<![CDATA[Penelitian ini bertujuan untuk menganalisis efektivitas penyelesaian sengketa pertanahan melalui mekanisme mediasi di Pengadilan Negeri Makassar, serta mengkaji berbagai upaya yang dilakukan oleh institusi peradilan tersebut dalam mengatasi kendala-kendala yang dihadapi dalam proses mediasi. Metode penelitian yang digunakan adalah metode normatif-empiris dengan pendekatan kualitatif. Data yang digunakan terdiri dari data primer yang diperoleh melalui wawancara dengan hakim dan mediator, serta data sekunder berupa dokumen putusan pengadilan dan peraturan perundang-undangan terkait. Hasil penelitian menunjukkan bahwa penyelesaian sengketa tanah melalui mediasi di Pengadilan Negeri Makassar belum menunjukkan efektivitas yang optimal. Hal ini tercermin dalam studi terhadap putusan perkara No. 31/Pdt.G/2023/PN.Mks. di mana proses mediasi tidak berhasil mencapai kesepakatan antara para pihak, sehingga perkara tetap berlanjut ke tahap litigasi. Rendahnya efektivitas tersebut disebabkan oleh beberapa faktor, antara lain rendahnya pemahaman para pihak terhadap manfaat mediasi, serta keterbatasan kapasitas mediator dalam mengelola konflik secara adil dan konstruktif. Sebagai upaya perbaikan, Pengadilan Negeri Makassar telah menempuh dua strategi utama, yaitu: (1) melakukan sosialisasi secara berkelanjutan kepada masyarakat dan pihak berperkara mengenai pentingnya penyelesaian sengketa melalui mediasi, dan (2) meningkatkan kualitas sumber daya manusia melalui pelatihan dan sertifikasi mediator guna memperkuat kompetensi dalam menangani sengketa tanah. Dengan demikian, keberhasilan mediasi dalam perkara pertanahan sangat bergantung pada sinergi antara kesiapan teknis mediator, pemahaman hukum para pihak, serta dukungan kelembagaan dari pengadilan. This study aims to analyze the effectiveness of land dispute resolution through mediation mechanisms at the Makassar District Court, as well as to examine the various efforts made by the judicial institution in overcoming the obstacles faced in the mediation process. The research method used is the normative-empirical method with a qualitative approach. The data used consists of primary data obtained through interviews with judges and mediators, as well as secondary data in the form of court decision documents and related laws and regulations. The results of the study indicate that land dispute resolution through mediation at the Makassar District Court has not shown optimal effectiveness. This is reflected in the study of the decision of case No. 31/Pdt.G/2023/PN.Mks, where the mediation process failed to reach an agreement between the parties, so the case continued to the litigation stage. This low effectiveness is caused by several factors, including the low understanding of the parties regarding the benefits of mediation, as well as the limited capacity of mediators in managing conflicts fairly and constructively. As an improvement effort, the Makassar District Court has taken two main strategies, namely: (1) conducting continuous socialization to the community and the parties to the case regarding the importance of dispute resolution through mediation, and (2) improving the quality of human resources through training and certification of mediators to strengthen competence in handling land disputes. Thus, the success of mediation in land cases is highly dependent on the synergy between the technical readiness of the mediator, the legal understanding of the parties, and institutional support from the court.]]>
