Abstract

Pembiayaan Kredit Pemilikan Rumah (KPR) Syariah merupakan salah satu produk unggulan perbankan syariah yang bertujuan memenuhi kebutuhan hunian masyarakat dengan tetap berlandaskan prinsip-prinsip syariah. Namun, dalam praktiknya pembiayaan KPR Syariah tidak terlepas dari risiko pembiayaan bermasalah, terutama ketika nasabah mengalami Pemutusan Hubungan Kerja (PHK) yang berdampak pada menurunnya kemampuan membayar angsuran. Penelitian ini bertujuan untuk menganalisis faktor penyebab terjadinya pembiayaan bermasalah, strategi penyelesaian pembiayaan KPR Syariah, serta menilai kesesuaian penyelesaian tersebut ditinjau dari perspektif Maqashid Syariah pada PT Bank Aceh KC SM Raja. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kasus. Teknik pengumpulan data dilakukan melalui wawancara, observasi, dan dokumentasi terhadap pihak bank dan nasabah KPR Syariah yang terkena PHK dan pengajuan restrukturisasinya ditolak. Hasil penelitian menunjukkan bahwa penyebab pembiayaan bermasalah berasal dari faktor eksternal berupa kehilangan pendapatan akibat PHK serta faktor internal berupa kebijakan manajemen risiko dan prinsip kehati-hatian bank dalam menyetujui restrukturisasi pembiayaan. Strategi penyelesaian yang dilakukan bank meliputi upaya restrukturisasi pembiayaan, namun tidak seluruh permohonan dapat disetujui berdasarkan evaluasi kemampuan bayar jangka panjang nasabah. Ditinjau dari perspektif Maqashid Syariah, penyelesaian pembiayaan telah memperhatikan aspek perlindungan harta (hifdz al-mal), tetapi masih memerlukan penguatan dalam menjaga kemaslahatan nasabah, khususnya pada aspek perlindungan jiwa (hifdz al-nafs) dan keadilan sosial. Penelitian ini diharapkan dapat menjadi kontribusi bagi pengembangan kebijakan perbankan syariah yang lebih berorientasi pada prinsip maqashid syariah dalam penyelesaian pembiayaan bermasalah.

Abstract

Wage payment practices are a crucial element in employment relationships because they relate to legal certainty and the protection of workers' economic rights. However, in the informal sector—particularly home-based catering businesses—wage mechanisms are often implemented without a clear agreement regarding the amount and timing of payments. This study aims to analyze wage payment practices in catering businesses in Medan Johor District from the perspective of Government Regulation Number 36 of 2021 concerning Wages and DSN-MUI Fatwa Number 112/DSN-MUI/IX/2017 concerning Ijarah Contracts. This study uses a qualitative approach with juridical-empirical methods through in-depth interviews with workers and catering business owners and an analysis of relevant regulations and fatwas. The results show that wage payments are fluctuating and uncertain, depending on the number of orders, without a clear agreement from the start of the employment relationship. This practice does not comply with the principle of wage certainty in labor law and contradicts the principle of clarity of ujrah in ijarah contracts. This research contributes to strengthening the study of labor law and Islamic law by emphasizing the urgency of wage clarity as an instrument of justice and protection for workers in the informal business sector.

Abstract

The rice trade in traditional markets still faces issues of inconsistency between the quality of rice and the information stated on the packaging, one of which occurs through the practice of repackaging low-quality rice and selling it as medium or premium rice. This study aims to analyze the practice of repackaging (repacking) medium rice using low-quality rice in traditional markets in Pekanbaru from the perspective of Indonesian positive law and Islamic economic principles. This research employs a qualitative approach through interviews, observations, and documentation. The findings indicate that the repacking practice causes losses for consumers because the quality of the rice does not match the information provided on the packaging and may also pose potential health risks. From a legal perspective, such actions violate Law Number 8 of 1999 concerning Consumer Protection and regulations related to food labeling. However, weak supervision has allowed this practice to continue without adequate enforcement. From the perspective of Islamic economics, the repackaging of low-quality rice that is sold as medium or premium rice constitutes tadlis (deception) and gharar (uncertainty), which contradict the principles of honesty, trustworthiness, and fairness in transactions. The concept of hisbah in the thought of Ibn Taymiyyah emphasizes the obligation of the state to supervise markets and prevent fraud. Nevertheless, the conditions in the field indicate that this function has not yet been carried out optimally. This study highlights the importance of strengthening government supervision and improving consumer literacy. It also contributes academically by enriching studies on fraudulent practices in food trade through the integration of Indonesian positive law analysis and Islamic economic perspectives, particularly the concept of hisbah in Ibn Taymiyyah’s thought as a mechanism for market supervision.
