Abstract

The object of this writing is based on the present, very often occurs among doctors, and or health workers proven to have made a mistake, and or medical negligence. Medical errors and or negligence can result in disability, and death of a patient. Disability and death of a patient cause thinking among doctors and/or health workers, it is considered that they have committed an alleged crime that endangers the safety of the body and life of a patient, so that doctors and/or health workers feel that they have been criminalized by certain parties. This criminalization is of course very confusing, considering that in fact in This criminal law perspective certainly cannot be said to be criminalization, in fact it can be said to be a form of criminal responsibility.

Abstract

Penelitian ini akan mengkaji, menganalisis, dan menemukan bagaimana penerapan Asas Keseimbangan Dalam Undang-Undang Cipta Kerja (Omnibus Law) Terhadap Pemenuhan Hak Atas Kesehatan di Indonesia, dan untuk Mengkaji, menganalisis, dan menemukan peran hukum kesehatan dalam upaya menciptakan keseimbangan Dalam Undang-Undang Cipta Kerja (Omnibus Law) Terhadap Pemenuhan Hak Atas Kesehatan di Indonesia. Metode penulisan ini mengggunakan pendekatan yuridis normative yang menitikberatkan pada penelitian terhadap asas-asas hukum, sistematika hukum, sejarah hukum, dan perbandingan hukum. Hasil penelitian dalam penulisan ini, menitikberatkan pada Penerapan Asas Keseimbangan Dalam Undang-Undang Cipta Kerja (Omnibus Law) Terhadap Pemenuhan Hak Atas Kesehatan di Indonesia, dan untuk Mengkaji, menganalisis, dan menemukan peran hukum kesehatan dalam upaya menciptakan keseimbangan Dalam Undang-Undang Cipta Kerja (Omnibus Law) Terhadap Pemenuhan Hak Atas Kesehatan di Indonesia mampu memenuhi tujuan hukum, yakni : Keadilan, Kepastian, dan Kemanfaatan. Perlu dilakukan upaya yang terpadu untuk menemukan sebuah kriteria atau indikator dalam menemukan konsep keseimbangan, sehingga pemahaman yang keliru dalam penerapan Asas Keseimbangan Dalam Undang-Undang Cipta Kerja (Omnibus Law) Terhadap Pemenuhan Hak Atas Kesehatan di Indonesia, dapat diluruskan kembali melalui pendekatan peran hukum kesehatan dalam upaya menciptakan keseimbangan Dalam Undang-Undang Cipta Kerja (Omnibus Law) Terhadap Pemenuhan Hak Atas Kesehatan di Indonesia.

Abstract

Law Number 44 of 2009 states that: a hospital is a health service institution that provides comprehensive individual health services that provide inpatient, outpatient and emergency services. This latest development increasingly shows that the hospital has de facto shifted from a social institution to a business institution. In efforts to provide health services that aim to dignify patients as whole human beings at this time it often occurs because of imperfect laws which often cannot reach reality. It can be seen that several cases were found in various hospitals, due to the economic limitations of the patient. Thus resulting in the patient being unable to complete hospital administration after the patient was declared dead, and this suddenly went viral on various social media, because these online drivers did not come to visit their sick colleagues or to carry out demonstrations, but forced the bodies of children from one of his fellow online drivers who died, who was allegedly made difficult by the hospital, due to economic limitations in the patient's (victim's) family was unable to complete hospital administration.
