Abstract

Purpose: Territorial disputes remain a crucial issue within the doctrine of national sovereignty, despite international law promoting borderless cooperation. In reality, such conflicts, like the one between Palestine and Israel, continue and result in significant casualties and humanitarian crises. This study aims to analyze humanitarian crimes in the Palestine-Israel conflict zone and assess the jurisdiction of the International Criminal Court (ICC) in addressing them. Methodology: The research uses a normative legal approach based on international regulations and case studies. It relies on secondary legal sources through library research and qualitative descriptive analysis. Results: The findings indicate severe human rights violations, particularly against civilians, including women and children, and damage to non-military facilities. These acts reflect violations of humanitarian law and fall under the ICC’s jurisdiction, which includes genocide, crimes against humanity, war crimes, and aggression. Conclusion: The ICC, although limited in its reach over non-party states, remains a crucial body for pursuing justice and accountability in international humanitarian crises when national systems fail to act. Limitations: The study is confined to the humanitarian aspects of the Israel-Palestine conflict without addressing territorial status or sovereignty issues. It also affirms the ICC’s jurisdiction and the UN Security Council’s obligation to act under the principle of Obligation Erga Omnes. Contribution: This research reinforces the role and limitations of the ICC in addressing gross human rights violations and underscores the need to strengthen global legal frameworks to ensure accountability beyond state sovereignty.

Abstract

ABSTRAKTindak pidana perdagangan orang (TPPO) merupakan kejahatan serius yang melanggar hukum nasional dan internasional serta merendahkan harkat dan martabat manusia. Kejahatan ini menimbulkan penderitaan fisik, psikis, sosial, dan ekonomi bagi korban. Negara melalui Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang telah mengatur hak korban untuk memperoleh restitusi sebagai bentuk ganti rugi dan pemulihan. Namun, implementasinya di lapangan masih menghadapi berbagai hambatan, seperti ketidakjelasan mekanisme hukum, lemahnya koordinasi antar lembaga, serta rendahnya pemahaman aparat penegak hukum dan korban terhadap hak restitusi tersebut.Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap korban TPPO dalam memperoleh restitusi berdasarkan perspektif kepastian hukum, serta menelaah ratio decidendi hakim dalam memutus perkara TPPO yang memperhatikan hak-hak korban. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Sumber bahan hukum yang digunakan meliputi bahan hukum primer (undang-undang, putusan pengadilan), bahan hukum sekunder (buku, jurnal, karya ilmiah), dan bahan hukum tersier (kamus hukum dan ensiklopedia).Hasil penelitian menunjukkan bahwa secara normatif, ketentuan mengenai restitusi telah diatur dalam Pasal 48 Undang-Undang Nomor 21 Tahun 2007 dan diperkuat oleh Peraturan Mahkamah Agung Nomor 1 Tahun 2022 tentang Tata Cara Pengajuan dan Pemeriksaan Permohonan Ganti Kerugian dan/atau Restitusi. Namun, kepastian hukum bagi korban belum sepenuhnya terjamin karena belum adanya sanksi tegas terhadap pelaku yang tidak membayar restitusi, belum adanya tanggung jawab negara apabila pelaku tidak mampu membayar, serta minimnya efektivitas implementasi di tingkat peradilan. Ratio decidendi hakim dalam sejumlah putusan TPPO umumnya masih berfokus pada penghukuman pelaku daripada pemulihan korban, sehingga prinsip keadilan substantif belum sepenuhnya tercapai.Penelitian ini menegaskan perlunya reformulasi kebijakan restitusi yang komprehensif, peningkatan koordinasi antar lembaga penegak hukum, serta penguatan peran Lembaga Perlindungan Saksi dan Korban (LPSK) untuk memastikan terpenuhinya hak restitusi korban sebagai bentuk perlindungan hukum, keadilan, dan kepastian hukum.Kata kunci: Perlindungan hukum, korban perdagangan orang, restitusi, kepastian hukum, ratio decidendi.
