Abstract

Abstract: The "Marriage is Scary" phenomenon among younger generations reflects a shift in how marriage is perceived, not as a key life achievement, but as a source of anxiety and uncertainty. This trend is reinforced by high digital media consumption, as seen in Serang Baru District, Bekasi, an area with significant internet and social media use. This study aims to analyze the factors behind the emergence of the "Marriage is Scary" phenomenon, its impact on interest in marriage, and the Indonesian government's response. A qualitative method with a case study approach was used. Data were collected through observation, interviews, and documentation, then analyzed using Creswell’s thematic analysis model, which includes coding, theme identification, interpretation, and integration with relevant literature. To ensure validity, data triangulation from multiple sources was applied. The findings reveal that fear of marriage among youth in Serang Baru is influenced by five main factors: economic instability, social pressure, social media influence, emotional instability, and traumatic personal experiences. These factors contribute to a declining interest in marriage, marked by delayed decisions and greater selectivity in choosing a partner. The study also found that while the Indonesian government has responded through premarital education and legal protections for women, it has not explicitly addressed the "Marriage is Scary" narrative. Abstract

The digital era builds cross-cultural relationships, so there is a shift in choosing the ideal partner criteria. According to the Muslim community, this is a highlight in itself, Islam has long regulated the concept of choosing a partner by making religion the main foundation. The purpose of this study is to examine the extent to which the digital era influences the views of generation Z in choosing the ideal partner, knowing the criteria for couples who are considered ideal, and examining these preferences through a normative perspective sourced from Islamic law, Marriage Law, and sharia maqashid. This study uses a qualitative approach with field studies through interviews and open questionnaires, involving Muslim university students spread across Java, Kalimantan, and Medina as purposive subjects. The results of this study show that Gen Z who live in the digital era is influenced by various platforms and information accessed. The criteria for choosing the ideal partner based on the perspective of Gen Z in the digital era are; apply Islamic teachings in daily life, have a vision and mission that is in line with and be responsible, established, physically attractive, sekufu and able to establish healthy relationships. Gen Z not only prioritizes religious aspects, but also considers social factors, which reflects a shift from traditional norms. The results of the normative analysis indicate that despite the change in preferences, these criteria are still in line with religious teachings and national law. This study contributes in the form of fostering responsive Muslim families in the digital era.

Abstract

This study aims to examine the transformation of high heritage property into low heritage property in Kenagarian Sumani as a form of community adaptation to social dynamics. The study focuses on the factors that drive the change in the status of inheritance from high heritage property to low heritage property, as well as the practices involved. The phenomenon is then analysed from the perspective of maqāṣid al-syarī‘ah to evaluate its alignment with the objectives of Islamic law in achieving the best interests of those involved in the inheritance process. This study uses a qualitative approach with a case study design. Data were collected through interviews with niniak mamak, traditional leaders, and local residents, as well as through an analysis of various sources of customary law and Islamic literature. The results of the study show that the change in status from high to low heritage is made to prevent family conflict. This change has a positive impact on ownership clarity and family harmony, despite reducing the traditional value of high-status property as a symbol of identity. From a sharia perspective, this shift is in line with the Islamic sharia's goal of safeguarding property, lineage, life, intellect and religion, illustrating the adaptive interaction between customary law and Islamic legal objectives.

Abstract

The increasing participation of women in higher education often intersects with patriarchal norms and triggers domestic conflicts leading to divorce. Indonesian positive law does not explicitly regulate higher education as a ground for divorce; however, judicial practice demonstrates that education frequently appears within the context of marital breakdown. This study examines judicial considerations in the Decisions of the Religious Court of Ambon No. 242/Pdt.G/2020/PA.Ab and the Religious Court of Raha No. 0357/Pdt.G/2020/PA.Rh through normative research using a case approach, focusing on the basis of judicial reasoning, statutory interpretation, and the application of the maqashid al-shari’ah perspective. The findings indicate that higher education is not treated as an independent legal ground for divorce, but rather as a social context accompanying objectively proven marital breakdown, including prolonged separation, loss of communication, failure to fulfill marital obligations, and abandonment. Judges applied extensive and teleological interpretations of Article 19 letters (b) and (f) of Government Regulation No. 9 of 1975 in conjunction with Article 116 letters (b) and (f) of the Compilation of Islamic Law, reflecting a no-fault divorce approach that emphasizes the failure of marital functions rather than fault-based reasoning. A disparity in systematic interpretation is identified: the Religious Court of Ambon emphasizes the failure of marital objectives through a legal-formal approach, while the Religious Court of Raha prioritizes the protection of the wife through a gender-responsive, legal-substantive approach. From the perspective of maqāṣid al-sharīʿah, divorce in cases involving higher education is justified to safeguard the five essential objectives of Islamic law and to prevent greater harm than maintaining a disharmonious marriage.

