Abstract

Advances in artificial intelligence (AI) technology, particularly generative AI, have produced digital works that resemble human creations. However, Law Number 28 of 2014 on Copyright does not expressly regulate the legal status of AI-generated works or human contributions through prompts, resulting in a legal voids. This research examines the problem of copyright protection for AI-produced works from the perspective of Indonesian law. The discussion focuses on the legal status of prompts as expressions of ideas, the role of creators within the current legal framework, and the urgency of reforming the Copyright Law to face digital era challenges. This urgency is underscored by the growing number of cases involving unauthorized commercial use of AI works, such as the viral case between independent creator Noxxa and game company Garena. This study employs a qualitative approach using a normative juridical method, analyzing relevant laws in Indonesia and several other countries. The findings indicate that although AI-generated works are not directly protected, human contributions through original prompts can fulfill the requirement of originality and deserve copyright protection. Therefore, legal reform is needed to accommodate technological developments and ensure fair, proportional protection for works involving AI.

Abstract

Transformasi gerakan mahasiswa di Indonesia menunjukkan kesinambungan dalam mengaktualisasikan Pancasila dalam kerangka hukum tata negara. Sejak Reformasi 1998 hingga aksi digital 2025, mahasiswa konsisten hadir sebagai agen perubahan dan pengawal konstitusi, menyalurkan perjuangan melalui demonstrasi jalanan maupun aktivisme daring. Ruang digital memperluas partisipasi dan mempercepat mobilisasi, sekaligus memunculkan disinformasi, polarisasi, serta represi yang mengancam kebebasan sipil. Dinamika tersebut menegaskan bahwa Pancasila tidak hanya berfungsi sebagai ideologi negara, tetapi juga sebagai kompas etik dan dialektika hukum yang menjembatani prinsip konstitusi dengan praktik demokrasi di era digital. Integrasi nilai Pancasila, literasi digital, dan hukum tata negara memberikan perspektif baru tentang bagaimana gerakan mahasiswa beradaptasi terhadap tantangan kontemporer tanpa kehilangan peran historisnya. Penguatan literasi digital, perlindungan kebebasan akademik, dan kepatuhan negara terhadap hak konstitusional menjadi agenda mendesak untuk menjaga ketahanan demokrasi Indonesia.

Abstract

The rapid advancement of digital technology and artificial intelligence (AI) in the twenty-first century has fundamentally transformed the structure of modern constitutional governance. Digitalization has reshaped the interactions between governments and citizens, altered the patterns of political participation, and presented major challenges to constitutional principles. This study aims to analyze the implications of technological development for constitutional law and propose the concept of a digital constitution as an adaptive framework in the AI era. This study employs a normative legal method, using both conceptual and statutory approaches. Legal materials consist of primary, secondary, and tertiary sources, which are analyzed qualitatively and descriptively. The findings reveal that, while digital transformation enhances governmental efficiency and public transparency, it also generates serious risks, including data misuse, digital surveillance, and political disinformation. These dynamics demand a reinterpretation of constitutional norms to protect citizens' digital rights in cyberspace. The concept of a digital constitution is proposed as a normative response that integrates digital rights into constitutional rights and reaffirms the principle of the rule of law within technological governance. To achieve a democratic and just constitutional order, it is crucial to strengthen regulatory frameworks, ensure algorithmic accountability, and foster collaboration among state institutions, civil society, and the private sector. Ultimately, constitutional law must evolve into an adaptive, transparent, and fair system that can address the profound challenges of the digital and AI-driven era.
