Abstract

Abstract: This article examines how female judges in Indonesia’s religious courts handle nusyuz (disobedience) cases by employing the Ethic of Care approach and legal political theory. Based on an analysis of several court decisions and interviews with female judges, the study finds that judicial interpretations of nusyuz vary significantly. While some judges continue to apply textual-normative approaches based on the Compilation of Islamic Law (KHI), others adopt more relational methods that consider social context, emotional dynamics, and gender power imbalances in marriage. The Ethic of Care critique highlights the limitations of a purely formalistic legal approach, advocating instead for a justice model that is empathetic, contextual, and substantively fair—especially in cases involving women. From a political legal perspective, the implementation of Islamic family law in Indonesia remains influenced by patriarchal legal structures, yet there is an increasing space for progressive reinterpretation. This study underscores the urgent need for reconstructing family law politics in Indonesia to better promote gender justice and the protection of women's rights within the judicial process.       Abstrak Artikel ini membahas penanganan perkara nusyuz oleh hakim perempuan di lingkungan peradilan agama di Indonesia dengan menggunakan pendekatan Ethic of Care dan teori politik hukum. Berdasarkan analisis terhadap sejumlah putusan pengadilan agama serta wawancara dengan hakim perempuan, ditemukan bahwa terdapat variasi pendekatan dalam memaknai dan memutus perkara nusyuz. Sebagian hakim masih menerapkan pendekatan normatif-tekstual berdasarkan pasal-pasal dalam Kompilasi Hukum Islam (KHI), sementara sebagian lainnya mulai mengedepankan pendekatan relasional yang mempertimbangkan kondisi sosial, emosional, dan ketimpangan relasi suami-istri. Pendekatan Ethic of Care mengkritisi praktik peradilan yang hanya fokus pada pembuktian formal, dan menawarkan paradigma alternatif yang lebih empatik, kontekstual, dan berpihak pada keadilan substantif, khususnya dalam perkara-perkara yang menyangkut perempuan. Di sisi lain, analisis politik hukum menunjukkan bahwa implementasi hukum keluarga Islam di Indonesia masih terikat pada konstruksi patriarkal, namun memiliki ruang untuk diubah melalui pembacaan progresif oleh aktor yudisial, khususnya hakim perempuan. Temuan ini menegaskan pentingnya rekonstruksi politik hukum keluarga Islam yang lebih responsif terhadap prinsip keadilan sosial, perlindungan perempuan, dan keseimbangan gender dalam rumah tangga.

Abstract

Community satisfaction is one of the indicators of the success of an agency in performing various tasks. With a sense of satisfaction from the community, shows the value to the performance of the agency. This research was conducted to find out the satisfaction of the community to the service in the jatiwaringin village office, it is necessary to conduct an analysis to identify what is needed by the community regarding the services provided by jatiwaringin village. The method used is servqual method consisting of five main dimensions, namely tangible, reliability, responsiveness, assurance, and empathy. So that it can know the level of public satisfaction from various aspects. After the analysis, the result is that the overall gap has a negative value. So that the community is not satisfied with the services provided by the Jatiwaringin Village Office in Bekasi City. The priority of performance that needs to be improved again is on reliability dimension with gap value -0.63 and tangible dimension with gap value -0.59. This proves that community satisfaction affects the quality of service in jatiwaringin village office in Bekasi City. Keywords: Servqual Method, Satisfaction, Service, Jatiwaringin Village
