Abstract

Fenomena memviralkan kasus perselingkuhan rumah tangga melalui media sosial menunjukkan gejala krisis etika digital dalam masyarakat Muslim. Penelitian ini bertujuan menganalisis dampak sosial dari tindakan tersebut serta menelaahnya melalui pendekatan maqāṣid al-syarī‘ah. Menggunakan metode kualitatif deskriptif dengan pendekatan fenomenologis, data dikumpulkan melalui wawancara mendalam terhadap enam informan, termasuk pelaku, saksi, pengguna media sosial, dan tokoh agama. Hasil penelitian menunjukkan lima dampak utama: dorongan psikologis yang spontan, kerusakan reputasi dan trauma sosial, normalisasi ghibah, terganggunya hubungan keluarga besar, serta rendahnya literasi digital dan pemahaman nilai keislaman. Semua dampak ini berkaitan langsung dengan pelanggaran prinsip ḥifẓ al-‘irḍ, ḥifẓ al-nafs, ḥifẓ al-‘aql, dan ḥifẓ ad-dīn. Analisis maqāṣid menunjukkan bahwa tindakan memviralkan aib merupakan pelanggaran struktural terhadap syariat. Oleh karena itu, diperlukan pendekatan preventif dan kuratif: edukasi pranikah, penguatan etika bermedia sosial, serta peran tokoh agama dan lembaga keagamaan dalam menyelesaikan konflik secara tertutup dan bermartabat. Penelitian ini menegaskan bahwa maqāṣid al-syarī‘ah dapat menjadi panduan normatif dan etis dalam merespons tantangan moral di era digital.

Abstract

Indonesia, with a population of 284.4 million as of March 2024, continues to face poverty challenges, with 25.22 million people (9.03%) living below the poverty line. Zakat, Infak, and Sedekah (ZIS) possess substantial potential as instruments for poverty alleviation and socio-economic empowerment, yet their implementation remains suboptimal. This study aims to analyze the management of ZIS, covering collection, distribution, and utilization, examine strategies for improving community welfare, and assess their alignment with the principles of Maqasid al-Shariah as formulated by Imam al-Syatibi. Employing a descriptive qualitative method with sociological and normative approaches, the research draws on primary data obtained through interviews and observations at LAZDA RIZKI Jember, complemented by secondary data from institutional documents and relevant literature. The findings reveal that the ZIS management at LAZDA RIZKI, including innovative programs such as the Creative Empowerment Center (Balai Kreatif), systematically reflects the realization of the five core objectives of Maqasid al-Shariah: protection of religion, life, intellect, progeny, and wealth. This study contributes to the discourse on ZIS governance from a Maqasid-based perspective and offers practical insights for zakat institutions in optimizing their role in advancing social welfare.

Abstract

Waqf plays a strategic role in strengthening the Islamic economy and promoting social welfare. However, scholarly debate persists regarding whether being Muslim constitutes a substantive legal requirement for a waqif, particularly within Indonesia’s pluralistic socio-legal context. Existing studies largely focus on administrative or economic aspects of waqf, while the normative tension between classical Islamic jurisprudence and Indonesian positive law on the religious status of the waqif remains underexplored. This study aims to address this gap by critically examining the requirement of Islamic faith for waqif from the perspectives of Islamic jurisprudence and Indonesian waqf law. Employing a qualitative normative-juridical method, the research analyzes classical and contemporary fiqh sources from the four Sunni schools (Ḥanafī, Mālikī, Syāfi‘ī, and Ḥanbalī), alongside national regulations, particularly Law No. 41 of 2004 on Waqf and Government Regulation No. 42 of 2006. The findings demonstrate that, within Islamic jurisprudence, being Muslim is not an absolute prerequisite for the validity of waqf, except when the object of waqf is directly related to ritual worship, such as mosques. The Ḥanafī, Syāfi‘ī, and Ḥanbalī schools emphasize legal capacity (ahliyyah al-taṣarruf), ownership, and lawful objectives as determining factors of validity. Similarly, Indonesian waqf law does not impose religious restrictions on waqif, provided that the waqf serves public benefit and does not contradict sharia principles. This study contributes to the discourse on waqf law by demonstrating that the requirement of Islam for waqif functions as a contextual moral and spiritual value rather than a rigid juridical condition, thereby highlighting a normative convergence between classical fiqh and national law in prioritizing social justice and public welfare.
