Abstract

Konsep diversi dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA) menjadi pedoman dalam proses peyelesaian tindak pidana anak, termasuk pada kasus anak yang melakukan klitih. Penelitian ini menganalisis tentang konsep diversi terhadap keadilan serta perlindungan korban dan masyarakat dalam proses penyelesaian kasus klitih. Metode yang digunakan berupa penelitian hukum normatif dengan cara mengumpulkan data sekunder yaitu bahan hukum primer dan bahan hukum sekunder yang didapat melalui studi pustaka dan wawancara, selanjutnya dianalisis menggunakan metode kualitatif dan hasil yang diperoleh dipaparkan secara deskriptif dengan menguraikan, menjelaskan, menggambarkan sesuai permasalahan dalam penelitian. Konsep diversi terlihat hanya mengedepankan perlindungan terhadap anak sebagai pelaku, diversi seharusnya dapat memberikan kesamaan dalam keadilan dan perlindungan hukum secara proporsional, jika pelaku mendapat perlindungan khusus maka korban dan masyarakat juga harus demikian, sehingga dapat menciptakan keadilan dan perlindungan hukum yang seimbang.

Abstract

The enforcement of criminal law in electoral processes constitutes a fundamental pillar in safeguarding democratic integrity and ensuring the realization of free and fair elections. However, in practice, a significant number of electoral crime cases fail to reach the prosecution stage or are terminated during investigation.  This suggests that the criminal justice process regarding electoral offenses is not yet fully effective. The findings reveal that stagnation in handling these cases is not merely attributable to technical constraints but reflects deeper structural and systemic issues within the law enforcement framework. Weak inter-institutional coordination within Sentra Gakkumdu has been shown to hinder procedural synchronization and increase the risk of enforcement discontinuity. Furthermore, insufficient evidence and limited investigative capacity significantly constrain juridical proof. These challenges are exacerbated by the relatively short time frame for case handling, which precludes comprehensive investigations. Additionally, shortcomings in regulatory systems and low levels of public participation in monitoring and reporting violations further undermine case continuity and weaken oversight. Therefore, a comprehensive and integrative reformulation of the electoral law enforcement system is urgently required. This includes strengthening institutional coordination, updating regulatory frameworks, and enhancing public participation to improve the effectiveness of the crime process and ensuring elections that are not only credible and accountable,  but also just and democratic.

Abstract

This study aims to analyze the implications of sentencing decisions for children from the perspective of restorative justice and rehabilitation in the juvenile justice system in Indonesia. Children in conflict with the law require special protection because they are still developing psychologically and socially, so the sentencing process is not only oriented towards punishment, but also towards recovery and guidance. This study uses a normative juridical method with a statutory regulatory approach and a conceptual approach referring to Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The results show that sentencing decisions for children have a significant impact on the psychological, social, and future conditions of children. The application of restorative justice principles through diversion and rehabilitation is considered more effective in encouraging child recovery, improving social relationships, and reducing the likelihood of recurrence of criminal acts. However, the implementation of restorative justice still faces various obstacles, such as a lack of understanding among law enforcement officials, limited rehabilitation facilities, and minimal post-sentencing supervision. Therefore, it is necessary to strengthen coordination between institutions, improve the quality of guidance, and optimize the rehabilitative approach so that the juvenile criminal justice system can provide protection and best interests for children.
