Abstract

This study examines the application of the principle of presumption of innocence to children involved in theft due to coercion by adults. Children as vulnerable subjects of law are often exploited or pressured to commit criminal acts against their free will, raising critical questions about the proper legal protection. Using normative juridical methods through legislative approaches and case studies, this study analyzes Indonesian regulations, especially Law No. 11 of 2012 concerning the Juvenile Criminal Justice System, as well as relevant judicial practices. The results of the study show that although the principle of presumption of innocence is a fundamental legal guarantee, its application in the case of children is still inconsistent. Law enforcement officials tend to prioritize a repressive approach, ignoring the psychological condition of children and coercive elements that eliminate the element of error (mens rea). Theoretically, this study uses legal protection theory, justice theory, and restorative justice principles, with an emphasis that children who are forced to commit crimes should be seen as victims of exploitation. The conclusion of the study confirms that the effectiveness of legal protection depends on the consistency of the application of the principle of presumption of innocence, the integration of restorative approaches, and strong institutional support to ensure the best interests of children.

Abstract

Drug abuse among adolescents in Jayapura City is a pressing issue with significant repercussions for health, society, and the future of younger generations. Due to Jayapura's strategic position as a border city with Papua New Guinea, it faces a heightened risk of cross-border drug trafficking, making it particularly vulnerable. This study explores the various factors contributing to the rise in drug abuse among adolescents, including individual, family, and peer group dynamics, socio-economic conditions, weak legal enforcement, and the influence of globalization. The findings suggest that a multifaceted approach is essential in addressing the problem. Repressive measures alone are insufficient, and should be complemented by preventive, rehabilitative, and educational strategies. Such approaches must emphasize child protection principles and ensure justice that is both substantive and forward-thinking. Progressive and responsive legal frameworks, aligned with the goals of criminal punishment, are necessary to effectively combat drug abuse in Jayapura. Moreover, these frameworks should prioritize adolescent recovery, recognizing that these individuals are the future of the nation.

Abstract

This study examines The Legal Position of the Peace Deed as a Means of Dispute Resolution for Parties Outside the Court, focusing on the notary’s authority and the legal strength of the peace deed compared to court decisions. Using a normative juridical method, this research emphasizes an analysis of positive legal provisions such as the Indonesian Civil Code, the Notary Law, and the Law on Arbitration and Alternative Dispute Resolution. The findings indicate that notaries possess legal authority to draft peace deeds as authentic instruments ensuring legal certainty and justice for disputing parties. A peace deed made before a notary holds the same legal force as a court decision with permanent legal effect (inkracht van gewijsde) and may serve as an executorial title when issued in the form of a grosse acte. Thus, the notarial peace deed functions as an effective, efficient, and equitable legal instrument for resolving disputes, reinforcing the principles of simplicity, speed, and low cost within the national legal system.
