Abstract

This study aims to analyze the regulation of child custody and citizenship of children from mixed marriages after divorce. The method used is normative juridical based on primary and secondary legal materials. The results of the study show that child custody and citizenship status are influenced by the law of the country where the divorce is processed, and must still refer to the principle of the best interests of the child. Determination of the legal status of children must pay attention to the provisions in the Child Protection Law and the Citizenship Law.ABSTRAKPenelitian ini bertujuan untuk menganalisis pengaturan hak asuh anak dan kewarganegaraan anak hasil perkawinan campuran pasca perceraian. Metode yang digunakan adalah yuridis normatif berdasarkan bahan hukum primer dan sekunder. Hasil kajian menunjukkan bahwa hak asuh anak dan status kewarganegaraan dipengaruhi oleh hukum negara tempat perceraian diproses, dan tetap harus mengacu pada prinsip kepentingan terbaik bagi anak. Penetapan status hukum anak harus memperhatikan ketentuan dalam UU Perlindungan Anak dan UU Kewarganegaraan.
