Abstract

Rujuk dalam pandangan hukum Islam adalah suatu proses di mana suami-istri kembali bersama setelah perceraian dengan tujuan memperbaiki dan melanjutkan kehidupan rumah tangga. Namun, persoalan mengenai siapa yang memiliki hak mutlak dalam menentukan keputusan rujuk menjadi penting, mengingat perlunya kesepakatan kedua belah pihak. Penulisan ini mengkaji posisi hukum rujuk dalam Islam dan menentukan siapa yang seharusnya memiliki hak utama dalam proses pengambilan keputusan tersebut. Hasil penelitian menunjukkan bahwa keputusan rujuk seharusnya merupakan hasil musyawarah antara suami dan istri, dengan mempertimbangkan kepentingan kedua belah pihak. Meskipun suami memiliki peran penting sebagai kepala rumah tangga, hak mutlak untuk memutuskan rujuk tidak bisa hanya berada pada satu pihak. Kedua belah pihak harus memiliki kebebasan untuk menyatakan persetujuan atau ketidaksetujuan tanpa adanya paksaan. Keputusan rujuk yang sah hanya dapat tercapai apabila keduanya setuju dengan sukarela. Selain itu, perlunya peran pihak ketiga atau mediator untuk membantu pasangan dalam menyelesaikan masalah dan memberi nasihat yang bijak juga menjadi sorotan. Secara keseluruhan, rujuk dalam Islam lebih ditekankan pada prinsip keadilan, musyawarah, dan kesejahteraan bersama daripada memberikan hak mutlak kepada salah satu pihak.

Abstract

This study evaluates the alignment between criminal responsibilities imposed on juvenile offenders in Indonesia and the United Nations Convention on the Rights of the Child (UNCRC). Specifically, it focuses on the Indonesian Law Number 11 of 2012 on Juvenile Criminal Justice System, which was enacted in accordance with the UNCRC. Through the use of normative methods, this study reveals that there are existing challenges hindering the effective implementation of the UNCRC provisions. Notably, the issue of long-term juvenile detention arises as a significant concern, as it restricts the autonomy and freedom of these individuals. The UNCRC emphasizes that custody should only be utilized as a last resort for young offenders. Therefore, it is crucial for the Indonesian justice system to establish more efficient and effective laws that discourage the imprisonment of juvenile criminals, thereby upholding the principles enshrined in the UNCRC.

Abstract

In recent times, there have been many cases of biological fathers marrying off their daughters outside of marriage, one of the factors being that the girl's parents did not disclose that she was born out of wedlock (adultery). The objective of this study is to examine the ruling on a biological father marrying off his daughter outside of marriage according to Imam Syafi'i. Imam Syafi'i opines that the marriage of a daughter by her biological father is invalid. This research employs a qualitative method with a library research (literature review) approach. Data were collected through the analysis of primary and secondary sources related to Islamic jurisprudence, particularly the views of Imam Syafi’i. The study aims to understand the legal and theological reasoning behind Imam Syafi’i’s opinion, by critically examining classical and contemporary scholarly works.
