Abstract

Perkembangan teknologi digital kini telah memberikan pengaruh yang besar pada kehidupan anak-anak terutama dalam penggunaan gawai dan media sosial. Walaupun dalam aspek komunikasi dan pendidikan memiliki sisi positif, pemanfaatan teknologi ini juga membawa risiko negatif. Penelitian ini bertujuan untuk melindungi hukum anak di Indonesia, dengan fokus pada peraturan seperti Undang-Undang Perlindungan Anak, Undang-Undang Informasi dan Transaksi Elektronik, Undang-Undang Perlindungan Data Pribadi, serta berbagai peraturan lainnya yang relevan. Ditemukan bahwa perlindungan anak di dunia digital masih menghadapi beberapa masalah, termasuk tidak adanya kejelasan mengenai definisi hukum tentang usia anak. Tingkat literasi digital yang rendah di kalangan masyarakat, terutama di kalangan orang tua dan anak-anak, juga memperburuk kondisi tersebut, sehingga anak-anak lebih rentan terhadap risiko eksploitasi seksual yang terjadi di ruang digital. Selain itu, keterbatasan dalam edukasi dan lemahnya pengawasan dari keluarga serta institusi pendidikan memberikan ruang bagi terjadinya kekerasan seksual di platform digital. Oleh karena itu, untuk melindungi anak- anak di era digital, diperlukan perubahan kebijakan, peningkatan literasi digital, serta penguatan kerjasama antar sektor secara terencana dan berkelanjutan.

Abstract

Legal protection is a protection given to legal subjects in accordance with legal rules, both preventive (prevention) and repressive (countermeasures), both written and unwritten in order to enforce legal regulations. Legal protection is one of the rights of Medical Personnel and Health Personnel based on Law Number 17 of 2023 concerning Health. This research compares legal protection for midwives in carrying out their professional practices before and after the enactment of Law Number 17 of 2023 concerning Health and analyzes the form of legal protection for midwives in handling medical disputes. The research method used is descriptive normative legal research. Meanwhile, the problem approaches used are the statutory approach and the conceptual approach. The research results showed that Law Number 17 of 2023 provides significant changes in the regulations for legal protection, namely they are more integrated and comprehensive and the regulations are clearer regarding the responsibilities and rights of Midwives in health services compared to previous regulations. Another comparison is in Law Number 17 of 2023 concerning Health that the resolution of medical disputes is prioritized through alternative dispute resolution outside of court. However, this law cannot yet be implemented in cases of suspected criminal acts against midwives in 2024, because the Professional Disciplinary Council (MDP) has not yet been formed and there are no recommendations for MDP as an effort to protect the law for Medical Personnel and Health Personnel. Therefore, it is hoped that implementing regulations, technical instructions from Law Number 17 of 2023 concerning Health will soon be prepared, especially regarding aspects of HRM management, guidance and supervision as well as legal protection, especially the mechanism for providing recommendations by the Professional Disciplinary Council (MDP).

Abstract

Terrorism is an international crime that jeopardizes world peace and security while severely violating human rights, particularly the right to life. In Indonesia, terrorist acts have resulted in indiscriminate loss of life, widespread fear, and extensive material damage impacting social, economic, political, and international relations. To combat terrorism, the Indonesian National Police established a specialized unit, the Special Detachment 88 Anti-Terror (Densus 88 AT), tasked with counter-terrorism efforts. This study utilizes a qualitative approach to evaluate the existing legal framework, focusing on the application of legal principles, relevant regulations, and current practices. Data collection involved analyzing primary and secondary sources, including official government documents and scholarly literature, to gain a comprehensive understanding of the legal norms relevant to the study. The results reveal that Densus 88 AT Polri, formed under Police Chief Decree No. 30/VI/2003, has been effective in counter-terrorism operations, apprehending 850 terrorists over 13 years and neutralizing key figures such as Noordin M. Top. However, concerns remain regarding alleged human rights violations, with accusations of excessive force and extrajudicial killings. Despite these criticisms, legal provisions under Law No. 5 of 2018 provide Densus 88 with the authority to use coercive measures in counter-terrorism efforts.
