Abstract

Mediation as an alternative form of dispute resolution outside the court is increasingly gaining attention in the Indonesian legal system. This study aims to analyze the effectiveness and efficiency of mediation in providing legal protection for disputing parties without going through a long, expensive litigation process that often causes prolonged conflict. Through a normative legal approach with literature studies and analysis of mediation regulations and practices in various institutions, it was found that mediation offers faster, more flexible solutions that pay attention to common interests. The results find that the success of mediation is highly dependent on the mediator's quality, the willingness of the parties, and adequate regulatory support. Thus, mediation can be an effective and efficient means of resolving disputes while strengthening access to justice for the community.

Abstract

Film “And Justice for All” (1979) yang dibintangi oleh Al Pacino menyajikan potret tajam tentang dinamika dunia hukum Amerika Serikat yang berlandaskan sistem common law. Sosok pengacara Arthur Kirkland menjadi representasi perjuangan seorang penegak hukum dalam menegakkan keadilan di tengah dilema etika dan tekanan sistemik. Melalui film ini, penonton diperlihatkan bagaimana kebebasan berargumentasi, keterbukaan proses peradilan, serta peran juri berfungsi sebagai elemen penting dalam menggali kebenaran materil dalam sistem common law. Tulisan ini merefleksikan keunggulan sistem common law dalam menemukan kebenaran perkara, memberikan kemanfaatan hukum yang konkret bagi para pihak, dan menumbuhkan kepastian hukum melalui living jurisprudence. Refleksi ini juga menarik pelajaran bagi sistem hukum Indonesia yang berakar pada civil law, agar mampu menghadirkan proses peradilan yang lebih terbuka, partisipatif, dan berorientasi pada keadilan substantif.

Abstract

This article proposes a new conceptual paradigm for understanding justice for crime victims by emphasizing two fundamental dimensions of human existence: agency and communion. The background of the problem indicates that despite normative progress, traditional justice approaches—retributive, restorative, and procedural—have yet to fully address the victim's need to simultaneously restore these two existential dimensions, creating a gap between the ideal of holistic justice and the fragmented reality of practice. This study aims to address the specific problem of formulating a justice framework that integrates the restoration of the victim's agency (sense of control and autonomy) and communion (social connectedness). The methodology employed is qualitative with a theoretical-conceptual research design, utilizing an in-depth literature review of social psychology theories, victimology, and legal philosophy. Data analysis techniques include content analysis and conceptual synthesis to construct an integrative model. The study results in a "Rehabilitative Justice" framework that integrates elements of traditional paradigms to simultaneously restore victims' agency and communion. The discussion reveals that this approach provides a theoretical foundation for reforming the Indonesian criminal justice system to be more humanistic and victim-centered. In conclusion, justice for victims must be understood as an existential rehabilitation process that restores dignity and social bonds. Recommendations include a philosophical reorientation of criminal law, a procedural reconstruction towards meaningful participation, and an institutional transformation of victim protection agencies towards comprehensive psychosocial and existential support.
