Abstract

Inconsistency in court decisions on agrarian disputes presents a crucial problem that tests the balance between formal legal certainty and substantive justice. This research aims to conduct an in-depth analysis of the application of the elements of an unlawful act and the dialectic of judicial reasoning (ratio decidendi). The analysis is conducted in the context of an ownership dispute over a 14,000 m² parcel of land in East Kutai. This case traversed four judicial tiers, from the District Court to the Judicial Review at the Supreme Court. Employing a normative legal research method through a case study approach, a comparative-qualitative analysis of each court decision is performed to dissect the legal logic underlying the dynamics of the contradictory verdicts. The findings indicate that the Supreme Court, in its role as the judex juris, ultimately affirmed the superiority of material truth. This truth, proven by actual and good-faith physical possession, was deemed superior to the legal formalism embodied in substantially flawed ownership documents. The substantive-justice-oriented court decision of First Instance was annulled at the formalistic Appeal level, only to be restored by the Supreme Court at the Cassation level and subsequently upheld in the Judicial Review stage. It is concluded that the final decision in this case not only provides concrete legal protection for the good-faith land possessor but also contributes significantly to jurisprudence as an important precedent that reinforces the judiciary’s orientation toward achieving substantive justice in the resolution of agrarian disputes in Indonesia.

Abstract

Penelitian ini bertujuan untuk menganalisis implikasi putusan Mahkamah Agung No. 555 K/Pdt/2025 terhadap praktik bisnis di Indonesia, khususnya terkait dengan wanprestasi dan perlindungan hukum bagi pihak yang dirugikan. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan deskriptif analitis yang mengkaji putusan pengadilan dan ketentuan hukum terkait. Hasil penelitian menunjukkan bahwa putusan Mahkamah Agung memperkuat prinsip kepatuhan terhadap kontrak bisnis dan memberikan perlindungan hukum yang lebih tegas bagi pihak yang dirugikan akibat wanprestasi. Putusan ini juga menjadi preseden penting dalam penegakan hukum kontrak di Indonesia dengan menekankan pentingnya kepastian hukum dalam setiap perjanjian. Implikasi dari penelitian ini adalah bahwa putusan Mahkamah Agung memberikan jaminan kepastian hukum bagi pelaku usaha, yang dapat meningkatkan kepercayaan investor dan stabilitas dalam hubungan bisnis antar perusahaan. Selain itu, penelitian ini juga menawarkan wawasan tentang bagaimana hukum Indonesia menangani kasus wanprestasi dan peran hukum dalam menjaga integritas dan kelangsungan bisnis di Indonesia, yang diharapkan dapat memberikan panduan bagi perusahaan dalam menjaga kepatuhan terhadap kontrak dan mengurangi potensi sengketa.

Abstract

This research aims to analyze the position of evidence and the dynamics of the burden of proof in disputes over government contract payments, with a focus on their implications for legal protection of business actors and the effectiveness of state budget implementation. The method used is a case study of District Court Decision No. 7/Pdt.G/2022/PN Tolitoli, involving a lawsuit filed by a private company against the local government for default in paying the remaining budget of a public market construction project in the 2018 fiscal year. The analysis is conducted normatively by examining contract documents, amendments, proof of work completion, and correspondence between the parties, as well as the evidentiary dynamics between the plaintiff and the defendant, including public officials and central government agencies. The findings reveal that the court acknowledged the validity of the contract and its amendments as primary evidence, declared the defendant in default for failing to fulfill payment obligations despite the completion of the project, and partially granted the plaintiff’s claim while rejecting the defendant’s administrative objection. Written evidence dominated the evidentiary process, while the burden of proof shifted from the plaintiff to the defendant once the initial evidence was presented, underscoring the principle that a valid agreement binds the parties and cannot be avoided on bureaucratic grounds. In conclusion, this decision reinforces both substantive and formal evidentiary practices in civil cases, promotes transparency and accountability in government contracts, protects business actors from the risks of default, and enhances legal certainty in state budget management to support a fairer and more professional bureaucratic reform.
