Abstract

Deliberate destruction of cultural heritage with outstanding universal value during war is an international crime. While efforts to protect cultural heritage in wartime have been coordinated through the 1954 Hague Convention with its Blue Shield Emblem, numerous cultural sites have still been destroyed in the last decade. This issue is compounded by the varying implementation of these prtections among states. Despite Indonesia ratifying the Convention in 1966, it has struggled to properly implement the Blue Shield Emblem for its cultural heritage sites. No country is entirely safe to the risk of war, especially given the increasing conflicts in recent years. This research examines the challenges of applying the Blue Shield Emblem to the Surosowan Palace, a significant cultural heritage site in Serang City, Indonesia. The Surosowan Palace holds historical value as a symbol of the Indonesian national identity, particularly as the Banten Kingdom was a vital trading hub in Southeast Asia from the 14th to the 17th centuries. This study uses a socio-legal method, drawing on data from interviews with key informants, to explore the barriers and gaps in protecting Surosowan Palace. This research highlights Indonesia's need for regulatory adjustments to implement the 1954 Hague Convention and emphasizes the inclusion of Surosowan Palace as a Blue Shield Emblem cultural heritage site.

Abstract

Audit sektor publik berperan penting dalam memastikan transparansi dan akuntabilitas keuangan pemerintah. Namun, tantangan dalam efektivitas, efisiensi, serta deteksi dini terhadap penyimpangan masih menjadi kendala. Studi ini mengeksplorasi peran kecerdasan buatan dan blockchain dalam meningkatkan kualitas audit publik melalui tinjauan literatur sistematis. Data dikumpulkan dari jurnal akademik dan laporan kebijakan yang terindeks dalam Scopus, dipublikasikan antara 2019–2024, berbahasa Inggris, dan tersedia secara Open Access melalui penyaringan berbasis PRISMA. Studi ini juga membandingkan penerapan teknologi antara negara maju dan berkembang. Hasil menunjukkan bahwa negara maju memiliki kesiapan regulasi dan infrastruktur yang lebih baik, sedangkan negara berkembang menghadapi tantangan resistensi kelembagaan dan keterbatasan sumber daya. Kecerdasan buatan meningkatkan efisiensi audit melalui otomatisasi analisis data dan deteksi anomali, sementara blockchain memperkuat integritas data melalui pencatatan yang tidak dapat diubah. Implikasi praktis studi ini mencakup perubahan peran auditor publik dari pemeriksa manual menjadi pengelola sistem digital, serta pentingnya integrasi teknologi dalam kebijakan audit dan pengawasan real-time. Kendala utama meliputi ketidakpastian regulasi, keterbatasan teknologi, dan resistensi terhadap perubahan. Studi ini merekomendasikan penguatan kerangka regulasi, pembangunan infrastruktur digital, dan peningkatan literasi teknologi di kalangan auditor. Penelitian lanjutan diperlukan untuk mengevaluasi kesiapan institusi dan dampak jangka panjang dari transformasi digital ini dalam audit sektor publik.

Abstract

This study aims to analyze the weaknesses of regulations on election dispute resolution in Indonesia and formulate a more equitable regulatory reconstruction to increase the effectiveness and legal certainty in the election process. Using normative juridical methods and empirical approaches, this study examines the applicable regulations. The results of the study show that the current regulations do not fully reflect the principle of substantive justice, the effectiveness of the electoral dispute resolution system in Indonesia is still constrained by the imbalance between legal structure, legal substance, and legal culture. As a solution, this study recommends the reconstruction of election dispute resolution regulations, including extending the dispute resolution period to 21 working days, strengthening the legal force of mediation results to be binding, ensuring that the execution of adjudication decisions can run well, and applying sanctions for election organizers who do not carry out the decision in a timely manner. The novelty of this study lies in the critical analysis of the weaknesses of nationally applicable regulations as well as the proposed legal reconstruction that emphasizes more on substantive justice in resolving election disputes in Indonesia. With the improvement of regulations, it is hoped that the election dispute resolution system in Indonesia can be more transparent, effective, and fair, thereby increasing public trust in the election process and strengthening the legitimacy of election results in Indonesia.
