Abstract

Siswa yang mendapat beasiswa telah memiliki niat untuk melanjutkan Pendidikan ke jenjang yang lebih tinggi. Keinginan yang besar yang di fasilitasi oleh Yayasan Martin de Porres untuk dapat membantu siswa meraih setiap mimpi mereka. Namun terdapat kendala yang tidak dapat dipungkiri bahwa siswa tidak mudah beradaptasi dengan pola Pendidikan dan karakter yang dibutuhkan agar menjadi siswa yang berprestasi. Metode yang dilakukan adalah pengumpulan data, observasi, membuat program, melaksanakan program serta melakukan evaluasi dari program yang telah dilaksanakan.Setelah program dijalankan selama 6 bulan ternyata belum didapatkan hasil yang signifikan untuk memperoleh karakter servant leadership. Para penerima beasiswa Yayasan Martin de Porres masih berkutat pada pencapaian self leadership yaitu pada disiplin. Sedangan kemajuan yang didapat adalah pengalaman berorganisasi dan penyelesaian masalah dalam kelompok, Untuk menekankan kedisiplinan perlu diberikan metode reward and punishment sehingga dapat menekan ketidakteraturan. Untuk rekomendasi kedepan, diperlukan adanya konsistensi para pendamping kegiatan sehingga dapat memberikan masukan atau solusi yang kurang lebih sama. Pendampingan minimal dilakukan 3 semester berturut-turut untuk mendapatkan hasil yang diinginkan oleh Yayasan Martin de Porres.

Abstract

Settlement of problems that occur in Indonesia can be non-litigation or litigation. The process of solving problems through litigation is through the Court. Courts are divided into two, namely general courts and special courts. The Industrial Relations Court is included in the Special Court, which has the authority to resolve Industrial Relations Disputes in accordance with the Industrial Relations Dispute Settlement Act, namely Law Number 2 of 2004. This writing discusses the limits of the authority of the Industrial Relations Court with the existence of SEMA Number 7 of 2012. Types the research used in this paper is normative juridical. The approach used is the statutory approach and the conceptual approach. Analysis using descriptive qualitative. The results of this study note that the settlement of industrial relations disputes through the Industrial Relations Court can be carried out after the non-litigation method of settlement is unsuccessful. Disputes that can be resolved at the Industrial Relations Court are Industrial Relations Disputes, namely Rights Disputes, Interest Disputes, Disputes on Termination of Employment and Disputes Between Labor Unions. The Industrial Relations Court can resolve disputes as long as they are not accompanied by other dispute cases, for example bankruptcy or criminal cases. Abstract

Indonesia established a State Administrative Court to resolve disputes between the government and the community. Initially, the State Administrative Court had the authority to make decisions on accepting positive fictitious applications based on the Government Administration Law, but since the introduction of the Job Creation Law, the authority of the State Administrative Court has been abolished. So there will be a judicial review of the Job Creation Law. Decision Number 10/PUU-XX/2022 is a judicial review of the Job Creation Law. The decision explains that the application cannot be accepted because it is still premature because the Job Creation Law has still been formally revised for two years since 2020. This research is normative juridical research. The result of this research is that there is a legal vacuum in the authority to grant acceptance of positive fictitious applications because the Job Creation Law does not regulate it, so that if the Government still does not regulate this matter, then the Government must create a new institution that can provide decisions on accepting positive fictitious applications.
