Abstract

The progress of a nation can be seen from the level of legal awareness and legal obedience of its citizens. The higher the legal awareness and legal obedience of a country's population, the more orderly the life of society and the state will be. The factor of legal awareness and legal obedience plays an important role in the development of law, meaning that the weaker the level of legal awareness of society, the weaker the legal strictness, conversely the stronger the legal awareness, the stronger the legal obedience factor. Indonesia as a country of law. This statement indicates that all actions must be based on the legal principles of the rule of law as stated in Article 1 paragraph (3) of the 1945 Constitution. However, in Indonesia there are still many cases of legal violations committed by state officials such as the Ferdi Sambo case, as well as the case of the mutilation of a wife by her husband TBD in Ciamis, etc. Therefore, it is necessary for the author to conduct further research using empirical legal research methods using a juridical and sociological approach to measure the impact and effectiveness of Legal Awareness Legal Obedience of Society and Government as a Factor in Upholding the Rule of Law in Indonesia. Legal awareness from the community and government requires several efforts hard work and strategy in enforcing the law in Indonesia and cannot be separated from the ability and strong will of various elements both from the community and the government because it is the key to upholding the law in Indonesia so that it will lead to order and progress.

Abstract

Transformasi sektor pangan dan energi di Indonesia menjadi prioritas strategis dalam pemerintahan Presiden Prabowo Subianto, khususnya pasca Pemilu 2024. Penelitian ini bertujuan menganalisis dinamika politik ketatanegaraan dalam implementasi kebijakan lumbung pangan dan hilirisasi energi serta kesesuaiannya dengan prinsip konstitusional. Metode penelitian menggunakan pendekatan yuridis normatif dengan tambahan pendekatan konseptual dan sosiologis. Data dikumpulkan melalui studi kepustakaan, baik sumber primer berupa peraturan perundang-undangan dan putusan Mahkamah Konstitusi, maupun sumber sekunder dari buku, jurnal, dan laporan penelitian. Hasil penelitian menunjukkan adanya kesenjangan antara norma konstitusi (das sollen) dan praktik implementasi (das sein), tercermin dari minimnya partisipasi publik, lemahnya pengawasan legislatif, serta potensi pelanggaran hak-hak konstitusional masyarakat. Di sisi lain, stabilitas politik pasca Pemilu 2024 memberikan peluang percepatan transformasi, namun berisiko mengurangi kontrol checks and balances. Penelitian ini menegaskan perlunya penguatan tata kelola demokratis dalam transformasi pangan dan energi agar sejalan dengan amanat Pasal 33 UUD NRI 1945 dan prinsip negara hukum demokratis. Abstract

The rapid expansion of artificial intelligence (AI) within criminal justice systems has transformed contemporary law enforcement from reactive adjudication toward predictive governance based on algorithmic surveillance, risk assessment, and data-driven policing. While predictive policing technologies are frequently promoted as instruments of efficiency and objectivity, their increasing use has generated profound concerns regarding algorithmic bias, procedural inequality, opacity in decision-making, and the erosion of fair trial guarantees. This article examines how the rise of algorithmic justice challenges the foundational principles of modern criminal procedure, particularly the presumption of innocence, transparency, equality before the law, and the right to defense. Using normative legal research with conceptual and comparative approaches, this study analyzes the development of predictive policing and AI governance in several jurisdictions, including the United States, China, the European Union, and Indonesia. The article argues that conventional fair trial doctrines are increasingly inadequate in responding to opaque and predictive systems of algorithmic governance because existing procedural safeguards were primarily designed for human decision-makers rather than automated computational systems. This study further demonstrates that AI-driven law enforcement not only reproduces structural discrimination embedded within historical criminal data, but also expands state surveillance capacities through technologically mediated forms of governance. As a theoretical contribution, this article proposes a reconstruction of fair trial principles through a framework of human-centered algorithmic governance emphasizing algorithmic transparency, explainability rights, meaningful human oversight, anti-discrimination safeguards, independent algorithmic auditing, and digital procedural rights. Ultimately, the article argues that the future legitimacy of criminal justice systems depends upon the ability of legal institutions to control algorithmic power while preserving constitutionalism, procedural justice, and fundamental human rights in the era of digital governance.

Abstract

This research analyzes the legal responsibility of marketplace operator Lazada regarding the freezing of seller accounts and sales balances based on Government Regulation Number 80 of 2019 concerning Trade Through Electronic Systems. Using a qualitative juridical empiric approach, the study examined the case of Aba Mart, a seller who experienced account freezing and loss of approximately Rp 15 million in sales balance. Through in-depth interviews, direct observation, and documentation analysis with Aba Mart as the single case subject, the research reveals that Lazada's unilateral account freezing actions constitute breach of contract and unlawful conduct, violating Articles 7, 15, and 18 of PP No. 80/2019. The findings indicate that Lazada violated the principles of good faith and balance in the Indonesian Civil Code. The dispute resolution mechanisms available to sellers prove ineffective and inaccessible, particularly for small traders in Bandung. This research recommends comprehensive regulatory reforms addressing transparency standards, independent appeal mechanisms, strengthening of standard contract clauses, and provision of legal assistance to small business operators to create a fair and equitable e-commerce ecosystem.

Abstract

The establishment of the Badan Pengelola Investasi Daya Anagata Nusantara (Danantara) under Law Number 1 of 2025 represents a significant transformation in the management of state investment and strategic assets. Its establishment raises issues concerning authority, governance, transparency, oversight, and state administrative accountability. This study employs a normative juridical method using statutory and conceptual approaches. Legal materials are analyzed qualitatively to examine Danantara’s institutional authority from the perspective of state administrative accountability. Danantara has a legal foundation to manage state investment and strategic assets; however, its expanded authority must be balanced with clear mandates, functional delineation, effective oversight, independent auditing, transparent reporting, and conflict-of-interest prevention. Comparisons with state investment institutions in Singapore, Malaysia, and Norway demonstrate the importance of balancing investment autonomy with accountability mechanisms. Danantara requires an accountable investment autonomy model that balances investment discretion with legal, administrative, financial, institutional, and public accountability to ensure that state assets are managed transparently, audibly, professionally, and in accordance with the public interest.
