Abstract

Amar ma'ruf nahi munkar merupakan prinsip dasar dalam ajaran Islam yang mendorong umat untuk menyebarkan kebaikan dan mencegah kemungkaran dalam kehidupan sehari-hari. Prinsip ini terkandung dalam banyak hadits, termasuk dalam kitab Sahih Bukhari dan Sahih Muslim. Artikel ini bertujuan untuk menganalisis hadits-hadits mengenai amar ma'ruf nahi munkar dengan fokus pada teks, makna, serta penerapannya dalam masyarakat. Pertama, artikel ini mengkaji bunyi hadits amar ma'ruf nahi munkar dalam Sahih Bukhari dan Sahih Muslim. Kedua, artikel ini membahas makna dari hadits-hadits tersebut, baik dalam konteks bahasa maupun sosial-keagamaan. Ketiga, artikel ini mengkaji bagaimana prinsip amar ma'ruf nahi munkar diterapkan dalam kehidupan sosial masyarakat. Dengan demikian, artikel ini berupaya memberikan wawasan yang lebih mendalam tentang bagaimana hadits-hadits ini dapat diterjemahkan dalam tindakan nyata yang berpengaruh terhadap kehidupan sosial umat Islam.

Abstract

The issue of Interfaith Marriage presents a complex discourse in Islamic law, creating tension between nash (sacred texts) and contemporary social realities. This research aims to analyze the perspective of Contemporary Fiqh regarding the law on Interfaith Marriage and identify its relevance to the Religious Moderation agenda in Indonesia. Employing a qualitative research method with normative-juridical and comparative approaches, this article examines legal texts (fiqh) and concepts of socio-religious ethics. The analysis shows that the majority of Contemporary Fiqh establishes an absolute prohibition (haram). This prohibition is strongly based on the principle of sadd az zari'ah, which means 'blocking the means to evil,' aligning with the ushul fiqh rule: (Preventing harm takes precedence over attaining benefit), in order to safeguard faith (hifz ad-din) and progeny (hifz an-nasl). This ruling is further supported by the Quranic prohibition (Q.S. Al-Baqarah: 221) and Indonesian positive law regulations, specifically Article 40 letter (c) and Article 44 of the Compilation of Islamic Law (KHI). Meanwhile, Religious Moderation serves as a manhaj as-shifat (methodology of attitude) that demands the implementation of tawassuth (balanced) and i'tidal (just) principles in addressing social realities. In conclusion, the relevance of Religious Moderation lies in ensuring that these fiqh differences are not implemented fanatically (ghuluw) but are managed proportionally to foster social harmony (tasāmuh) in Indonesia.

Abstract

Decision Number 1953/Pdt.G/2025/PA.Bks at the Bekasi Religious Court discusses a marriage isbat petition filed by Asmalih bin Matal Siman against his siblings, Asmat bin Matal Siman and Halimah binti Matal Siman, regarding the validation of their parents’ marriage, namely the late Matal Siman bin Siman and the late Asmaroh binti Jaya, which was conducted on January 10, 1963, in accordance with Islamic law but was not registered at the Office of Religious Affairs (KUA) of West Bekasi District. This petition was submitted based on the need for legal administrative purposes and certainty of heir status due to the absence of official marriage registration. This research aims to analyze the legal considerations of the panel of judges in granting the petition and its implications for the validity of unregistered marriages. The research method employs a normative juridical approach by examining the court decision and relevant statutory provisions. The results show that the panel of judges considered that the marriage of the deceased fulfilled the pillars and requirements of marriage under Islamic law, was validly conducted with a guardian and witnesses, and had never been legally challenged. The legal considerations were based on Article 7 of the Compilation of Islamic Law and Article 49 of Law Number 7 of 1989 concerning Religious Courts and its amendments, thereby granting the court jurisdiction to adjudicate the case. The final judgment granted the Petitioner’s request, declared the marriage valid, and imposed court fees of IDR 302,000.00.
