarming issue in Indonesia. Children are not only victims but also become perpetrators within drug networks. Law enforcement practices often neglect the principles of restorative justice and child protection, and are still not fully accompanied by adequate understanding and implementation by law enforcement officers. In addition, social stigma toward children involved in narcotics cases presents a major obstacle in their rehabilitation and social reintegration processes. This paper adopts a juridical and sociological approach to examine legal practices and the social impact experienced by child offenders of narcotics, while offering holistic solutions involving synergy between the legal system, families, and society. The findings emphasize the need to enhance the capacity of law enforcement, establish child-specific rehabilitation centers, and promote public education to eliminate the persistent negative stigma.

Abstract

This paper discusses legal protection for children as offenders in the juvenile justice system in Indonesia through a restorative justice approach. The study aims to analyze the effectiveness of this approach and the challenges faced in its implementation. The method used is normative juridical with a legislative and conceptual approach. The research findings indicate that the restorative justice approach offers a more child-friendly resolution mechanism, protects children from social stigma, and focuses on restoring social relationships. However, its implementation is still hindered by a lack of understanding among law enforcement officials, limited resources, and a legal culture that predominantly favors a retributive approach. A synergy among various parties is needed to enhance the effectiveness of legal protection for child offenders.

Abstract

Kegiatan pengabdian kepada masyarakat dengan tema “Anak Sebagai Generasi Harapan: Pentingnya Memahami Hukum Sejak Dini” yang dilaksanakan di SMP Negeri 39 Samarinda yang melibatkan 38 siswa kelas VII yang berusia sekitar 14-15 tahun, dengan tujuan untuk meningkatkan kesadaran dan pemahaman hukum di kalangan peserta didik. Anak-anak yang akan menjadi generasi penerus bangsa, harus diberi pengetahuan dasar tentang hukum agar mereka dapat membedakan mana yang benar dan salah serta memahami konsekuensi hukum dari setiap tindakan. Kegiatan ini dilaksanakan melalui penyuluhan hukum interaktif, diskusi kelompok, dan simulasi kasus sehari-hari. Kegiatan ini mengacu pada teori pendidikan hukum menurut Satjipto Rahardjo (2006) yang menekankan pentingnya menanamkan nilai-nilai kesadaran hukum sejak dini sebagai bagian dari pembentukan karakter bangsa. Penting bagi mereka untuk memahami nilai-nilai hukum dan moral sejak dini agar mampu menjadi individu yang bertanggung jawab serta menghormati hak dan kewajiban sebagai warga negara. Kurangnya pemahaman hukum dikalangan pelajar seringkali menjadi penyebab munculnya perilaku menyimpang. Hasil kegiatan menunjukkan bahwa siswa lebih memahami aturan hukum yang berlaku di lingkungan sekolah dan masyarakat. Mereka juga lebih disiplin dan lebih menyadari pentingnya menghindari perilaku melanggar hukum seperti perundungan, kekerasan, dan pelecehan. Kegiatan ini sangat penting karena akan menghasilkan generasi muda yang jujur dan taat hukum. Mereka akan berfungsi sebagai dasar untuk masyarakat yang adil dan beradab di masa depan
