Abstract

A constitution is a set of rules within a state and plays a vital role within a country. This journal attempts to examine the importance of a constitution for each country. This research method uses a qualitative approach aimed at organizing and sorting data into patterns, categories, and basic descriptive units so that themes can be found and working hypotheses can be formulated as suggested by the data. In an effort to find a good constitutional rule, interpretative efforts are needed, the constitution as a result of an assessment of the implementation of norms in a constitution in practice. The constitution in Indonesia has a complex history and has gone through a long debate. Where Indonesia itself had to go through four amendments, including in 1999, 2000, 2001, and 2002. Indonesia is one of the countries that uses a written constitution, namely the 1945 Constitution of the Republic of Indonesia (UUD 1945). The desired goal is to see the implementation of the existing constitution in Indonesia and the future challenges that we must anticipate together for all Indonesian people. In this study, the method used is qualitative research with a library approach. The findings of this study indicate that the application of the Constitution in the study of constitutional law has been successful. We acknowledge that there are still shortcomings that require our collective attention, and future challenges that require our collective attention and concern as a society with increasingly growing multiculturalism and transnationalism.

Abstract

Customary law is one of the living legal systems that continues to develop within Indonesian society. Its existence is constitutionally recognized and plays an important role in the administration of village governance. Villages, as the lowest level of government, possess strong social and cultural characteristics, making customary law a significant guideline in decision-making and conflict resolution. This study aims to analyze the existence of customary law in village governance from the perspective of state administrative law. The research method employed is normative legal research using statutory and conceptual approaches. The results indicate that customary law maintains a strategic position in village governance as long as it does not conflict with higher-level laws and regulations. Within the framework of state administrative law, customary law functions as a foundation for local policies, strengthens community participation, and supports the realization of democratic and equitable village governance.

Abstract

The era of globalization has changed many things, including generation Z's mindset about marrdiage. Many of generation Z feel safe when postponing marrdiage. This is clearly contrary to Islamic law, where Islam strongly recommends its followers to have a partner because by having a partner, peace of mind can be obtained besides By entering into marrdiage, someone can avoid committing adultery. This research is qualitative research or field research using observation and interviews in a semi-structured form where the researcher tries to conduct interviews from one person and then develops into many people. The results of the research state that postponing marrdiage is permitted in Islam for Shardia reasons, whereas based on the results of the author's interviews with sources, the main reasons for generation Z not getting married are 1) making their parents happy, 2) trust issues, 3) financdial, 4) education.

Abstract

Asas-Asas Umum Pemerintahan yang Baik (AAUPB) adalah prinsip-prinsip dasar yang digunakan untuk mengatur dan menilai tindakan serta kebijakan pemerintah agar sesuai dengan prinsip keadilan, transparansi, dan akuntabilitas. Dalam konteks Hukum Tata Negara, AAUPB menjadi instrumen penting untuk memastikan bahwa penyelenggaraan pemerintahan berlandaskan pada konstitusi negara serta hak-hak dasar warga negara. Artikel ini bertujuan untuk menganalisis penerapan AAUPB dalam kerangka Hukum Tata Negara Indonesia, dengan memperhatikan bagaimana asas-asas tersebut berfungsi dalam menjaga kestabilan hukum, keadilan, dan kesejahteraan masyarakat. Melalui analisis hukum normatif dan pendekatan perbandingan terhadap praktik administrasi publik, artikel ini menyimpulkan bahwa meskipun telah ada kemajuan signifikan dalam implementasinya, tantangan dalam penerapannya tetap memerlukan perhatian lebih, terutama dalam konteks kelembagaan dan penegakan hukum.
