Abstract

Penelitian ini mengkaji kaidah-kaidah yang berkaitan dengan nafkah dalam hukum Islam dan implementasinya dalam konteks kehidupan keluarga Muslim kontemporer. Transformasi sosial ekonomi modern telah menghadirkan kompleksitas baru yang menuntut pemahaman mendalam terhadap konsep nafkah sebagai manifestasi keadilan, kasih sayang, dan tanggung jawab dalam ajaran Islam. Metodologi penelitian menggunakan pendekatan kualitatif dengan analisis deskriptif terhadap literatur fiqh klasik dan kontemporer, serta data empiris dari praktik peradilan agama di Indonesia. Hasil penelitian menunjukkan bahwa nafkah dalam perspektif syariah memiliki dimensi yang lebih luas dari sekadar pemenuhan kebutuhan material, meliputi aspek spiritual, sosial, dan psikologis. Konsep kecukupan (kifayah) sebagai standar minimal nafkah mendemonstrasikan fleksibilitas hukum Islam dalam mengakomodasi perbedaan kondisi sosial ekonomi. Pendekatan maqashid syariah terbukti efektif sebagai kerangka metodologis dalam merespons tantangan implementasi kaidah nafkah di era modern. Integrasi pendekatan interdisipliner antara kajian fiqh, sosiologi keluarga, ekonomi Islam, dan psikologi memberikan perspektif holistik dalam memahami fenomena nafkah kontemporer. Penelitian ini merekomendasikan pengembangan regulasi adaptif, penguatan institusionalisasi peradilan agama, dan peningkatan literasi hukum Islam masyarakat sebagai strategi optimalisasi implementasi kaidah nafkah yang berkeadilan dan berkelanjutan

Abstract

This study aims to analyze the phenomenon of delayed marriage among Master of Family Law students at the State Islamic University of North Sumatra and review it from an Islamic law perspective. This study uses a qualitative method with a legal-normative and sociological approach, through literature study and in-depth interviews with students who have delayed marriage. The results of the study show that the main factors for postponing marriage include economic and financial pressures, the priority of completing education, and mental and emotional unpreparedness. From an Islamic law perspective, marriage is a highly recommended sunnah of the Prophet, but the law on postponing marriage is contextual and can change according to individual circumstances. Postponing marriage with a valid excuse, such as economic limitations, focus on studying, and efforts to prepare oneself, is considered permissible and justifiable based on the principle of maqasid al-syar'i, especially in maintaining safety of life, continuity of reason, preservation of offspring, and security of property. The implications of postponing marriage have two sides, namely positive impacts in the form of increased focus on education, career, and self-development, as well as negative impacts such as emotional pressure, loneliness, difficulty controlling sexual desire, and social pressure. This study concludes that postponing marriage among students can be understood as an effort to achieve long-term benefits as long as it is done proportionally, responsibly, and based on Islamic values.Keywords: Postponement of Marriage, Modern Era, Islamic Law

Abstract

This study examines the method of determining the criteria for kafaah from the perspective of munakahat fiqh as the main foundation for realizing a sakinah family. Kafaah is defined as equality, harmony, or balance between couples who are about to marry to maintain harmony and protect women's rights from the risk of household failure. Legally, Article 61 of the Compilation of Islamic Law emphasizes that religious differences cannot be a barrier to marriage. Scholars from four schools of thought differ on what is considered the elements of kafaah, including freedom, property, profession, and lineage. However, they all agree that the quality of religiosity and morals are the most important requirements. Religion is seen as a pillar of stability because it can guide the soul in facing household problems and prevent the emergence of caste or social stratification that contradicts the principle of piety, as mentioned in QS. Al-Hujurat verse 13. To evaluate the tension between classical texts and contemporary sociological realities, this study uses a qualitative descriptive-analytical and juridical-normative approach. Research shows that kafaah is a customary requirement for marriage, not a legal requirement. This allows women and their guardians to choose an equal partner to achieve a harmonious, stable, and lasting marriage.Keywords: kafaah criteria, sakinah family, munakahat fiqh perspective.
