Abstract

Penelitian ini mengkaji praktik penggantian uang kembalian dengan barang di Biru Swalayan Kecamatan Wiradesa, Kabupaten Pekalongan, dari perspektif hukum dan etika Islam. Metode penelitian menggunakan analisis deskriptif kualitatif, dengan data primer dari wawancara konsumen dan pengelola swalayan, serta data sekunder dari literatur terkait. Hasil penelitian menunjukkan bahwa praktik ini masih sering terjadi dan berpotensi melanggar hak konsumen sesuai Undang-Undang Perlindungan Konsumen. Dalam perspektif Islam, penggantian kembalian dengan barang hanya dibenarkan jika ada kesepakatan dan nilai barang setara. Penelitian ini menyimpulkan perlunya peningkatan kesadaran pelaku usaha terhadap peraturan dan etika bisnis Islam, serta edukasi konsumen mengenai hak-haknya. Sistem pembayaran yang transparan dan penggunaan teknologi dapat menjadi solusi berkelanjutan.

Abstract

This research discusses the land conversion carried out by PT Hardases Abadi Indonesia (HAI) in Wangandowo Village, Bojong District, Pekalongan Regency, and its impact on the lives of the surrounding community. Land that was originally in the form of hills and forests was converted into an industrial area for the construction of a shoe factory with a building area of 184,638 square meters. This land conversion has a positive economic impact in the form of local labor absorption and increased community welfare. However, the land use change also caused serious environmental impacts, such as the loss of water catchment areas and the occurrence of flash floods due to the collapse of the factory's embung in March 2024 which damaged residential areas and caused casualties. The research used a qualitative approach with interviews, observation and documentation to explore the socio-economic and environmental impacts. The results emphasized the need for strict environmental management and sustainable spatial planning so that industrial development can run in balance with environmental sustainability and community welfare.

Abstract

Innovations in Islamic microfinance products at BMT BAHTERA play an important role in the development of Micro, Small and Medium Enterprises (MSMEs) in Indonesia. This research analyzes various sharia-based financing product innovations at BMT BAHTERA, such as mudharabah, musyarakah and rahn, which have helped expand access to financing, increase financial inclusion, and encourage the growth of MSMEs. Using a qualitative approach through literature review and in-depth interviews, this research identifies that BMT BAHTERA's financing product development includes innovative features such as flexible payment schemes, customer mentoring and digital integration. Despite facing challenges such as limited understanding of MSMEs and the need for policy alignment, the potential for this product development is huge, supported by technological developments and increasing public awareness of Islamic finance. This research contributes to the Islamic finance literature and provides recommendations for further development to support the sustainable growth of MSMEs.
