Abstract

Law of the Republic of Indonesia Number 21 of 2008 concerning Sharia Banking still raises problems in the process of resolving cases within the scope of Sharia Banks. The scope of the Religious Courts and the General Courts have the same authority in resolving Islamic Banking disputes in Indonesia. This research was conducted to explore and analyze the absolute authority of judicial institutions in Indonesia in resolving cases related to Islamic banking in Indonesia. This research is normative juridical in nature by approaching the applicable laws and regulations associated with the legal issues studied. Based on the research, it is found that the District Court does not have absolute authority in resolving Islamic banking disputes. The settlement of Islamic Banking disputes according to Law Number 21 of 2008 concerning Islamic Banking can be done by choosing one of the paths, namely through litigation within the Religious Court, and secondly, non-litigation can be done by means of deliberation, mediation, the National Sharia Arbitration Board (BASYARNAS) or other authorized arbitration institutions, and the General Court.  Keywords: authority, dispute resolution, islamic banking

Abstract

The Court's judgment is necessary. The Court must examine, resolve, and decide the case filed by the Court. However, there were court errors in the decision. This study aims to determine and analyze the law on the Judge's wrong legal consideration in the Ratio Decidendi theory and the juridical implications of the Judge's decision that misapplied the law in decision Number 2802/Pdt.G/2019/Pa.Pwt. The method used in this research is normative juridical, where the law is conceptualized as what is written in the legislation. The data source in this research uses secondary data. The data collection method in this research uses literature study, namely by collecting literature such as books, scientific journals, and primary legal materials to support this research, as well as identification and clarification of legal facts in the field by asking questions to sources that are by this research. Based on the results of the study and discussion of the legal analysis of the Judge's decision, which is wrong in its legal considerations in the Ratio Decidendi theory, namely the reasons that determine the decision formulated in the verdict. This part of the consideration cannot be separated from the verdict and has a legally binding force, which can be formulated as a legal rule. The legal impact of an incorrect decision in its legal considerations does not affect the ruling but is binding on the parties, provided that it is not appealed or cancelled.

Abstract

Artikel ini menyajikan bagaimana sejarah terbentuknya Muhammadiyah yang didirikan oleh K.H Ahmad Dahlan Muhammadiyah serta menjelaskan bagaimana sejarah perkembangan Pendidikan islam di Muhammadiyah sejak awal abad ke-20. Muhammadiyah merupakan organisasi yang bergerak pada bidang keagamaan, Pendidikan serta sosial. K.H Ahmad Dahlan mendirikan Muhammadiyah dengan tujuan untuk melakukan pembaruan dalam ajaran Islam tanpa mengesampingkan peningkatan kesejahteraan masyarakat Indonesia. Tokoh-tokoh seperti KH Ahmad Dahlan menjadi focus dalam membahas visi Muhammadiyah terhadap Pendidikan Islam di Indonesia. Muhammadiyah memiliki peran yang cukup penting dalam pembangunan dialog antar agama dan dalam memperjuangkan nilai-nilai toleransi antar agama di Indonesia. Muhammadiyah telah menjadi salah satu pilar utama dalam membimbing umat Islam di Indonesia untuk menuju masa depan yang lebih baik dengandi dasarkan pada nilai-nilai islam, keadilan dan kemanusiaan.
