Abstract

Sebagai akibat dari kemajuan teknologi informasi, komunikasi, dan transportasi, Globalisasi menjadi fakta yang tidak dapat dihindari. Setiap negara menghadapi berbagai tantangan sebagai akibat dari Globalisasi. Salah satunya adalah semakin tidak bermaknanya batas negara terhadap yang menurut Arjun Apparadurai terhadap kendali arus kebudayaan, media, teknologi, keuangan, dan ideologi. Keluar masuknya hal-hal tersebut juga mendorong mobilitas yang lebih tinggi. Secara langsung pergerakan manusia disebut sebagai migrasi internasional. Migrasi ini menimbulkan resiko salah satunya Human Traffi cking atau perdagantan manusia. Tulisan ini akan mengelaborasikan Human Traffi cking dalam paradigma keimigrasian serta hukum internasional. Dalam konteks Indonesia, akan dilihat fungsi Lembaga pemerintah yang berwenang menjalankan fungsi keimigrasian. Secara praktis, badan pemerintah ini melakukan aktivitas pengawasan terhadap keluar masuknya orang ke wilayah hukum Indonesia. Dengan pendekatan normatif yuridis dan empiris yakni dengan mengelaborasikan setiap pengalaman studi kebijakan dan regulasi. Sebagai hasilnya, permasalahan hukum traffi cking dapat dijelaskan dengan menyandingkan pemahaman akan hukum nasional, internasional dalam sudut pandang keimigrasian sehingga rekomendasi kebijakan ke depan dapat lebih tepat.

Abstract

Indonesia, as an archipelagic state located at the crossroads of global routes, faces dynamic human mobility, including immigratoir, asylum seekers, and refugees. This study aims to examine the legal construction of immigration administrative actions in Indonesia and their implications for sovereignty and national immigration policy. The research applies a qualitative method with a normative juridical approach based on literature review and regulatory analysis. The findings show that national regulations do not fully reflect the principle of lex superior derogat legi inferior. Although Indonesia has not ratified the 1951 Refugee Convention and the 1967 Protocol, it still bears responsibility for managing asylum seekers and refugees, creating regulatory and operational challenges. The study concludes that the role of the Directorate General of Immigration must be reinforced through cross-sectoral coordination with the military, police, local governments, and related stakeholders. Recommendations highlight three priorities: revising Presidential Regulation No. 125 of 2016 to align with national interests, requiring UNHCR to consult the Indonesian government before granting refugee status, and ensuring financial and logistical responsibilities are borne by IOM to prevent excessive burdens on Indonesia.

Abstract

Indonesia is a country strategically positioned at the crossroads of the world, a fact that has significant implications for global human movement with diverse visions and missions. The dynamics of such global mobility inevitably influence the geopolitical and geostrategic policies of the Government of the Republic of Indonesia, especially given its unique geographical conditions and location at a global intersection. This reality underlies the role of the Ministry of Law and Human Rights of the Republic of Indonesia, particularly the Directorate General of Immigration, which serves as the gatekeeper of national sovereignty. This role is encapsulated in the motto Bhumi Pura Wira Wibawa, meaning the Authoritative Gatekeeper of the State. With this guiding principle, the Directorate General of Immigration bears responsibility not only for delivering quality immigration services but also for enforcing the law, safeguarding state security, and supporting the development of community welfare. One of the key manifestations of this responsibility lies in carrying out measurable and systematic Immigration Administrative Actions. These actions require strong coordination across institutions and active involvement of various elements of society, ensuring that immigration management is both comprehensive and sustainable.
