Abstract

Konflik adat dan status hak tanah komunal merupakan persoalan agraria yang terus berulang di Indonesia. Tanah bagi masyarakat adat tidak hanya bernilai ekonomis, tetapi juga memiliki dimensi sosial, budaya, dan spiritual yang melekat erat pada identitas komunitas. Penelitian ini bertujuan untuk menganalisis penerapan pendekatan antropologi hukum dalam memahami konflik tanah komunal serta merumuskan alternatif penyelesaian yang lebih adil dan berkelanjutan. Metode penelitian yang digunakan adalah kualitatif dengan desain studi kasus pada tiga lokasi utama: Papua, Kalimantan Tengah, dan Sumatera Barat. Data diperoleh melalui wawancara mendalam, kuesioner, observasi partisipan, serta studi dokumentasi hukum dan adat. Hasil penelitian menunjukkan bahwa konflik tanah komunal pada dasarnya bersumber dari ketidaksinkronan antara hukum adat dan hukum positif. Hukum adat tetap hidup dan memiliki legitimasi tinggi di tingkat komunitas, sementara hukum negara cenderung menekankan aspek administratif dan sertifikasi. Temuan ini diperkuat oleh hasil kuesioner yang menunjukkan tingginya tingkat kesepakatan bahwa integrasi antara hukum adat dan hukum positif merupakan solusi ideal. Pendekatan antropologi hukum terbukti mampu menjembatani kesenjangan tersebut dengan menempatkan tanah sebagai entitas multidimensi. Penelitian ini menegaskan bahwa keadilan agraria di Indonesia hanya dapat dicapai melalui harmonisasi hukum negara dengan hukum adat.

Abstract

Cases of negligence of health workers in private hospitals raise serious problems related to legal protection for patients. This study aims to analyze the forms of legal protection available, the obstacles faced by patients, and alternative solutions in cases of medical negligence in Indonesian private hospitals. A qualitative approach with a case study design was used through in-depth interviews, observations, and document analysis at two private hospitals in West Java. The results of the study show that normative legal protection has been regulated in the 2023 Health Law and the Hospital Law, but its implementation is still weak. Informed consent is more practiced as an administrative formality, patient complaint units are less effective, and mediation mechanisms are rarely used. The main obstacles include low legal literacy of patients, the dominance of health workers in power relations, and the economic interests of private hospitals. This study emphasizes the need to improve patient legal literacy, legal-medical communication training for health workers, and optimize non-litigation mechanisms as a form of real protection. The implications of this study emphasize the importance of the active role of hospitals and the government in ensuring that patients' rights are protected, so that the social functions of hospitals can run in balance with business orientation.

Abstract

This research aims to analyze the optimization of the use of Village Funds in realizing the welfare of the people of Geneng Village, Batealit District, Jepara Regency. The research method used is descriptive qualitative with data collection through interviews, observation and documentation. The research results show that the quality of village officials' human resources is the main factor in determining the effectiveness of determining the Village Fund priority scale. Competent village officials are able to formulate development programs according to the real needs of the community, increase citizen participation, and ensure transparency and accountability in the use of Village Funds. However, obstacles such as limited apparatus capacity, lack of continuous training, and limited supporting facilities still influence the optimization of Village Fund management. This research recommends increasing the capacity of village officials, strengthening infrastructure, and developing community participation mechanisms so that the Village Fund can more effectively promote community welfare in a sustainable manner.