Abstract

The trend of premarital sex among Indonesian Muslim youth has become increasingly worrying at both global and national levels, largely due to limited knowledge and awareness. This phenomenon poses serious health risks, including sexually transmitted diseases such as HIV/AIDS and the possibility of unhealthy offspring. Premarital education is therefore expected to provide accurate information related to reproductive health, particularly for Muslim women. This study aimed to examine the general perceptions of female students at STDI Imam Syafi'i Jember regarding the quality and benefits of premarital reproductive health education. It also analyzed the correlation between age and differences in marriage plans with these perceptions. A quantitative approach was applied using a Likert-scale questionnaire administered to 130 female students. Data were analyzed using descriptive statistics, correlation tests, and the Mann–Whitney U test with JASP software. The findings showed that 92% of respondents held high or very positive perceptions of the quality and benefits of the education provided. These perceptions were not influenced by age or by differences in the students’ marriage plans. Overall, the results emphasize the urgency and relevance of premarital reproductive health seminars and the need for wedding education._____________________________________________________________Tren seks pranikah mengkhawatirkan baik secara global maupun nasional di kalangan remaja Muslim Indonesia, yang sebagian besar disebabkan oleh kurangnya pengetahuan. Masalah ini memiliki konsekuensi kesehatan yang parah, termasuk risiko penyakit seperti HIV/AIDS dan potensi keturunan yang tidak sehat. Pelaksanaan edukasi pranikah diharapkan mampu memberikan informasi terkait permasalahan yang berkaitan dengan kesehatan reproduksi terutama pada kalangan wanita muslimah. Tujuan dari penelitian ini adalah untuk mengetahui gambaran umum persepsi mahasiswi STDI Imam Syafi’i  Jember tentang kualitas dan manfaat dari edukasi kesehatan reproduksi pranikah yang dilakukan serta menguji korelasi usia dan perbedaan rencana menikah terhadap persepsi yang diberikan.. Dengan menggunakan pendekatan penelitian kuantitatif,  menggunakan kuesioner skala Likert pada 130 mahasiswi. Metode statistik deskriptif, uji korelasi dan uji Mann-Whitney U digunakan untuk menganalisis data dengan menggunakan JASP. Hasil penelitian menunjukkan bahwa persepsi mahasiswi terhadap kualitas dan manfaat edukasi pranikah yang diberikan termasuk kategori tinggi/sangat positif (92%). Persepsi ini tidak dipengaruhi oleh usia maupun perbedaan rencana menikah dari mahasiswi. Hasil ini menunjukkan bahwa edukasi pranikah melalui seminar kesehatan reproduksi yang dilakukan memiliki urgensi dan relevansi topik seminar tersebut sebagai bekal penting bagi wanita muslimah. Namun edukasi ini belum sepenuhnya memberikan manfaat bagi persiapan pernikahan. Oleh karen itu perlu dilakukan seminar lanjutan untuk persiapan pernikahan.

Abstract

This research aims to analyze the effectiveness of Cash Waqf Link Deposit (CWLD) as a means of collecting productive waqf funds at the Sentra Jamur Sragen. This study focuses on CWLD practices and productive waqf from an Islamic perspective, as well as the implications of productive waqf for waqf donors and the surrounding community. The research methodology uses a descriptive qualitative approach with a case study approach. This method was chosen to provide an in-depth description of the CWLD strategy implemented at Bank Syariah Sragen, productive waqf practices at the Sentra Jamur Sragen, and the implications of productive waqf practices. The results of this study indicate that CWLD is the right choice for collecting waqf funds to carry out productive waqf because CWLD-based fund collection is considered transparent, fast, and effective. In addition, CWLD and productive waqf practices are considered to be in accordance with Islamic law applicable in Indonesia and in accordance with regulations set by the government. Furthermore, waqf donors and the surrounding community feel the positive impact of the Sentra Jamur Sragen.
