Abstract

Despite recent legal provisions to protect emergency medical personnel in Indonesia, many still face criminal, civil, or administrative sanctions, revealing gaps in the current law’s effectiveness this study uniquely analyzes and proposes reconstructive reforms based on justice principles. This study employs a descriptive-analytical method within a constructivist paradigm and socio-legal approach, integrating Islamic and Pancasila justice as grand theories, legal systems theory as a middle-range framework, and theories of legal protection and progressive law as applied perspectives to comprehensively analyze emergency medical personnel’s legal protection. The findings reveal several key weaknesses. First, at the substantive level, vague and ambiguous legal norms result in inconsistent court decisions regarding the liability of medical personnel during emergency services. Second, at the structural level, disciplinary and ethical institutions lack assertiveness and clarity in enforcing professional accountability. Third, at the cultural level, crucial values such as patient safety, autonomy, and a culture of apology have not been fully embedded in medical practice. To address these problems, the study proposes a reconstruction of the legal framework by promoting centralized responsibility, expanding immunity protections for emergency actions, extending procedural time limits, and recognizing the role of unified professional organizations. These reforms aim to ensure effective and just legal protection for medical personnel.

Abstract

In the context of modern state governance, Islamic political values provide an ethical framework to strengthen the integrity of government and public policy. This study explores the principles and objectives of the state in the Qur’an and Hadith, supported by interpretations of classical and contemporary scholars. The aim is to identify the principles of governance and the objectives of the state from an Islamic perspective and to examine their relevance to modern administration. The method used is library research with primary sources from Al-Qur’an, Hadith, and Qur’anic interpretation, along with secondary sources from academic literature. The analysis applies a thematic exegesis approach and qualitative interpretation. The findings show that the principles of Islamic governance include trust (Surah al-Nisa’ [4]: 58), justice (al-Ma’idah [5]: 8), consultation (al-Shura [42]: 38), unity (Ali ‘Imran [3]: 103), and freedom of religion (al-Baqarah [2]: 256). The objectives of the state cover public welfare, the establishment of justice, and the development of a moral society. The implication of this study is that it reinforces previous findings on justice and consultation while adding a new perspective by highlighting the integration of human values and universal welfare in modern governance. The limitation lies in its normative-theological approach, which does not address empirical dimensions, so further research is needed to test the application of these principles in contemporary state governance. Di tengah tata kelola negara modern, nilai-nilai politik Islam memberikan kerangka etis untuk memperkuat integritas pemerintahan dan kebijakan publik. Kajian ini mengeksplorasi prinsip dan tujuan kenegaraan dalam Al-Qur’an dan Hadis, didukung penafsiran ulama klasik dan kontemporer. Tujuannya mengidentifikasi prinsip pemerintahan dan tujuan negara dalam perspektif Islam serta relevansinya dengan administrasi modern. Metode yang digunakan adalah studi pustaka dengan sumber primer berupa Al-Qur’an, Hadis, dan tafsir, serta sumber sekunder dari literatur akademik. Analisis dilakukan melalui pendekatan tafsir tematik dan interpretasi kualitatif. Hasil penelitian menunjukkan bahwa prinsip pemerintahan Islam mencakup amanah (Surat al-Nisa’ [4]: 58), keadilan (al-Ma’idah [5]: 8), musyawarah (al-Syura [42]: 38), persatuan (Ali ‘Imran [3]: 103), dan kebebasan beragama (al-Baqarah [2]: 256). Tujuan negara meliputi kesejahteraan publik, tegaknya keadilan, dan terbentuknya masyarakat bermoral. Implikasi penelitian ini adalah memperkuat temuan terdahulu tentang keadilan dan musyawarah, serta menambah perspektif baru yang menekankan integrasi nilai kemanusiaan dan visi kemaslahatan universal. Limitasinya adalah pendekatan normatif-teologis yang belum menyentuh dimensi empiris, sehingga penelitian lanjutan perlu menguji penerapan prinsip-prinsip ini dalam tata kelola negara modern. Abstract

The low level of drinking water subscriptions at PDAM Tirta Sari in Binjai City is a problem that needs to be studied to determine the causal factors. This study aims to analyze the factors that most influence the low interest of the people of Binjai City in subscribing to PAM. The method used is a weighting and ranking analysis of several hypotheses related to tariffs, water quality, service continuity, network coverage, and the availability of alternative water sources. The results of the analysis indicate that the mismatch between PDAM Tirta Sari Binjai City's tariffs and the quality of services provided is the most dominant factor influencing the low level of subscriptions at PDAM Tirta Sari Binjai City. This factor is ranked first with the highest total value. Other factors that also influence are low water pressure, limited distribution network coverage, and the existence of alternative water sources, while the quality of PDAM Tirta Sari Binjai City's water sourced from the Bingai River Watershed (DAS) has the lowest influence compared to other factors.

Abstract

This study aims to analyze the concepts and principles of religious moderation, examine its role in fostering tolerance and interreligious harmony, and identify the challenges and opportunities in implementing religious moderation within Indonesia’s multicultural society. Religious moderation is viewed as a strategic approach to maintaining social harmony amid the country’s religious, cultural, and ideological diversity. The research employs a qualitative approach using a library research method. Data were collected through a critical review and analysis of scholarly literature, including peer-reviewed national journals published after 2022, academic books, and relevant policy documents related to religious moderation. Data analysis was conducted through data reduction, thematic categorization, and descriptive-analytical interpretation to achieve a comprehensive understanding of the research focus. The findings indicate that religious moderation plays a crucial role in strengthening tolerance and interreligious harmony in Indonesia by promoting balance, justice, inclusivity, and respect for diversity. The study reveals that religious moderation is effectively implemented through education, interfaith dialogue, the involvement of religious leaders, and supportive public policies that encourage harmonious religious life. However, its implementation continues to face several challenges, such as exclusive religious interpretations, the spread of extremism in the digital era, uneven public understanding of religious moderation, and the politicization of religion. On the other hand, significant opportunities exist, including strong governmental support, the integration of religious moderation into educational curricula, the use of digital media to disseminate moderate values, and the development of community-based religious moderation initiatives. In conclusion, religious moderation is an essential and relevant approach for maintaining tolerance and interreligious harmony in Indonesia. The success of its implementation depends largely on the synergy between government institutions, educational establishments, religious leaders, and civil society. The implications of this study emphasize the importance of strengthening policies, education, and socio-religious literacy based on religious moderation in a sustainable manner to ensure that the values of tolerance and harmony become deeply embedded in Indonesian society.
