Abstract

This article aims to examine the legality of oil mining resulting from traditional mining exploitation by the Ranto Pereulak community, East Aceh. This research uses descriptive qualitative research methods and the approach used in this research is a sociological normative approach. This research was located in Ranto Peureulak District, which is one of the sub-districts in East Aceh Regency. The results of this research show that the East Aceh Government through Qanun Number 6 of 2009 provides space for the community to manage mining products, in this case oil, by obtaining an IUP issued by the East Aceh government and going through all the conditions therein. The IUP is granted by the Regent after obtaining principle permission or approval from the Governor through the relevant provincial and district level agencies. However, in practice, many people in Ranto Peureulak District, East Aceh Regency, in managing illegal wells traditionally do not follow the applicable SOPs or regulations. Then the oil drilling carried out can endanger the health of workers and the surrounding community. This can also have an impact on the environment, because it does not pay attention to health standards or Health Safety and Environment or abbreviated as (HSE), which is the main priority for mining. In terms of safety too, it often catches fire and causes casualties, both workers and residents. Because drilling oil and gas wells is a very complex process and at each step procedures, requirements and important decisions are required that must be considered and implemented very carefully.

Abstract

Pengungsi rohingya menjadi salah satu isu kemanusiaan global paling mendesak akibat diskriminasi, pengusiran massal, dan pelanggaran HAM sistematis oleh pemerintah Myanmar. Indonesia, meskipun bukan pihak dalam Konvensi 1951 dan Protokol 1967, tetap menaruh perhatian besar terhadap persoalan ini melalui pendekatan kemanusiaan dan politik luar negeri bebas-aktif. Penelitian ini menggunakan pendekatan yuridis-normatif dengan menganalisis instrumen hukum internasional, regulasi nasional, serta literatur akademik. Studi kasus penanganan pengungsi Rohingya di Indonesia menjadi pijakan utama untuk mengukur implementasi prinsip non-refoulement dan perlindungan HAM. Hasil kajian menunjukkan Indonesia menghadapi dilema antara keterbatasan yuridis dan tanggung jawab moral. Praktiknya, pemerintah memberikan bantuan darurat, fasilitas penampungan, serta layanan kesehatan. Kehadiran Peraturan Presiden Nomor 125 Tahun 2016 menjadi langkah penting dalam pengaturan penanganan pengungsi. Di tingkat diplomasi, Indonesia mengusulkan “Formula 4+1” yang menekankan stabilitas, penghentian kekerasan, perlindungan tanpa diskriminasi, akses kemanusiaan, serta rekonsiliasi sosial. Keterlibatan Indonesia memperlihatkan peran strategis sebagai mediator regional meski dibatasi sumber daya, beban sosial-ekonomi, dan potensi ancaman keamanan. Penyelesaian krisis Rohingya masih terkendala kepentingan politik global dan prinsip non-intervensi ASEAN. Karena itu, penguatan hukum nasional, kerja sama internasional, dan diplomasi multilateral menjadi kunci untuk solusi berkelanjutan.

Abstract

This article examines the rapid development of modern marketing systems, particularly through Multi-Level Marketing (MLM), in Aceh, a region that implements Islamic law comprehensively. This raises questions about the compliance of MLM practices with the principles of Islamic muamalah, particularly in reference to DSN-MUI Fatwa No. 75/2009 on Sharia Direct Selling (PLBS). This study focuses on two issues: (1) the conformity of MLM agreements applied by PT Natura Prima Beauty with DSN-MUI Fatwa No. 75/2009; and (2) the form of agreements used by the company for its members. Using a qualitative juridical-normative method combined with field research at the Banda Aceh Stockist, the findings indicate that agreements are not established through individual written contracts but are instead regulated by a collective code of ethics binding all members. The code of ethics outlines rights, obligations, and prohibitions, and is considered a valid contract (akad) from a sharia perspective. Bonus mechanisms based on real sales, transparency through IT systems, and upline–downline mentoring ensure fairness and business sustainability. Overall, this practice meets the 12 requirements set by DSN-MUI Fatwa No. 75/2009, although challenges remain in terms of formal regulation in Aceh.
