Abstract

 ABSTRAK Ketetapan Majelis Permusyawaratan Rakyat (Tap MPR) memiliki peran penting dalam sejarah ketatanegaraan Indonesia, namun setelah amandemen UUD 1945, kedudukannya berubah signifikan. Tap MPR tidak lagi memiliki kekuatan hukum tertinggi dan dikeluarkan dari hierarki peraturan perundang-undangan. Perubahan ini memunculkan kontroversi, terutama terkait potensi pertentangan antara Tap MPR dan UUD 1945. Tanpa mekanisme pengujian yang jelas, sulit untuk menilai konstitusionalitas Tap MPR yang dihasilkan sebelum reformasi. Penelitian ini mengusulkan pengujian konstitusionalitas Tap MPR melalui Mahkamah Konstitusi atau melalui mekanisme yang melibatkan MPR dengan mencerminkan kehendak rakyat. Studi ini juga membandingkan mekanisme judicial review di negara lain, seperti Amerika Serikat dan Jerman, untuk memberi solusi bagi penguatan supremasi konstitusi dan kepastian hukum di Indonesia. Kata Kunci: TAP MPR, Constitutional Review, UUD NRI Tahun 1945, Hirarki Perundang-undangan, Amandemen.ABSTRACT The Decrees of the People's Consultative Assembly (Tap MPR) have played a significant role in the constitutional history of Indonesia. However, following the amendments to the 1945 Constitution, their status has undergone a substantial shift, with Tap MPR no longer holding the highest legal authority and being removed from the hierarchy of legislation. This change has sparked controversy, particularly regarding the potential conflicts between pre-reform Tap MPR and the 1945 Constitution. Without a clear review mechanism, assessing the constitutionality of pre-reform Tap MPR remains challenging. This study proposes a constitutional review mechanism for Tap MPR, either through the Constitutional Court or a special process involving the MPR that reflects the people's will. The study also examines judicial review practices in other countries, such as the United States and Germany, to offer solutions for strengthening constitutional supremacy and ensuring legal certainty in Indonesia. Keywords: Tap MPR, Constitutional Review, UUD NRI Tahun 1945, Legislative Hierarchy, Amendments.
